Issue: Dealing with your lender or servicer
Subissue: Need information about your loan balance or loan terms
Consumer Complaint: Ten years ago, I started paying my direct federal student loans ( both subsidized and unsubsidized ) under the income-based repayment plan, as required by the terms of the Public Service Loan Forgiveness program. At this point I worked for a not for profit organization, after graduating from medical school with {$200000.00} in student loans. Two years ago, I realized that my payment count towards the PSLF for the subsidized loans were different than the PSLF payment count unsubsidized loans. This seemed odd because all payments made in years prior were always split between unsubsidized and subsidized loans, so how could the tally be different. At this point, XX/XX/XXXX, I filed paperwork to have this information reviewed. It is XX/XX/XXXX, and after a dozen phone calls over that time period I have yet to have an answer. I am at just about at 10 years and need to file my loan forgiveness application. Each time customer service says the same thing. Im getting tired of not being able to get answers so I can take care of whatever needs to be done to get this loan reviewed. We waited to have a family and have put off other plans trying to wait for this to resolve. The unknown makes it hard to plan major life decisions. Please help.

Consumer Complaint: I returned to school at the XXXX XXXX XXXX in XXXX to obtain my XXXX Degree when I was in my early 40s. I took out student loans with the service provider being XXXX XXXX, then XXXX. I have been a long-time government employee. When I first learned of PLSF, XXXX misled and misguided me. I later consolidated the loans with XXXX over to the U.S. Department of Education, serviced by FedLoanServicing. I had many conversations with FedLoanServicing about qualifying for PLSF and what repayment plan was required for me to qualify. I was misinformed and misled by FedLoanServicing, and after several years of repayment, I was told that I was not in the correct repayment plan. I recently retired in XX/XX/XXXX, and my income is considerably less than last year. I need help in getting my student loan debt straightened out, if not forgiven. The balance has increased so much that I cannot understand why or how.

Issue: Incorrect information on your report
Subissue: Information belongs to someone else
Consumer Complaint: There are three loans on my credit report that have the same opened day as my real loans. The account number, lenders information and term length are not the same. The debt amount is off by a few dollars. The name of the lender is listed as the Department of Education but the address XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, VA XXXX Does NOT belong to them. Its belongs to XXXX, a software company. I have called the department of education but they do not do anything because they dont look past the fact that I do have loans with the same start date. Borrowers Defense denied my claim despite proof from my student loan account records showing an amount for twice my student loans. The financial records show double the amount but my XXXX only list three which is correct. I wasnt charged at an interest rate of 100 % in a time span of XXXX ( which is when they appeared ). They do say that the loans are from being transferred as a result of defaulting. They were on deferment as I was having an economic hardship. I was in the midst unemployment which resulted in an eviction. The default was a surprise. What they ignore is the fact that last year alone, disbursements were made for about {$30000.00}. I only owe {$14000.00}. Two of the loans were issued for a year I never applied to. I attended XXXX XXXX XXXX and was told to give one of the financial aid workers my application and they would help but I didnt hear back from US Dept of Education. Even my statements listed another company as the lender. The school said I would owe them. I also reported this but no one has ever taken it seriously despite proof. Is it not illegal to ask someone to pay a debt that was fraudulently acquired or isnt theirs?

Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: FedLoan Servicing was mailed disputes regarding my credit report for XXXX months worth of late payments reported from XXXX and XXXX of XXXX causing me to have XXXX ( XXXX ) late payments show on my credit. After more than 6 months it was finally resolved and FedLoan Servicing sent correspondence to me and also here that the issue will be corrected and the update will reflect on my credit reports within 60 days from XX/XX/XXXX which it was. However, FedLoan Servicing came back here on CFPB in XXXX and stated that again there was another error and the correction to remove the late payments from XXXX and XX/XX/XXXX was also removed in error and that the late payments should remain on my credit reports. My issue with FedLoan Servicing is that they are not resolving an issue that they created. I have sent several disputes to this company and have not received any form of resolution this has taken a toll on me mentally, physically, and emotionally to have to endure pain and suffering all because of their mistakes. No one at this company has taken accountability to resolve my issue, please assist and I want these late payments to be removed once again from all three ( XXXX ) of my credit reports immediately. For their company to agree to update this information then later go back and add it to my report is destructive to my credit worthiness and illegal.

Issue: Struggling to repay your loan
Subissue: Can't get other flexible options for repaying your loan
Consumer Complaint: I have a loan that originally cost {$6500.00}. My mother was convinced to pursue this loan. At the time I was XXXX years old and just trusted her. She signed a variable rate loan. To this day I have paid {$3900.00} in interest and XXXX in principal. I have attempted to reach an agreement and give them a lump sum. The companies response is simply that you cant negotiate your loan terms. I still owe XXXX because they raise the rate every quarter and I end up owing more than when I did in XX/XX/XXXX and it is not XX/XX/XXXX of the following year. If this is legal than I'm going to change careers and start taking advantage of kids in college and get them to sign loans under terrible terms.

Subissue: Problem with customer service
Consumer Complaint: This complaint is related to Fedloans our student loan servicer under contract by the Dept of Education. Unfortunately, this is not our first complaint against the company. Each year we re-apply per the program guidelines for our Repayment plan. Weve been with Fedloans since XX/XX/XXXX when our loans were transferred to them ( through no choice of our own ). It has been nothing short of a nightmare. The current complaint relates to poor customer servicer and unreliable information being given as we try to repay our loan. Each year were required to re-certify our income for the recalculation of our student loan payment. Each year the process is unpredictable and frustrating due to the variety of guidance we are given by the servicer themselves. This year even though our financial situation hasnt changed thee experience has been horrible. We re-applied using a form that has never reflected our unique situation. So like in the past 5 years I submitted a cover letter explaining our situation and that we have answered the form to the best of our knowledge. This year I inadvertently selected the wrong box on the form and was asked to correct the form which I immediately did and returned for the servicer. That sent us into three additional rounds of applications whereby we were given conflicting information by Fedloans providing us opposite guidance as to how to complete the form and what info to provide. Our loan is a spousal consolidation loan and from my understanding they review both my income and that of my ex-wife ( although I was even told something different from one agent this year ). Not only has the guidance evolved this year but in recent years we were given alternating advice as to how to complete the form. This year after the first mistake was made ( admittedly by myself ) the servicers told us the following. Round One- I submitted on the application on XX/XX/XXXX w ith both my income and my ex wifes income with both our signatures. ( I mistakenly checked the wrong box on the form which didnt change the results of what we submitted ). In then end they got what they needed to do the calculation. Round Two- I resubmitted my income on XX/XX/XXXX ( changed the wrong check box ) and my ex-wifes income and one application form. Round Three- I was told to re-submit my income and signature on the application without my ex wifes info. I was told the payment would only consider my income ( like last year ) since my ex-wife has separate student loans of her own and because I signed the form as single. Resubmitted on XX/XX/XXXX Round Four- I was told to re-submit an application for myself and have my ex-wife submit an application separately with her income. ( The very same info was provided in the first round. ) The issue is still unresolved. In each of these replies Ive attached a cover letter explaining the changes as directed by Fedloans staff and it doesnt seem to matter. Each time you speak to someone different, rather than having one rep assigned to solve your case. This business practice is absolutely ridiculous and found no where else in the consumer world. This has been standard practice for years. I asked a rep about this recently and she told me we can all answer any questions a borrower might have so you dont need to speak to a particular person. This strategy obviously does not work because either they are not taking notes in their system or the agents have different levels of expertise. The frustration here is that we can not trust what the servicer tells us and even though our financial situation has not changed in recent years we go through this exercise with bad customer service and face uncertainty along the way. Of all our financial commitments this presents the most stress and uncertainty on an ongoing basis. Ive never even come close to having this experience with a market driven consumer product. With a mortgage or car payment you get your payment and can plan for the certainty for years. ( Not with federal student loans. ) These variations in application data can and have drastically alter what we pay in student loans from XXXX monthly to XXXX monthly which is a wide swing for a consumer product. Once our payment went from XXXX monthly to XXXX monthly even though our financial situation hadnt changed. Worse yet is we dont really know how they compute the payment amount. Calculators that are available on the Federal Student Aid website have never accurately depicted how our payment was calculated and Ive been told various things by customer service agents on the phone as illustrated in my current complaint. I have past written guidance from Fedloans that the servicer doesnt even follow - so nothing can be trusted. PLEASE HELP US!! XXXX XXXX XXXX

Consumer Complaint: My student loans were serviced by fed loans servicing ( total 13 accounts ) instead of one account. These 13 accounts are being rehabilitated by US Dept. of Education. Therefore, all accounts now has been transferred under Dept. of Education. However, on my credit report the same loans are being reported as collections and 120 days late with XXXX balance by Fed loan Servicing and repeated by US Dept. of Education. totaling 24 negative items. I have tried disputing this error several times and investigation from the credit reporting agency has not been addressed. The investigation returned as complete with a few changed dates. I am still being double dinged for the same 12 items.

Consumer Complaint: XX/XX/2019 I noticed a late payment reported by FedLoans. I have not had any contact with this company about a payment or had received a notification regarding a payment due. I had a loan payment agreement with XXXX XXXX. After making payments with them to process the loan they were involved in a lawsuit and my payments were no longer taken from my bank account. Then I noticed on my credit report that I was late on a {$20.00} payment with Fedloan which I was never notified of. I then contacted Fedloan to see how and what the late payment was from they stated they had sent a notice to me and I was late for my student loan. They never established a payment agreement of any kind nor had they ever contacted me for this payment. I have since tried disputing the incorrect reporting and Fedloan processed my dispute as I did have a loan and the loan did belong to me. I never disputed having a loan I disputed Fedloan establishing a payment agreement without my knowledge or consent. The representative at Fedloan states they sent a letter to me but they did not have my address verified nor did they provide any proof any letters were ever sent. This has made a negative impact on my credit.
