Issue: Dealing with your lender or servicer
Subissue: Trouble with how payments are being handled
Consumer Complaint: I have been enrolled in the Public Service Loan Forgiveness Program since XXXX. I have recertified my loans as required, and have never missed a payment. I am approximately 7 years into the program. Each time my loan splits into separate loans because of the maximum balance allowed, the payments are not updated. I recertified in XX/XX/XXXX, and am now showing only 10 qualifying payments. I have reached out numerous times and all but 10 of my payments since XXXX are under manual review. They have been under manual review for about 6 months. Each phone conversation I have has resulted in no advancement in the updating of my PSLF status. I am given vague answers with reasonable time frames to expect resolution, however my payments continue to be uncounted and my account remains outdated. I need this updated so I can plan when my loans are expected to be forgiven, and be sure I am being credited accurately.

Consumer Complaint: I XXXX XXXX the consumer, original creditor, natural person. Pursuant to Federal law 15 USC 1692 American Education Services is a 3rd party debt collector and is in violation of 57 Federally protected consumer law violations. American Education Services has failed to obtain and send verification of this alleged debt by not mailing me a contract. Instead of sending me a contract of this alleged debt, American Education Services sent statements which alleges we have a business agreement and we do not. Under the FDCPA it is unfair or unconscionable to attempt to collect an alleged debt in any amount that is not expressly authorized by an agreement creating the debt or permitted by law. Due to the fore going, you have caused me additional stress, frustration, credit damage, and costs. Furthermore, I XXXX XXXX the consumer, original creditor, natural person am not delinquent because there is no law that defines delinquency. This was initiated through the use of the open end credit using my social security card pursuant to 15 USC 1602 ( f ). You have also waived your opportunity to amicably resolve this issue without the need to litigate. This was your last opportunity to mitiage this matter and as a result I intend to forward this matter to an attorney or initiate litigation against you under the FDCPA.

Consumer Complaint: My student loans were transferred from XXXX to MyFedLoan in XX/XX/XXXX. I was in an income based repayment play with XXXX. Without my consent, myfedloan took me out of income based repayment and placed me in forbearance. I discovered this, and I called Myfedloan at the time and asked not to be placed in forbearance. However they said they were unable to do this, but that I could make the payments anyways and then submit a request to have those payments " accepted ''. I made the payments on time and submitted this request to have those payments accepted. Myfedloan sent me a letter in XXXX documenting that they were going to accept those payments. However, now, 4 years later, their system for tracking eligible payments has my payments from XXXX and XX/XX/XXXX marked as ineligible since I was in forebearance. I called about this in XX/XX/XXXX and after a long phone call they said that this was a mistake on their part and that it would be corrected. I called back several months later to check in on the status of this and they said they were working on it. I called again in XX/XX/XXXX and they said the request was never put in, but that they would put in the request now. I contacted them again in XX/XX/XXXX and they said that they were working on it, but were unable to give any time frame for expectations of completion. The system does not show that they are working on it. I can not accept that it takes more than 11 months to correct their own administrative mistake. I've been unable to escalate my concerns to anyone at myfedloan to get assurances they are actually working on it or to get an actual timeframe on how long this should take to fix.

Consumer Complaint: I contacted FedLoan Servicing to request a temporary address change for a few months in XX/XX/2015. I had to go out of the country to check on my daughter who was living in the XXXX for medical school. I made the request in XX/XX/2015. Even though I made the request, I never received my student loan statement to my new address for the few months that I was living in the XXXX. I wasnt made aware that there was a bill due because fedloan did not do as they said that they would and update my temporary address. All dates that I would be gone we also notated. This is very unfair and unjust.

Consumer Complaint: I submitted a Employment Certification form to FEDLOAN SERVICING on XX/XX/XXXX to certify 5 addition months towards loan forgiveness. I have contacted them several times in regards to this. Now, that I'm closer to the 120 month requirement, they have not certified the additional five months. My account was in review for several months back in XXXX for this VERY SAME THING. I'm employed with the same employer, XXXX XXXX XXXX XXXX, for the entire ten years. It's almost time for my loans to be forgiven and I want this to be a smooth process. Can you please assist with getting the previously submitted Employment Certification form processed so my account will reflect accurate information. Because as it stands right now, the information is inaccurate. The total to date should be XXXX Certified payments and XXXX Eligible payments. XX/XX/XXXX would not be certified as a new Employment Certification form would be needed. Thanks

Consumer Complaint: This has been going on for 18 months. Fed Loan servicing is incorrectly reporting payments. I consolidated my student loan with XXXX in XXXX of XXXX, paying off Fed Loan completely. When we went to buy a house in early XXXX, we found that they were saying I was 120 days late as of XX/XX/XXXX. When we submitted a dispute, they told us it was correct. I went to check the emails they sent to my mailbox on their system and they were no longer available because the account was closed. They continued to report it wrong until I finally a lawyer involved. So he started to challenge the entries on my credit report and every time he does, Fed Loan servicing reports to my credit reports erroneously which then lowers my credit score even more. This is retaliation because we want them to report correctly and correct their mistakes. Eventually, they correct the mistakes, but it does not correct the damage they have done. It has happen again where they are saying I am 120 days late as of XX/XX/XXXX when they were paid in full in XXXX of XXXX. This is costing me the chance to buy a house and thousands in high interest rates. I don't know where else to turn.

Consumer Complaint: I was contacted by PHEAA in regards to a wage garnishment placed on my paycheck due to outstanding debt XX/XX/2019. They said they were representing AES and the US department of Education in regards to my student loans and that to resolve " all '' of my student loan debt and it was all, I asked several times, I would need to complete an aggressive repayment plan which I completed. Before completion, I was informed by a different agency that all of my student loan debt wasn't included. I am now working with XXXX and XXXX to settle the debt I thought was already settled. I can pay the full rehabilitation needed to be paid in full to rectify credit standings with XXXX and XXXX. I was approved for a construction loan until this debt ( that I had aggressively paid on time through rehabilitation ) was flagged on a report. I am not saying I don't owe the debt. My issue is if I am told all my federal student loan debt was included by an acting representative of the US Dept of Education only to find out it is not, is fraudulent and very misleading. I have asked for guidance with this and have been sent to the various subsidiaries of US Dept of Education super conglomerate only becoming more confused. I am now paying 11 percent interest on a loan because I was unable to get a construction to mortgage loan, because I trusted the word of PHEAA and AES.

Consumer Complaint: I had been waiting for review of several of my payments that were finally marked " eligible '' after over a year of waiting for them to review them. Once they did review and mark the payments " eligible, '' I have 121 ( and now more ) payments out of the 120 needed for forgiveness as of XXXX of 2020. I submitted my application for public service loan forgiveness immediately after receiving this information from Fed Loan. I have heard nothing from them, nor have I received any documents. I called again today and asked the status of my application. The agent stated that my application had been approved for forgiveness and now it will take 4-6 months to have them officially discharge the debt. The agent could not give me much information aside from saying it would be 6 months for Federal Student Aid to " officially process the forgiven loan. '' This is absurd as I have worked well over 10 years in public service, paying my student debt and continue to have to wait for this company to do their job and obligations under my loan. And now that I am eligible and even APPROVED for forgiveness, it will take another 6 months!?!?!?

Consumer Complaint: How are you doing during this pandemic? Hoping that youre safe and sound. Listen, I was shocked when I reviewed my credit report this week and I found multiple inaccuracies on my credit report from the 3 major credit bureaus from a collection company that I never have dealt with before. I've attempted several times to ratify the issue with the original creditors and credit bureaus and they still reporting inaccurate, unverifiable information. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. What is your authorization of law for your collection of this alleged debt? 4. Please evidence your authorization to do business or operate in this state. 5. Please evidence proof of the alleged debt, including the alleged contract or other instrument bearing my signature. 6. Please provide a complete account history, including any charges added for collection activity. You have 30 days upon receipt of this letter to provide strict proof of contract. In the event you can not provide strict proof of contract, you must cease and desist any and all collection efforts and immediately remove any derogatory information reported to the consumer reporting agencies. In addition, you will need to provide me your agreement, in writing, that you are closing your file, ceasing collecting activity, and deleting all information related to this reference number from any and all credit reports youve furnished the information to. In the event you transfer this account to an attorney without providing proof of contract, and proving your claim, he/she will be immediate reported to the XXXX XXXX XXXX and XXXX XXXX XXXX for code of ethics violations.

Consumer Complaint: Previously, I filed a complaint XXXX regarding how FedLoan Servicing was counting my qualified payments for XXXX. On XX/XX/XXXX, FedLoan Servicing provided the following response and my complaint was closed : " The Office of Consumer Advocacy ( OCA ) at Pennsylvania Higher Education Assistance Agency ( PHEAA ) performed a review of your account. Specifically, we reviewed your payment history, your repayment plan history, and your forbearance and deferment history with each of your servicers. Please Note : PHEAA conducts its student loan servicing operations commercially as American Education Services and for federally-owned loans as FedLoan Servicing. In your inquiry you expressed concern regarding the number of payments credited toward your pursuit of loan forgiveness under the XXXX XXXX XXXX XXXX ( XXXX ) program. Our review of your account determined that you submitted Employment Certification Forms ( ECF ) that were approved for the following periods : XXXX XXXX Government - XX/XX/XXXX XX/XX/XXXX, XXXX XXXX XXXX - XX/XX/XXXX - XX/XX/XXXX, Ga XXXX Defender Standards - XX/XX/XXXX To XX/XX/XXXX, XXXX XXXX XXXX XXXX - XX/XX/XXXX To XX/XX/XXXX, Ga XXXX XXXX XXXX XXXX XX/XX/XXXX XX/XX/XXXX, XXXX XXXX Government - XX/XX/XXXX To XX/XX/XXXX, XXXX XXXX Government - XX/XX/XXXX To XX/XX/XXXX, And XXXX XXXX Government - XX/XX/XXXX XX/XX/XXXX. You have made 105 XXXX-qualifying payments. You can view additional details online at MyFedLoan.org. If you have additional questions regarding your account, please contact FedLoan Servicing at XXXX. Loan representatives are available Monday through Friday from XXXX XXXX to XXXX XXXX XXXX. '' In fact, on my online FedLoan Servicing account the payment tracker was updated to 105 qualifying payments. On XX/XX/XXXX, I received a letter from FedLoan Servicing stating that my XXXX for XXXX had been approved, which was the period of employment that was in controversy previously. Shortly before the New Year, I checked my online account again because I had submitted another ECF for XX/XX/XXXX and XX/XX/XXXX and wanted to check the status. I found that my qualifying payment tracker was back down to 93 and the payments made during XXXX were now, again, not qualifying. Of course, when I call or chat with FedLoan Servicing, no one can explain to me what is going on. I need this fixed, again.
