Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: I filed a complaint regarding a hard inquiry on my credit report on XX/XX/ from a US bank and stated that I have never done any business with a US bank in the past or present. US bank replied to the complaint mentioning that the hard inquiry was part of the application process. They mentioned that the application that they assumed I filled out was rejected, and the reason was " UNABLE TO VERIFY IDENTIFICATION INFORMATION ON THE APPLICATION. '' I have never applied to anything with a US bank, and their letter indicated that the identity of the applicant was not verified. I tried to call US Bank several times to ask about what kind of application it was because I never applied to anything with US Bank, but I always get a recorded message asking me to go to their website to get an answer to most of the questions. US bank refused to remove the hard inquiry on my credit report even though they were unable to verify the identity of the applicant.

Consumer Complaint: As of XX/XX/2023 I have noticed fraudulent accounts and inquiries on my credit and consumer reports and other consumer reporting agencies. These fraudulent accounts must be removed permanently and indefinitely in my ftc reports its listed incorrect names addresses and employment this is grounds for removal!!! FAIR CARES ACT DISPUTE Law 15 U.S.C. 1681-1681x The Act ( Title VI of the Consumer Credit Protection Act ) protects information collected by consumer reporting agencies such as credit bureaus, medical information companies and tenant screening services. Information in a consumer report can not be provided to anyone who does not have a purpose specified in the Act. Companies that provide information to consumer reporting agencies also have specific legal obligations, including the duty to investigate disputed information. In addition, users of the information for credit, insurance, or employment purposes must notify the consumer when an adverse action is taken on the basis of such reports. The Fair and Accurate Credit Transactions Act added many provisions to this Act primarily relating to record accuracy and identity theft. The Dodd-Frank Act transferred to the Consumer Financial Protection Bureau most of the rulemaking responsibilities added to this Act by the Fair and Accurate Credit Transactions Act and the Credit CARD Act, but the Commission retains all its enforcement authority.

Subissue: Old information reappears or never goes away
Consumer Complaint: Over four months ago, I contacted US Bank regarding three credit card accounts that belonged to my deceased brother, XXXX XXXX XXXX XXXX, SS # XXXX, who passed away back in XXXX. Since I am the executor of his estate, the purpose of my follow up with them was to obtain 1099Cs for discharged of his alleged debts so that I could file his final tax returns for XXXX. US Bank was kind enough to do this and they forwarded three 1099Cs which I used to file my brothers taxes. ( copy attached ) Unfortunately US Bank continues to report on my brothers credit reports that he still owes them on these three accounts even though they clearly have discharged them. My accountants and consumer protect attorneys have advised me that regardless of the issuance of 1099Cs, US Bank is still in the position to either attempt to collect or sell off these debts to a third party as long as they are reporting these accounts to the credit agencies and while these accounts appears on his credit reports. While I do not think that this is a malicious act by US Bank nor their intention, I am nevertheless concerned about dealing with this subject in the future as my brothers estate is empty of any money and closed. I mailed and also faxed a letter to US Bank on this matter on XX/XX/XXXX ( copy attached ). On XX/XX/XXXX, I followed up with US Bank and after an hour of being transferred to half a dozen departments and twice that number of confused representatives, I talked to XXXX, a supervisor in the Escalation and Collection Department, who told be that to her knowledge the debts were discharged and should not be reporting to the credit reporting agencies. Nevertheless as of today these account are still being reported to the credit reporting agencies despite what US Bank is saying. Their inability to correct this problem is disconcerting to me and so I am turning to the FCRA to assist in getting them to put an end to this matter by ceasing to report these closed and discharged debts.
