Consumer Complaint: As of XX/XX/, XXXX began billing me for an alleged student loan I, XXXX XXXX : Beneficiary allegedly owe. However me being the beneficiary it doesn't benefits me to repay an alleged loan. I am writing to address the matter of the student loan debt associated with my account. I am the beneficiary of the XXXX XXXX Living Trust, and repaying this student loan debt is not beneficial based on a careful consideration of various factors. Firstly, I would like to draw attention to the etymology of the word " repayment, '' which implies paying again. As a beneficiary of a living trust, it is my understanding that repaying an alleged loan would mean paying twice, which does not align with the equitable principles that govern trust relationships. Everything is a trust. How? Because everything is an agreement and if anything has my name on it thats a legal title of my estate. Now lets look at the work credit which means trust. Now lets look at the word report which means property. My credit report is my trust report which is my property. Furthermore, the maxim of equity states that equity does not punish. Repaying an alleged loan, particularly one that may not be legally enforceable or valid, could be perceived as a form of punishment. Equity regards the beneficiary as the true owner, and the trustee is obligated to uphold their duties in settling the account. Considering the aforementioned principles, I kindly request the following actions : Account Review : I request a thorough review of the alleged student loan debt associated with my account in light of the trust relationship and equitable considerations. Account Settlement : If the debt is found to be valid and legally enforceable, I request clear instructions on settling the account. As the beneficiary, I trust that the trustee will uphold their duties to settle the account. Removal from Credit Reporting Agencies : I request the immediate removal of any adverse reporting related to this alleged debt from credit reporting agencies, as it is not beneficial to the beneficiary 's interests. You're furnishing this information to the credit reporting agencies which makes you the trustee. If you're not the trustee then you're a stranger. Its three parts to a trust. Trustee, settlor, and beneficiary. If you're not the trustee then you need to hand me my property back. I appreciate your attention to this matter and look forward to a fair and equitable resolution. If there are any specific procedures or documentation required to facilitate this process, please provide them at your earliest convenience. Thank you for your understanding and cooperation.

Consumer Complaint: I am a victim of identity-theft. I am writing to request that you block all the following fraudulent accounts in my files with Transunion, XXXX, and XXXX. This information does not relate to any transactions I made. I did not authorize anyone to use my personal information. I hereby exercise my legal rights enacted by The Federal Trade Commission, which explicitly states when a victim files an affidavit it shall beg honored by all credit bureaus and all fraudulent information must be blocked within 4 days and proper notification shall be given to all furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with XXXX XXXX XXXX XXXX Consumer Financial Protection Bureau, and Attorney General with legal action of your companys unlawful collection practices, misrepresentation of reporting inaccurate debts, and noncompliance to adhere to laws enacted to help those who are victims of identity-theft. I request that an extended fraud alert be placed in my file explaining that fraudulent applications may be submitted in my name. Do not extend credit without first contacting me personally and verifying all applications.

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' TransUnion, XXXX, and XXXX are consumer reporting agencies and I am the XXXX. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies TransUnion, XXXX, XXXX, and XXXX XXXX XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX XXXX XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' XXXX XXXX XXXX ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX XXXX XXXX is not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. I also requested all corporations to fill out a form 1020 and return back to me and still haven't gotten it. I have asked XXXX XXXX XXXX to also show proof that the debt is mine by sending me a copy of the master promissory note bearing my signature in which was never sent or provided to me.

Consumer Complaint: 15 USC 1681 a ( d ) ( 2 ) ( A ) ( i ) clearly states that transactions between the consumer and the Person/Corporation making the report is NOT included on the consumer reports. Yet TransUnion, XXXX XXXX XXXX is reporting this information. The reporting of excluded information pursuant to 15 USC 1681 a ( d ) ( 2 ) ( A ) ( i ) on a consumer report is a clear violation of Metro2 compliance. Provide me with the Metro2 compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been validated, lets be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. TransUnion, XXXX, XXXX and the creditors reporting collections/Charge-Offs, late payments/other derogatory information in my consumer report are in violation of 26 USC ss 6050P Returns Relating to the Cancellation of Indebtedness By Certain Entities. If this derogatory account information is not deleted from my consumer reports within 30 days, I will be forced to officially file IRS form 3949A : Information Referral AND IRS form 211. Application For Award Original Information Overview with the Internal Revenue Service against ALL entities involved.
