Consumer Complaint: I am writing to dispute the accuracy of the information contained in my credit report done by Trans Union on XXXX On XXXX at XXXX pacific time. I called Trans Union dispute department, spoke with XXXX regarding my Investigation Results. I Asked Why was the information deleted from my credit report? XXXX reports that XXXX XXXX XXXX reports that I opened an account on XXXX XXXX XXXX and closed on XXXX XXXX XXXX. She informs me that the " Account DID Not belong to ME. It's Another person 's account that's placed on my report. '' This was not in the Investigation Results that was provided to me. I've requested a full report from Trans Union File Number : XXXX. In the full report it does not inform me that another 's person 's account appeared on my credit report. Today XXXX I called Trans Union dispute department at XXXX pacific time and spoke with XXXX XXXX I requested a full disclosure on this incident. I made it clear that the investigation has been completed and I wanted the information about another person 's account being placed on my credit report. XXXX said that he will have that mailed to me within 7 days. He left me on hold and never came back. At XXXX I am still on hold. minutes later the phone hangs up and line went dead. Trans Union was not transparent with their investigation and providing an accurate report.

Consumer Complaint: " Survivor '' ( hereinafter referred to as Account Opening Affected Consumer ) Who at all times relevant is a Resident of the Commonwealth of Pennsylvania did not provide any written documentation providing consent for my information to be sold. Specifically, my personal information is currently under a security freeze under all XXXX CRAs and has been reported to the FTC as stolen. The respondent has engaged in unfair and abusive acts or practices that violate 1031 ( c ) ( 1 ), ( d ) ( 1 ), ( d ) ( 2 ) ( B ), and 1036 ( a ) ( 1 ) ( B ) of the CFPA. 12 U.S.C. 5531 ( c ) ( 1 ), ( d ) ( 1 ), ( d ) ( 2 ) ( B ), 5536 ( a ) ( 1 ) ( B ). Section 1036 ( a ) ( 1 ) ( B ) of the CFPA prohibits abusive acts or practices. 12 U.S.C. 5536 ( a ) ( 1 ) ( B ) .The Bureau did not propose to prescribe what an adverse item of information in a consumer report is, because it may vary depending on the weight each individual user of a consumer report gives to certain items of information as well as the consumers individual circumstances. The Bureau stated this information could include the evaluation of factors enumerated in section 603 ( d ) of the FCRA on consumer reports such as : credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of livingThe recruitment, harboring, transportation, provision, or obtaining of a person for labor or services, through the use of force, fraud, or coercion for the purpose of subjection to involuntary servitude, peonage, debt bondage, or slavery. Under 1036 ( a ) ( 1 ) ( A ) of the CFPA, it is unlawful for covered persons to offer or provide to a consumer any financial product or service not in conformity with Federal consumer financial law, or otherwise commit any act or omission in violation of a federal consumer financial law. 12 U.S.C. 5536 ( a ) ( 1 ) ( A ). act or practice is abusive if it takes unreasonable advantage of the consumers inability to protect his or her interests in selecting or using a consumer financial product or service. 12 U.S.C. 5531 ( d ) ( 2 ) ( B ) .Misused Sensitive Customer Information to Open Unauthorized Accounts E-OSCAR.org website is a creation of the Credit Reporting Agencies . Perversely, they refuse to be treated as such in violation of 1022.140 Prohibition against circumventing or evading treatment as a consumer reporting agency ( a ) A consumer reporting agency shall not circumvent or evade treatment as a consumer reporting agency that compiles and maintains files on consumers on a nationwide basis, as defined under section 603 ( p ) of the FCRA, 15 U.S.C. 1681a ( p ), by any means, including, but not limited to : ( 1 ) Corporate organization, reorganization, structure, or restructuring, including merger, acquisition, dissolution, divestiture, or asset sale of a consumer reporting agency ; or ( 2 ) Maintaining or merging public record and credit account information in a manner that is substantially equivalent to that described in Paragraphs ( 1 ) and ( 2 ) of section 603 ( p ) of the FCRA, 15 U.S.C. 1681a ( p ). Duties of users making written credit or insurance solicitations on basis of information contained in consumer files ( 1 ) In general.Any person who uses a consumer report on any consumer in connection with any credit or insurance transaction that is not initiated by the consumer, that is provided to that person under section 1681b ( c ) ( 1 ) ( B ) of this title, shall provide with each written solicitation made to the consumer regarding the transaction a clear and conspicuous statement thatthe consumer has a right to prohibit information contained in the consumers file with any consumer reporting agency from being used in connection with any credit or insurance transaction that is not initiated by the consumer ; the Bureau provided examples of adverse items of information that include records containing derogatory information, such as payment delinquencies or defaults reported to a consumer reporting agency on a loan or large purchase, records of coerced debt where a loan is taken out by a victim of trafficking under force or threat, records of criminal arrests and convictions, and records of evictions or non-payment of rent. The Bureau is adopting 1022.142 ( b ) ( 6 ) ( ii ) with revisions to clarify that, in addition to the consumer, a representative designated by the consumer may identify items of adverse information that should not be furnished by a consumer reporting agency and that the consumer must provide a preferred contact method relating to the consumers request to block adverse information that resulted from trafficking. The Respondents are in violation of but not limited to ; 604 ( f ) of FCRA, 15 U.S.C. 1681b ( f ) Consumer reporting agencies are required to use that method of contact and are prohibited from using that information for any purpose other than to communicate about the consumers request as described in 1022.142 ( d ) through ( f )
