Consumer Complaint: We requested mortgage assistance that would decrease our monthly payments and remove our delinquency ( such as a modification ), instead we were offered a repayment plan that doubled our monthly payment of {$1300.00} to {$2700.00} and had a balloon payment of {$13000.00} at the end of twelve months. We are having financial hardships and have had since XX/XX/XXXX when my husband lost his job because of the global financial crisis of XX/XX/XXXX. We have been going back and forth with Select Portfolio Servicing since to receive an affordable house payment. They did lower our payment from over {$2200.00} ( more than our income ) to {$1300.00}. Even though they lowered our payment, the new payment had a debt-to-income ratio of 70 %, leaving us without enough money to our bills. For over eight years we had built up debt to friends, family and neighbors that loaned us money and have struggled to repay the loans. Our mortgage servicer SPS has continually told us that there are investor restrictions preventing them from giving us an adequate loss mitigation program. We have read the pool servicing agreement and do not see this restriction. They also had claimed to participate in HAMP but treated all our HAMP applications as a non-government request and have not acknowledged that our request were HAMP. They also claim that there are investor restrictions against a HAMP loan as well. We submitted XXXX HAMP applications at the end of XXXX and were turned down on both. We are very tired of this ten year run around and wish to resolve our problems without losing our home.

Consumer Complaint: This is in regards to claim number # XXXX for your site would not let me enter my dispute. Per the attached letter dated XX/XX/XXXX, states the modification offered on XX/XX/XXXX w/payments in the amount of {$1100.00} to be honored. When in fact per the docs I uploaded previously, I was approved for a trial modification starting XX/XX/XXXX for {$1100.00}. SPS has the wrong date and amount which draws concern. In addition, they provide a XXXX tracking # along with stating that it was left by my front door. This draws even a greater concern that docs of such importance were sent with the instructions to be left at my front door, which could have been taken or blown away. Why is it acceptable for my final modification which is time sensitive. This goes right along with all the other additional mail SPS claims they sent, in which I never received. It is upon poor judgment that these docs were sent. Therefore, SPS clearly expressed that they have no knowledge or record of me receiving several documents from them, but received all documents that were required by me for I sent them via XXXX with signature being required for I knew I needed verification they received such. To send my final modification in such a manner only leaves me with the impression that SPS hopes I do n't receive it. Any and all formal documents should always be sent with a returned receipt. I can not be held responsible nor should I be penalized for not receiving something XXXX says they left at my front door. XXXX/XXXX have been notorious for logging deliveries in which were never delivered. In addition, I know that both offer a service that if no one is home to sign they leave a notification on your door to either come back or you can pick up from a sub station. I have expressed on numerous occasions with SPS that if documents are being mailed other than USPS than they should be sent to my work address so that I can obtain them or sign for them as needed : Once again the address for overnight, priority or certified mail should be sent to XXXX c/o XXXX, XXXX # XXXX, XXXX, NV XXXX. To continue with additional issues I have never stated that SPS is to cease verbal communication with me and I always request when I call in or agree to the conversation being recorded. Again, here is another act of SPS trying to deflect blame on the homeowner. Now because the final modification was n't signed/returned in a timely manner they are unable to honor the modification but yet will offer me a new trial modification for {$1.00}, XXXX or offer me an alternative option if I can not afford. This is a bait and switch. The modification program in which I went through loss mitigation and spoke with SPS attorney 's not once but twice and my approved amount was based on my monthly income in which as of today remains the same. Based on the all the records SPS determined I could afford the {$1.00}, XXXX therefore {$1700.00} is setting me up to fail. SPS needs to send the final modification to my work address so that I am guaranteed to receive it. Finally, if payments where to begin on my final modification XXXX/XXXX/XXXX, why is it that I continued to pay {$1100.00} which was not returned but the bank applied. It was n't until XX/XX/XXXX when I called in for a status of my final modification was I informed that I never returned the final modification which resulted in SPS returning the XXXX 's payment. Question, if I would have never called in for a status its likely that my payment would still be to this day being applied. These are malicious acts upon SPS and I have complied with all required of me so why would I have jumped through all these hoops and get to the final stage and ignore it? I would n't, and my continue payments are proof of that. I 'm sure SPS would not except if I said well I have a tracking # that XXXX delivered a payoff check.

Consumer Complaint: In XX/XX/XXXX, I refinanced my mortgage with XXXX for XXXX. On or about the end of XX/XX/XXXX, we fell delinquent on our mortgage. My wife and I applied for assistance with the State of Pennsylvania, our application was approved and XXXX brought our mortgage current. At the time, we signed a note for approximately {$28000.00} ( which I am currently repaying ) and it is my understanding that this brought my mortgage fully current and my balance with XXXX was now {$220000.00}. Within 30 - 60 days of bringing my mortgage current, the loan was sold to Select Portfolio. Soon after Select received my mortgage, my mortgage was current but they contacted me to tell me that it was their policy that my property taxes and homeowners insurance would need to be escrowed. My wife and I were fine for several years, I was not delinquent but I am not sure that an escrow account was established as there was no change in my payment. In XX/XX/XXXX, my daughter passed away. I was on a fixed income and I was responsible for yet another funeral and I decided to contact the mortgage company to see if there was anything I could do to reduce my payment. Over the phone, the specialist was able to reduce my mortgage to {$230.00} from {$1500.00}. That is the amount that we began to pay on or about XX/XX/XXXX. I was under the impression that Select had established an escrow account and this was my payment. My wife died in XX/XX/XXXX, in XX/XX/XXXX, I received a notice that Select Portfolio needed to modify my mortgage because the escrow account was behind XXXX dollars. This was the first I knew that the escrow was behind. The balance of my mortgage went from {$220000.00} to {$250000.00}. They did help me modify the mortgage and my principal and interest payment is now {$330.00} and the escrow was approximately {$400.00} bringing my payment to approximately {$740.00}. I did not understand why my mortgage payment steadily increased though apparently it is the result of my escrow continually increasing. My question is how is my mortgage balance increasing when I am making my payments. In XX/XX/XXXX I received a call from a company called XXXX FL XXXX. According to a gentleman named XXXX, they had evidence my mortgage company Select Portfolio was mishandling my account and that if I could pay a fee of {$1500.00}, I would have the deed to my home free and clear. I was able to pay them {$400.00}, but they could not help me if I did n't pay the rest of the funds. I sent them my statements from both XXXX & SPS for that time period. Is it possible that there is a violation? I have not heard from XXXX since that time. I really just want to understand what has happened and if the balance of my mortgage is correct.

Consumer Complaint: On XX/XX/2010 I sent SPS a letter and a copy of my XXXX orders to XXXX requesting assistance under the SCRA. My interest rate with SPS was 6 3/4 of a percent and they reduced my interest rate down to a mere 6 %. This was not in the spirit of the program. A reduction of {$90.00} a month is not helpful for someone leaving a XXXX figure a year career in the civilian world to earn approximately $ XXXX a year by being recalled to XXXX. Most XXXX I knew received interest rates down to 2 % and I think that is respectable. To add insult to injury I never got a {$90.00} reduction to this date almost 7 years later. SPS failed to recalculate my payments to reflect the reduced interest rate. I never received the second portion of the SCRA, which calls for diminished monthly payments based upon the interest rate reduction. It appears to me that SPS gave me a portion of the loan interest rate savings because the interest-bearing principal was {$460000.00} and then there was a deferred principal of {$210000.00}. This is not consistent with 50 USC app section 527. To date I have not ever been given any reprise from SPS under the Service Members Civil Relief program. They sent me a letter stating that they did give me some reprise but the numbers do n't add up. They have sent me 3 sets of financials over the last 3 months and there simply is not a reduction of {$90.00} anywhere to be seen. If they give me a reduction why ca n't they prove it? Where is it? Did it go to the wrong account? These are just a few questions SPS should answer!

Consumer Complaint: I am set up on Automatic Loan payments to be drafted each month from my checking account. My due date is the XXXX of every month. After asking why they charged a fee to make on-time payments on-line, I was told I could make the pmts for free if I sign up for XXXX online & can choose the option to have the funds deducted exactly 16 days after my due date, which is my grace period for no late charges. I chose this option because it best coincided with my pay dates. However, on XX/XX/XXXX and again on XX/XX/XXXX, the monthly pmt was taken early. In XXXX, it was deducted on the XXXX when it should have come out on the XXXX ( 16 days after my XXXX due date ). In XXXX, it should have been drafted on XX/XX/XXXX yet it came out on XX/XX/XXXX. After this happened the XXXX time in XXXX, I faxed over proof the funds were taken along with a faxed request for resolution and nobody called me back to explain why this occurred. On both occasions, I was left on hold several times, transferred to different depts., including their " Cashier dept. ", yet nobody could explain why it happened. After the XXXX time it happened in XXXX, the team member I spoke with ( XXXX ) at first tried to tell me this occurred because XXXX is a XXXX month, which seemed irrelevant & should not affect the XXXX calendar days from your due date. I was finally transferred to Supervisor XXXX XXXX ( ext XXXX ) on XX/XX/XXXX who opened a research request and promised to call me back. I rec 'd a vml from XXXX the following Monday XX/XX/XXXX, however, I could not get thru to her directly & was stuck explaining the situation AGAIN to someone else on the XXXX who also said they 'd research & get back to me. As of Wed XX/XX/XXXX, I still have not heard back.

Consumer Complaint: XXXX years I 've been in my house, always paid mortgage on time. Few yrs back got caught up in the remortgage scam and now I 'm under water ca n't get help anywhere. Back in XX/XX/XXXX I applied for a loan modification, the one currently in place was expiring in XX/XX/XXXX. It is now XX/XX/XXXX and they have been stringing me along all this time so that my mortgage payment can go back up to the higher amount. I have done everything they 've asked of me several times just for them to come back 3 weeks later and tell me they need some thing else. The something else is always the same thing I have been sending since XX/XX/XXXX. I have a XXXX % rate, a single person working XXXX jobs to try and stay in my home and they are giving me the business. The company that started this was XXXX financial co. They sold my mortgage to a new company called sps Select Portfolio Sevicing, inc. They bite the big one. I have sent them so much that whenever b I call it takes them forever to go threw it for them to tell me they have everything b they need. Then 2 to 3 b weeks later they send me a letter telling me they need something else. This has been going on since XX/XX/XXXX. Now the higher amount is in play, I refuse to pay it.

Consumer Complaint: I 'm XXXX ... .after 3 years of fight ... I am left full of XXXX and XXXX regarding my home I worked so hard for. In XX/XX/XXXX I was approved with XXXX for a loan mod. I was very pleased with this mod as it was affordable. I paid 3 trial payments to XXXX and I was on track to a promising future with my home. THEN THE TROUBLE SET IN. My file was sent to SPS servicing following me making my 3 trial offer payments. As soon as I found out my file transferred lenders I called SPS to make a payment and they said I was not approved for my mod and that I would have to start the process ALL OVER AGAIN! I was FLOORED!!! I tried to contact management, I called profusely everyday to see what I could do to preserve my fully approved mod with XXXX ... .and nothing ... I got the ultimate run around. I have been calling, faxing, emailing, mailing letters to SPS pleading my case and my pleas have all gone unanswered. I have spoke with Manager after Manager, customer service reps and non of them were able to assist, I finally was able to speak with a rep who forwarded me to Onbudsman department and they reviewed the case, but they do not want to honor the mod because they stated too much time has passed. In my mind it was only yesterday the mod was approved. After my investigation I found that SPS had sent the final mod documents to the wrong address. They failed to type the suite number and therefore I was not able to receive the modification documents on time. I never had the opportunity to sign my docs and my heart, my mind and my soul knows I was wronged. Had I been given the chance and the opportunity to sign I would have. I paid the 3 trial epayments happily and was so excited about the mod and my new life. You see, I was in the process of divorce. I was starting life over and on my own I could afford the XXXX payment. I was moving forward and not looking back. I had XXXX kids and could raise my family in this home and afford it. I can not explain to you the relief I had after receiving my approval. Since working with SPS I have been nothing but XXXX to the max. I have gained XXXX my life is full of XXXX and I feel XXXX. I have called upon resource after resource, I have written extensive letters to SPS I am at my wits end. ... I went through a Financial Literacy training at my church. We had a lady come in from the CFPB. She provided us a book that says TRAIN THE TRAINER. I took that course and in the book I found your information. Shortly after I took the course XXXX came for a visit to XXXX where he was called upon by XXXX and XXXX. XXXX stated that if we needed anything to call his office. We even took pictures with XXXX while he was here. I XXXX that my case reaches you in enough time. I have been wronged and I know it. I have been fighting for 3 years now and I did not know of the CFPB until you came to my church. I thank the XXXX for bringing your organization into our church and into my life. Please contact SPS and ask them for the records where I have been calling them for the past 3 years. I have gotten no where ... but I hope you can get the records from them. You will see I have been relentless in contacting them. Please help ....
