Issue: Managing the loan or lease
Subissue: Billing problem
Consumer Complaint: From XX/XX/XXXX- XX/XX/XXXX, I fell on hard times and was unable to make on-time payments for my car loan. When I would get behind on a late payment, I would make the payment during the next billing cycle to clear up the past due balance. Instead of the creditor applying my payment to the past due balance, they would compile the two payments and carry over the new balance as being 60+ days late. Resulting in more negative reporting on my account. Despite my efforts to rectify this situation, I was unable to completely catch up on payments for about a year. During this time, I was a XXXX XXXX and relocated to XXXX XXXX XXXX to complete my education upon being accepted into an XXXX in the second most expensive city in the US. One year later, I was hired onto that XXXX as a full-time employee and became current on the account as soon as my financial standing improved and have remained so for over a year now. I am attempting to improve my credit score, but am having difficulty due to the negative listing on my credit report.

Issue: Improper use of your report
Subissue: Credit inquiries on your report that you don't recognize
Consumer Complaint: I have noticed that I have a hard credit inquire from your company on my XXXX, XXXX and XXXX XXXX credit file dated XX/XX/XXXX. As you probably know, Credit Reporting Agencies treat inquiries as a statement of fact and will not allow a consumer to dispute them. Since it is against federal law ( Fair Credit Reporting Act15 USC & 1681n ( a ) ( 1 ) ( B ) for an entity to view a customers credit report without a permissible purpose, I am writing to inquire as to your alleged purpose for doing so since I did not apply or request credit from your organization. Based on the evidence in my possession, this inquiry was performed under false pretenses as described in the clear language of the law. 15 USC & 1681n ( a ) ( 1 ) ( B ) states, in part, in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or {$1000.00}, whichever is greater. I have filed a police report with the Sheriff 's Department XXXX XXXX XXXX onXX/XX/XXXX with a report number # XXXX for identity theft, Name and unit of Reporting Deputy XXXX XXXX # XXXX. This is informing you that this was a fraudulent application and I did not authorize your company to pull my report. I do hope that we can settle this matter amicably. Consumer Complaint: I have been disputing this very old debt on my credit multiple times. They have not provided any proof of the debt or a copy of the contract or deficiency balance to determine the account is reporting accurately. I do not agree with what they have reported and they won't respond to me. They have violated 15 USC 1692 FDCPA and 15 USC 1681 s-2 FCRA

Issue: Problems at the end of the loan or lease
Subissue: Problem with paying off the loan
Consumer Complaint: The problem I'm having is now that I'm at the end of the loan. I'm trying to pay more on the vehicle to get it paid off. But for some strange Reason they keep increasing the interest, My payment is {$450.00} I send {$500.00} I ask to have the extra {$50.00} applied to the principle and for whatever Reason the interest always seems to offset my payment so no extra funds Are available to go to the principle. This has been going on for the last 24 months Of paying for the vehicle. For example if I send in the {$500.00} they take {$300.00} & Apply that to the principle & the interest is {$190.00} The interest seems to be all over The place to keep me from paying off the loan before the 72 months. I have a email From the finance company detailed with all payments. I have approximately {$3400.00} Left on the vehicle & they are stating I have 10 payments left. If you do the math that Would be {$4500.00} not {$3400.00} with extra money being sent. I can send the detailed Billing register of all payments.

Consumer Complaint: I had called XXXX on XX/XX/XXXX to open a claim to an accident that happened on XX/XX/XXXX. I was on a three way call with XXXX and who I thought was an agent from Santander to finalize all of the information on the account and to have XXXX CLOSE the account with Santander. There was talks on faxing documents to XXXX ( from Santander ) when they received certain information from each other the loan would be taken care of. I had given my social, all personal information, and permission to have this done with Santander. I was under the impression the loan was closed out with Santander that day due to the information I was given from the " Santander '' agent. I received a letter of automatic payments coming out again from Santander. Upon calling them to check on the status of the closed loan, they had no record of me even calling. I had asked several times if he was sure and he said yes. I am afraid at this point my information is compromised, and that we didn't have a good phone number for Santander. I was three way 'd in so I do not know the number the agent from XXXX had called. I reached out to XXXX to have them verify from me that on there end I had called and had the conversation and they confirmed everything with me for verifying I called and handled this on the XX/XX/2018.
