Consumer Complaint: On XXXX XXXX 2015 I mailed ( via Certified/Return Receipt ) a " cease and desist '' letter to Resurgent Capital Services. Letter was received and signed for by a XXXX XXXX on XXXX/XXXX/15. Today, XXXX/XXXX/15, I received another " debt validation '' lettter from Resurgent Capital Services dated XXXX/XXXX/15. USPS Article Number : XXXX XXXXText of Letter sent : Gentlemen : I am writing in response to your letter of XXXX XXXX, 2015 in connection with your proposed collection of the above-referenced " debt ''. After thoroughly researching this matter, it is obvious to me that I do not owe what your firm claims I owe. In fact, I emphatically dispute this alleged " debt ''. As I am aware of my rights under the Fair Debt Collection Practices Act ( hereinafter " FDCPA '' ) as well as Texas State law on the subject of debt collection, I dispute the validity of this debt. Please let this letter serve as formal notification that I consider this matter permanently and forever closed, and I hereby demand that your firm or any of its affiliates immediately cease and desist from any further contact with me regarding this matter except that I demand your firm confirm with me, in writing, that your debt collection efforts in the above matter have been immediately terminated or that you or the " creditor '' are taking specific actions permitted by the FDCPA or pursuant to Texas State law. Please be advised that I will consider any further contact of any kind from your firm or its affiliates ( except as to the above-mentioned confirmation by your firm that the referenced matter is closed ) to be in direct violation of the FDCPA, and that any such further contact from your firm or its affiliates will also be considered a violation of the laws of the State of Texas pursuant to debt collection. As such, please be further advised that any further communication ( whether written, oral, electronic or otherwise ) by your firm or its affiliates will, in fact, be reported to the Texas State Attorney General and the Federal Trade Commission. Consumer Complaint: I called this company previously about getting verification of the debt since I had no knowledge of it but was talked to horribly/threatened & without resolve but was told in a letter it was being investigated but to date never received any verification or follow up to my verification request. I only received notices stating the amount of the debt and that the company wo n't be able to sue due to the age of the debt & actions that will occur if left unpaid.

Consumer Complaint: Company keeps calling me at work and at home and NEVER identify themselves or company name. They leave leaving threatening messages for fraudulent debt. The message started with " A complaint had been filed against you '' and that I " and or my attorney need to call ''. '' They then threatened to contact my place of employment. I have not received anything in the mail in regard to this nor do I now owe, nor have I ever owed, any bills or other debts. You call the number back and get no information concerning true identity of company.

Consumer Complaint: I contacted LVNV about an old debt that I was tricked into paying after statute which is being paid as agreed. While I was talking to her, she found another old credit card debt from 20 years ago which was paid to a different creditor, but is back on their books with outrageous interest. The statute of limitations is 6 years in our state. They sent me a letter demanding a response within 30 days or they will take legal action against me for a 20 year old debt that was already paid to a different creditor. They are basically bullies taking people 's lunch money. I do not know whether to reply or not. The last time I replied to LVNV about a 15 year old debt out of statute, they sued me and I am still paying it. The amount is easily XXXX the original amount owed to the credit card. Our local judge just pushed these through and takes the money for the local court. Please help us. Thank you for your time.

Consumer Complaint: I was contacted from a company " LVNV Funding '' about a credit card account from XXXX XXXX, that was sent to their office for collections. They gave me the credit card # but were not able to give me any other information. I explained to them that I did not open an account with XXXX XXXX, nor did I have any knowledge of this account. The time period that they said it belonged to I know for absolute certain it was not me. I then got a copy of my credit report and sure enough this account is on there. I know that I have disputed it more than once but they always say they will send me a letter, and I never receive anything. This account is not mine and can not be verified to be mine.

Consumer Complaint: The attached complaint should be taken seriously by your agency, a debt buyer known as LVNV Funding LLC has been violating consumer rights for decades, and the CFPB should through the Federal Trade Commission take legal action against this company and the legal entities that work with them for the collection of debts that are simply no longer enforceable.
