Issue: Disclosure verification of debt
Subissue: Not given enough info to verify debt
Consumer Complaint: In XXXX 2014 I attempted to obtain a verification of this debt that was reported on my credit report. They responded that they atempted to send me notice, albeit I never received any such notice. I offered them my current address to further substantiate the debt they say I owe. To date, I never received any further corrospondance and when I called them today to follow up, I was told that the account is in " dispute ''. Well, it has been in dispute since XXXX 2014. They state I owe {$2900.00} which I was informed is inflated due to interest however when I asked what interest they could not verify the charges, just that it has been 5 years worth. Per the FDCPA, i am entitled to know what charges I owe. LVNV has concluded they have complied with the FDCPA 's regulations however just saying that they have is not proof of their due diligence to satisfy my request. I am once again requesting proof of the calculations supporting the debt amount, The original creditors contract with my signature or a certified copy and a letter of assignment of my debt from the original creditor.

Subissue: Debt was paid
Consumer Complaint: I had a judgement against me which I paid off a few months ago. This company took my payment and refuses to give me my warrant of satisfaction. I have called and emailed them as well as had my bank call and email them and we have gotten absolutely nowhere. They claim that they dont issue the warrants, that they only collect the money and foward the info. They also refuse to tell me who they forward the info to and/or what attorneys represent them. They say that they dont know because its always changing. All I want is my warrant of satisfaction so that I can file it with the court and have it removed from my record. The debt is paid and there is no reason I shouldt get this. Ive tried for months and gotten nowhere. Please help me with this simple request.

Subissue: Right to dispute notice not received
Consumer Complaint: I have disputed this item before ( CFPB Case number : XXXX ) and have still to be provided proof that I EVER received a letter with a right to dispute ( which I very well would have ). Legally, ( as they very well know ) I have a right to dispute. We have moved several times. Is this why? If so, they still by law must have provided ME with a collection letter with my right to dispute. Because of this ongoing mess and the failure to provide such a document once again, I am requesting this item be removed from my credit reports.

Consumer Complaint: This debt collector company is continuing to attempt to collect on an installment loan that I had through XXXX XXXX and paid off completely. They have also reported adverse information to all XXXX credit agencies, and illegally obtained a copy of my credit report, which has had an extreme negative impact to my credit report and score. This action on their behalf is now interfering with my job and my XXXX. I could possibly lose my job and my XXXX due to this agencies reckless collection practices. I have disputed this claim with the debt collector and collection agencies, however, the company still continues to verify that their information is accurate which it is not. They are trying to collect on a five year installment loan that I paid each month on time for the entire duration of the loan. " This was paid in full ''. I do not owe neither XXXX nor XXXX anything, however, they continue to report false information. I have provided them with copies of my credit report that shows I paid XXXX XXXX for 5 years on time, yet XXXX still continues to attempt collection practices. I have attached XXXX documents from my credit reports. XXXX is from the Collection agency that continues to report negatively even as recent as last month and the other is from XXXX XXXX which reports that this account was opened in XX/XX/XXXX and closed in XX/XX/XXXX. It also shows that it was a five year installment loan and was paid with a XXXX balance.

Consumer Complaint: The alleged loan orginated in XXXX/XXXX/XXXX and the account was charged off in XXXX/XXXX/XXXX. The account was acquired by Resurgent Capital Services from XXXX XXXX XXXX, XXXX on XXXX/XXXX/XXXX. I was contacted by mail in reference to this alleged loan. The original creditor was XXXX XXXX XXXX XXXX, of which I have never had any dealings. I have submitted a written dispute asking for all original documents and proof of this alleged loan with my signature. The loan is clearly out of the statute of limitations and is uncollectable. Yet I continue to receive correspondence in efforts to collect this debt. Resurgent has refused to accomodate any of my request for any and all documents pertaining to this alledged loan. I consider this harassment and would like all correspondence to cease and desist. Thank you for your time

Issue: Cont'd attempts collect debt not owed
Subissue: Debt is not mine
Consumer Complaint: Resurgent Capital Services is attempting to collect a debt for XXXX originally from XXXX that is not mine. I challenge that I owe this debt and request proof that I actually incurred this debt, not simply proof that a collection agency owns it. Furthermore, for this debt to hypothetically be mine, it would have been XXXX delinquent in XXXX 2008. This places the debt outside the XXXX year statute to be collected on, and past the XXXX year limit on being reportable to credit bureaus. Collecting or reporting in this debt is a violation of my consumer rights and the FCRA, as well as the FDCPA.

Consumer Complaint: I am being sued by a debt collector ( LVNV Funding , LLC ). LVNV Funding claims to have purchased a credit card debt in my name from XXXX Bank, who is listed as the " original creditor ''. Two months after my request for discovery, I received documents with my name and address indicating that I had a XXXX Bank XXXX credit card used from XXXX to XXXX, and that I had applied for this card " on or about '' XXXX XXXX, XXXX. The problem ; I have never had a XXXX XXXX credit card, or any other XXXX credit card. I then asked the attorney for the plaintiff to provide the application. The response was that sometimes there is no application because requests are done online. I can not believe that XXXX Bank would discard the information I would have needed to provide in order to obtain credit from them, even if done online without an actual signature ( unlikely in my case ). It should be a simple matter for the plaintiff 's attorney to provide the original application. What is the CFPB stance on something like this? How can I prove the debt is not mine when the plaintiff has documents that indicate otherwise?

Consumer Complaint: The debt collector XXXX Resurgence Capital Services XXXX is attempting to collect on a debt that I do not own. They have also sent a letter with a statement that indicates the current account owner XXXX LVNV Funding LLC XXXX will not report the debt to any credit reporting agency. This is a false statement. I learned about this debt as a result of it being reported to a credit reporting agency. Also, the statute of limitations to collect on this debt has expired. This debt was supposedly acquired in 2008. I have not heard from this debt collection agency, or any other company regarding this debt until now. If this debt is valid, I would assume the debt collection would have begun a while ago.

Consumer Complaint: I filed a complaint last month to which they said they responded. The response is a corrupt file. Once again LVNV and failed to provide any proof of dates, balance, how calculated or the debt is even mine. Furthermore, they are inaccurately reporting on my credit reports as current late payments. This is also false.
