I do not owe LVNV Funding and do n't know what the debt is. Many years ago I closed several credit cards and in XXXX went through a personal bankruptcy where all debtors were paid in full from the proceeds of a major personal injury lawsuit recovery in XXXX.

I look at my credit report ant there was a wage garnishment, I never receive any paperwork from these people and do not owe this debt. This is an old credit card debt that they are trying to collect on.

Consumer Complaint: On XXXX/XXXX/2016, I received a letter dated XXXX/XXXX/2016 from XXXX XXXX XXXX, XXXX. identifying themselves as a debt collector seeking to collect the above referenced amount from the original creditor identified as XXXX XXXX XXXX, XXXX. I responded to this letter with correspondence dated XXXX/XXXX/2016 that specifically requested the following ; Proof of licensure to collect in my state Proof of license numbers and Registered Agent The original creditor 's contract with signatures or a certified copy of the original contract ( certified by the original creditor 's custodian of records ) ; and A letter of assignment ( evidence of ownership of the debt ). I received correspondence from XXXX XXXX XXXX, XXXX. dated XXXX/XXXX/2016 that included several printouts of credit card statements, but none of what I requested in my correspondence dated XXXX/XXXX/2016. I responded with correspondence dated XXXX/XXXX/2016 requesting that their office confirm they are legally entitled to collect the debt they are seeking by sending the items requested in my correspondence dated XXXX/XXXX/2016. After sending my correspondence dated XXXX/XXXX/2016, I received three different letters from XXXX XXXX XXXX, XXXX. all dated XXXX/XXXX/2016. XXXX letter states the following ; " Our office received notification of a dispute regarding the above mentioned account. For us to properly address your concern, we will need more information in writing about the nature of your dispute. '' I am unsure as to this request, because my correspondence dated XXXX/XXXX/2016 and XXXX/XXXX/2016 clearly state my needs. The second and third letters are identical and both state the following ; " Previously we verified the above referenced debt with copies of related documents ; a measure that is above and beyond what is required. '' The difference between the second and third letters is that only one included enclosures. These enclosures were a copy of a credit card statement and XXXX pages of an Account Summary Report. In regards to the statement that XXXX XXXX XXXX, XXXX. " verified '' the referenced debt, the credit card statement enclosures do not suffice as proof that their office is able to legally collect the debt. On XXXX/XXXX/2016, I received a letter dated XXXX/XXXX/2016 from Resurgent Capital Services identifying themselves as a debt collector seeking to collect {$650.00}. As stated earlier, I had already received correspondence from XXXX XXXX XXXX, XXXX. identifying themselves as a debt collector and demanding payment. I also stated that one of the three letters from their office included a XXXX page Account Summary Report. This report notes, " This account summary has been prepared by Resurgent Capital Services on behalf of LVNV Funding LLC . It is not a credit card or other account statement from the original creditor. '' This statement seems to suggest that both companies are aware of each other and related/working together, however, given the fact that Resurgent Capital Services ' correspondence dated XXXX/XXXX/2016 includes the debt validation notice printed at the bottom suggests that they are in fact a company separate from XXXX XXXX XXXX, XXXX. that is also demanding payment for the alleged {$650.00} debt.

Consumer Complaint: I am disputing account number XXXX with LVNV Funding because I have sent several dispute letters to the credit bureaus and it comes back verified every single time. I have contacted LVNV Funding to get the method of verification and debt validation on this account and they not provided me the information I have requested per the Fair Credit Reporting Act and the Fair Debt Collections Practices Act. The account is also being reported as having a credit limit when according to the Credit Reporting Resource Guide & Metro 2 standards, credit limits only pertain to charge cards or revolving credit. Not collection accounts.

XXXX sent a cashiers check to LVNV Funding / Resurgent Capital Services to payoff a judgement filed against my deceased husband that became a real estate lien due to non-payment. After many telephone calls by myself and my banker, we received a letter dated XXXX XXXX, 2016 stating that the lien had been satisfied and the release of judgment will be filed. No such release has been received by XXXX XXXX as of this date. I feel that this release should have been taken care of many months ago. I am sure that my bank would have taken care of this in a matter of days, not over 6 months.The bank 's attorney sent a letter to LVNV / Resurgent Capital Services on XXXX XXXX, 2016 with no response. Your assistance in this matter will be appreciated. I wish all financial institutions treated customers as XXXX and XXXX XXXX XXXX Bank in Staunton does. They do it right.
