Consumer Complaint: Everytime they are forced to remove the debt due to satute of limitations the keep reposting it. XXXX who is the originator of the debt charged it off and released me from the debt and a year later LVNV XXXX started trying to collect. My income is judgement proof by federal law They need to stop trying to collect an old debt out of the statute of limitation and forever remove it from my credit report

Consumer Complaint: I have requested validation of the debt LVNV is attempting to collect, on numerous occasions but the company has failed to comply with my requests. Despite failing to comply with the validation clause of the FDCPA, LVNV is continuously reporting the unverified information to the credit bureaus. In my most recent attempt to acquire debt validation through the Consumer Financial Protection Bureau, LVNV submitted a " response '' however, the attachment was blank. I did inform the company their response was blank through the CFPB platform, however ; since there was no enforcement they did not resubmit the information. This is my second attempt through the Consumer Financial Protection Bureau and my fourth overall attempt to acquire validation of the debt. At this stage failure to provide validation of the debt or to stop attempting to collect on this debt will result in legal action. I am the XXXX and the invalid information you are willfully reporting is hindering my ability to acquire the financing necessary for me to earn a living. The current deal that your invalid information is interfering with will net me {$2100.00} per week. If this information is not validated and you continue to report it to any of the credit bureaus I will seek actual damages of lost earnings, statutory damages for your violations of the FDCPA, and recoupment of any and all legal fees acquired to enforce the law. While I am currently not receiving the assistance of an attorney, I assure you I do have the time, the economic means, and the grounds to pursue this legally.

Consumer Complaint: This is my second complaint. My original complaint # XXXX was responded to inaccurately. Briefly, Resurgent Capital claims they are collecting a debt on behalf of LVNV Funding for the original creditor XXXX.They claim the debt is valid as there is and have been an unpaid balance. In consideration of Resurgent '' s response dated XX/XX/2016 to the original file # XXXX, in paragraph XXXX they agree they received monies on behalf of their " third party servicers '', but now claim they returned payments to me as they were unable to honor the terms in my restrictively endorsed letter. So, if what they claim is true regarding returned payments, I requested they provide proof. Forward a copy of the returned/endorsed payments made to me. They have failed to do so.

Consumer Complaint: After reviewing my credit reports, I noticed a collection account from PYOD aka Resurgent Capital Services. On XXXX/XXXX/XXXX, I sent a letter to PYOD asking them to validate this debt with my signature and to prove that I was obligated to pay them. They responded back with a letter saying the debt was mine and needed to be paid. I wrote a letter again on XXXX/XXXX/XXXX again asking them to validate this debt. Again, they failed to provide a proof of signature, but continue to claim that I had an obligation to pay them, which I do not. This collection account is still reporting negatively on my credit report as of today, XXXX XXXX, XXXX, and is affecting my ability to obtain credit.

Consumer Complaint: I have not received a statement from this company in months, despite my attempts to contact them via mail and phone. The last statement I received was XX/XX/2016. I have no idea what the balance is on this debt, nor do I know how my payments are being applied. Their statements are confusing and I do not believe they are applying my Payments correctly. I pay this loan electronically through Billpay in my mobile banking website. I pay {$40.00} every month, which is more than the minimum payment. I have never been late with any payment. I have written a letter to this company with no response. I have tried contacting their customer service number but it always goes to a voice mail and no one returns my call. I feel this company is unethical in that they do n't provide any statements to me and I have no idea what the balance is. They do not respond to any communications. And yet this debt appears on my credit report. How will I ever know that it is paid off? And it will appear on my credit report as unpaid.
