Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: On XX/XX/2021, I sent a letter to LVNV funding requesting that they validate an alleged debt they placed on my credit reports. I received a response from Resurgent Capital Services stating that they are collecting on behalf of LVNV Funding. Since when a collection agency collects from another one, and neither one of them has provided me with the original application of this alleged account like I asked them.

Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: XX/XX/XXXX XXXX XXXX tried to collect this debt on behalf of XXXX account ending in XXXX for {$730.00}. I advised them that this was result of identity theft and and provided the FTC reports showing as such. The case was closed and XXXX XXXX advised on XX/XX/XXXX for my case XXXX that XXXX XXXX will honor Mr. XXXX request and place his account in a cease and desist status. This will prevent further collection efforts from occurring on this account.. Now it is XX/XX/XXXX and they have sold this account to Resurgent, who is trying to collect for again, an account, ending in XXXX for {$680.00} that was not mine and is considered identity theft. I will file another case with the FTC to include Resurgent Capital so that this matter will finally be closed.

Issue: Written notification about debt
Subissue: Didn't receive enough information to verify debt
Consumer Complaint: I have been disputing this account with the credit bureaus for sometime now. Each time they would say that LVNV FUNDING would verify the debt. So I took it upon myself to ask LVNV FUNDING for validation of the debt. Are they legally able to collect on the debt? How did they calculate the amount they claim I owe? How do they know I am the owner of the debt? Im curious because I have never done business with them or the original creditor. Well, it has been more than 30 days and I still have not received anything proving the debt is mine. They received my letter on XX/XX/XXXX. Here is the tracking XXXX XXXX XXXX XXXX XXXX. I was under the impression that if they didn't respond it would automatically deleted from my credit reports. Silence is being in agreeance. I am sure there is a law that proves it.

Consumer Complaint: I have reached out to the company several times to validate this debt and provide me with information that will prove that this is my account and they have not responded with the correct information. They keep sending me letters saying that I sent duplicate letters just to stall the process and avoid verifying the account. I've attached the letters I have received from them so far as a response.
