Consumer Complaint: This letter is in response to a letter received by Portfolio Recovery Associates on XXXX XXXX, 2023. Apparently, XXXX XXXX has sold this account to them, a XXXX party interloper, and it is my belief this is a fraud. Since there is no signature on the documents they have sent me, who is accountable for this contract I am being offered? If they can state their claim & provide that contract I have with them whereas there is a wet ink signature from the Claimant & someone From the RESPONDENT, I would be happy to settle this alleged account. I requested VALIDATION and PROOF OF CLAIM made pursuant to the Fair Debt Collection Practices Act and Fair Credit Billing Act. XXXX respectfully requested that their offices provided XXXX with competent evidence as per the Declaration and Proof of Claim that I have any legal obligation to pay them the unsubstantiated alleged debt. Also, be informed that, for 3 years, their offices have been reporting non-validated information to the XXXX major XXXX XXXX, XXXX, XXXX and XXXX prior to validation and proof of claim of the alleged debt, which I also believes constitutes fraud under both Federal and California XXXX XXXX. And also has caused me significant financial harm and denial of credit. Due to this fact, these negative marks found on Claimant 's credit reports by their company and I retain the right to explore options regarding action against them in accordance with Violation of the Fair Credit Reporting Act as well as Violation of the Fair Debt Collection Practices Act, and United States Code TITLE XXXX, CHAPTER XXXX, Sec. XXXX. Portfolio Recovery Associates sent XXXX identical letters in response to previous CFPB complaints, XXXX on or about XX/XX/2023 and XXXX on XX/XX/2023, and not once did they provide Proof of Claim of the alleged debt. Therefore, the debt is considered to be invalid, and any documents that they sent me will be returned to them as refused for cause without dishonor upon proof of claim Their office never produced the required documentation in accordance with FTC guidelines and has taken actions which was and is detrimental to Claimants private commercial affairs and credit reports. These actions are a dishonor. Portfolio Recover Associates failed to provide VALIDATION and PROOF OF CLAIM.; made a false representation of the character of the referenced alleged debt and, made a false representation of the legal status of the referenced alleged debt.

Consumer Complaint: In 2019 I received a bill from the original creditor and I thought nothing of it so I paid like anyone who has credit should. A few months later, I realized that what I was paying, was not mines. I had no idea what I was paying for, there was no cash advance, no description of a purchase I made, so I stopped paying. Because of that, this creditor has damaged my credit score, put me through severe financial ruin because the drop in my credit score over this. And when I request proof from portfolio, they send me documents that do not explain what the charges are for. When I mailed portfolio a letter, requesting information to verify and validate the account. This is all that they send me. They do not send me the receipts like I requested they do not send me the description of what was even purchased. They failed to send me proper documentation of what any of this stuff means. Because all that they are sending me is A paper with a transaction date with XXXX fees, and the name of the purchases are regular and the other XXXX is payments for XXXX months and the other is payments for XXXX months as well with a total of {$500.00}. There is absolutely no description for what these charges are for and for what they even mean.

Consumer Complaint: In XX/XX/XXXX I received correspondence from XXXX debt collection regarding a claim of debt from XXXX XXXX XXXX XXXX XXXX originating XX/XX/XXXX and involving a XXXX XXXX in an apartment in XXXX, KY. I disputed this by writing as I do not own or rent property in XXXX nor have I ever had XXXX XXXX. I elicited the help of local attorney XXXX XXXX and the problem seemed to be resolved. In XX/XX/XXXX, I received a bill from another debt collector, XXXX system which I again disputed. Since then I have received on average 5 calls per week from Portfolio Recovery another debt collector and they have attached a debt on my XXXX Credit report which I have also disputed. Portfolio Recovery has not sent anything by mail but the few messages they leave on my cellphone want me to go to their website Praway.com and put in my telephone # and social security #, which I will not do.
