Consumer Complaint: I have already filed one complaint here and the case was closed. They said they sent a settlement and consent judgement on or around XXXX XXXX and that they havent received it back from me. I got this letter on XXXX XXXX and sent it back signed immediatley. I dont know why they are saying they havent received it. I hope they are not lying because they want this to go to court or a default judgement. Please look further and find the signed paper I sent back. I have already made 3 payments towards this agreement and they have readily taken it out.

Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: Under the doctrine Estoppel by silence, Engelhardt v. Gravens ( MO ) 281 SW 715, 719 I may presume that no proof of the alleged debt, nor therefore any debt, in face exists. I have contacted portfolio recovery on a matter that pertains to my credit. I have been a victim of fraud. I sent portfolio recovery a certified letter via usps to validate this account asking to send original documents and a host of other things. I have not received any of the documents I requested. I have an account on my credit that does not belong to me. I asked portfolio recovery to remove the unvalidated information and nothing was done. I have the receipt that I sent the letter via usps certified. Removing this account from all three credit bureaus ( XXXXXXXX XXXX XXXXXXXX ) is what needs to take place there is no validation. I take pride in my credit and I have a XXXX score on my credit bureaus. This fraudulent account is ruining my credit to the extreme. A consumer can not provide signed documentation for an fraudulent account that they never authorized but I also asked for a signed documentation bearing my signature that I agreed to pay portfolio recovery and the collection agencies could not provide that information. I want this information removed IMMEDIATELY! DO NOT SEND COPIES! I NEED ORGINALS!

Issue: Problem with a company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: As a creditor, you have previously acknowledged your inability to provide original documentation that substantiates my ownership of this debt relating to the account on my credit report in which you sold to Portfolio recovery. I have consistently maintained that I never opened an account with your company, and I have provided substantial evidence that my personal information was compromised in the XXXX data breach. This raises serious concerns regarding the accuracy of the information on my credit report. Under the provisions of the Fair Credit Reporting Act ( FCRA ), it is imperative that all reported information is accurate, verifiable, and substantiated by the creditor. Given that you are unable to furnish the original documents confirming my association with this debt, I must assert that you are in violation of the FCRA. I kindly request the immediate removal of this account from my credit report within the next 7 days. Failure to comply with this request will leave me with no alternative but to pursue legal action to rectify this matter. I believe it is in our mutual interest to address this situation promptly and amicably to avoid any further legal action. The account is PORTFOLIO RC XXXX. See the XXXX data breach claim ID attached.
