Consumer Complaint: In 2011 we attempted to refinance through our local bank. We wanted to refinance because our mortgage, through Ocwen Loan Servicing, is prohibitively high at nearly {$7500.00} per month. We had an appraisal done and had the new mortgage loan all set up. But the day before all legal papers were to be signed, Ocwen Loan Servicing contacted our bank and our local XXXX XXXX XXXX to say that Ocwen would only let us out of the mortgage obligation if we paid the entire remaining mortgage PLUS a $ XXXXXXXXprepayment penalty! Everyone at our bank and at XXXX XXXX were shocked and said none of them had ever heard of such a situation and it certainly sounded like predatory lending. We knew nothing to do about this situation until the recent XXXX XXXX article on the Bureau of Consumer Financial Protection. We have continued to pay this monthly mortgage fee so we do not lose our home and business. It is difficult and discouraging, especially since interest rates have dropped so much, but we are still stuck at 9.75 %. We have tried asking Ocwen to let us refinance at a lower rate, but they have ignored us. Our local bank is still offering to refinance us at a much better rate, but we can only do so if we are able to get out of this prepayment penalty obligation with Ocwen. Consumer Complaint: Ocwen Loan, I fell a little behind in my mortgage due to an injury and divorce, I have been trying to get back on track with Ocwen but they refuse to accept payments and have consistently sent payoff and reinstatement letter that have already expired by the time they get them to me. Now a days with email and over night mail ever regular mail there is no excuse for this. My house is now in foreclosure, I have funds to pay the P & I that I owe in full but they say I need to talk to my account manager. He is never available and when appointment is set up to 6 weeks in advance they call and phone rings only once and no one on other end. I call back and am told I need to make another appointment.

Consumer Complaint: I filed for chap XXXX bankruptcy in XX/XX/2014 due to medical issues. At the time of filing the arrears on my property was {$9000.00}. The mortgage lender failed to file a claim with the court and consequently, the court was not able to make any payment to them ; although I made the payments to the court as required by the terms of my plan. The arrears on my property have now risen to more than {$25000.00} ( due to the lenders negligence ). Due to ongoing medical treatment, I have made several attempts to obtain a mortgage modification and am being told by the lender that " they are not able to offer any modification that will reduce my payment to an affordable level based on my verified income ''. My problem is ; were it not for the failure of Ocwen to file a claim with the court these arrears would not have reached this level. I can not imagine an acceptable reason that the lender could not get the claim filed with the court during the course of an entire year. If not for their error, they would have received payment. The money was on file with the court and was disbursed to another creditor because of their error. The lender is now holding me accountable for their negligence ; and I am being told that there are no options for me to work out a plan to keep my home.

I was told that due to the opening dates being the same, it is appearing to other potential lenders that they are XXXX separate mortgages. This is severely affecting my borrowing abilities and request it be taken care of. Neither lender will work with me on this dispute.

Consumer Complaint: XXXX, I submitted paperwork for a loan modification. XX/XX/XXXX, I received a response to start a 3-month trial loan medication ( XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX ) packet. XX/XX/XXXX, I received a certified mail notice from the Post Office. I selected for the mail to be delivered to the home address. It never arrived so I did n't know what was sent. XX/XX/XXXX, I was contacted by a loan agent that I needed to make a payment for XX/XX/XXXX because it was now late. I advised the agent that I did n't know how much the payment was since I just completed the trial modification and was awaiting notification of the status from the loan relationship manager. I was told that I needed to make a payment ASAP, since the account was in a forbearance. I made a wire transfer payment, like with the trial modification payments. In XX/XX/XXXX, I made an appointment to speak with my loan relationship manager. He advised me that the modification agreement needed to be signed first before the account could be updated in the system and not show a forbearance any longer. He advised me that this was the certified document that was sent but never received by me. He sent the documentation to me on XX/XX/XXXX via email and regular mail. I was advised to email, fax and mail the signed copies of the agreement to move forward with the loan modification. I had asked if a payment should be sent and he said not to until the documentation was received and I was given acknowledgement. It was not disclosed to me until after the documentation was returned that the payment, interest rate and loan amounts had changed and been increased. XX/XX/XXXX, another loan agent had stated the payment was late and that I needed to make one ASAP. Like before, I complied and made a wire transfer payment. I have spoken with various agents after making other appointments to speak with the loan relationship manager from XX/XX/XXXX to XX/XX/XXXX. I had mentioned that I had a hardship and that the new payment arrangements were not satisfactory. I had inquired about the foreclosure alternative paperwork and was given a packet to file. After submitting the paperwork, an agent told me I did n't qualify, regardless of my current circumstances, because of the recent modification. On XX/XX/XXXX, a loan agent called asking again to make a payment. I told him that I planned to make a wire transfer on XX/XX/XXXX. He said that I could make a payment by phone. I said again that I already have a pending wire transfer for XXXX and it was n't necessary for me to make one over the phone. He then asked for the bank information, in which I gave him since it was different from the previous wire transfers. I had then reiterated that I was not giving authorization to make a payment by phone since I would n't receive a paycheck until XX/XX/XXXX. The bank notified me that the agent had tried to put a payment through with the information he obtained from me even though I did n't give my consent. The payment was n't processed so the loan company sent a letter stating I was going to be accessed a late fee and a return payment fee. XX/XX/XXXX, I spoke with a loan supervisor and was told to send a request to their Research department to have the recorded conversation reviewed. I received a letter on XX/XX/XXXX that the recorded conversation was reviewed and that I had given authorization to the agent at that time. As of today, I still have not heard from my relationship manager and keep getting bounced around to other agents. I received a default letter and another letter that shows the current status of the account is past due. Today I inquired about the foreclosure alternative modification with an agent and he stated that I did n't qualify because the account was considered in good standing. I mentioned the letters and he said that the account is current.

Consumer Complaint: Ocwen Loan Servicing has sent me mail and left messages on my answering machine to give them updated hazard insurance information for my condominium. I have mailed it to them, emailed them, been on XXXX way calls with them and my insurers to prove I have coverage through my association. In fact I have a copy of my coverage right under my nose as I type this. They have vehemently denied they received anything from me and have forced insurance coverage that I will have to pay through an escrow account. I am at a loss of what to do. I have followed their instructions about mailing it to them, some agents have given me an email address while others say there is no email address. I do not have a fax machine, so I can not send it via fax ... although I am thinking of going to an office supply store to give it a shot. Tomorrow I will be sending certified mail with the policy so that I have some documentation they received it. I do n't want to pay my mortgage anymore because part of my money will go to mortgage insurance. I ALREADY HAVE HAZARD COVERAGE!!!

Consumer Complaint: I applied for a loan modification with Owen Loan Servicing LLC to try and modify my home mortgage. Ocwen denied my loan modification twice with false, and misleading, information. On XXXX XXXX, 2015, I applied for a loan modification and was incorrectly denied a loan modification. Ocwen denied my loan modification based on the fact I already was granted a past modification two years ago. Ocwen stated I can only apply for XXXX loan modification and I have reached the maximum times I may apply for a HAMP modification. This denial is not true and is an attempt by Ocwen and the Investor to intentionally foreclose on my property. Ocwen is not following the HAMP guidelines when evaluating borrowers for loan modifications. In XXXX 2015, I applied for a XXXX review for a loan modification. Ocwen again, denied me a loan modification on false and untrue facts. Ocwen stated that I earned an income of {$6000.00}, which is not true. I do n't earn {$6000.00} of income. My income is {$5100.00} a month. Also, Ocwen stated I was current on my mortgage, also not true. I am 90 days behind in my mortgage and need mortgage assistance to save my home. Ocwen several times has tried to convince me to sign a Deed in Lieu of Foreclosure and return my property to them. I have numerous times explained to Ocwen I do n't want to give my ownership to Ocwen and I need a affordable loan modification.
