Consumer Complaint: We first of all was manipulated into a mortgage contract ( that terminated after 20 years ) the contract was called a ballom mortgage originally we had a 30 year mortgage then at that time they demanded that we refinanced the the entire amount of the mortgage which was {$100.00} at the beginning. we paid over XXXX into this contract and yet we did n't recieve any equity. then they refuse to negociate any thing with us mortgage reform called a Modified Mortgage. that we were never late on our payment all the while we kept all of our mortgage payments up. at the end of that time they refuse to except any payment. after becoming fustrated with mortgage we finally relocated. they then forclosed and sold the home for {$110000.00} and we did n't receive a cent back. We believe that we victims of preditory lending which was perpetuated by Ocwen Mortgage a division of XXXX XXXX.

Consumer Complaint: On or around XX/XX/XXXX I was granted a loan modification which included the language that there would be {$220000.00} of deferred principal balance however I was unable to honor the terms of the agreement In XX/XX/XXXX I applied for another loan modification which superseded the original modification stating that there would not be any deferred amount of money owed. I contacted Ocwen over one year ago to resolve this matter and they did nothing! Now my back is up against the wall as I need to refinance to pay approximately {$60000.00} of taxes to the IRS by XXXX XXXX, XXXX or I will be subject to large penalties and interest. I am in the process of seeking a second mortgage and your current mortgage coupon and the payoff demand both misrepresents the terms of the XX/XX/XXXX modification stating that there is an additional {$220000.00} owed. I contacted Ocwen one year ago and this matter was supposed to have been resolved. Please expedite and correct this serious matter immediately as I am due to suffer serious financial consequences as a result of this gross error. Sincerely XXXX XXXX

Consumer Complaint: Ocwen loan is a servicer for XXXX and has not offered an affordable modification under the HAMP, as requested. The Office of Comptroller of Currency entered a consent order against XXXX and ordered them to offer modifications that benefit the consumer, under Article IV of AMENDMENT TO XXXX XXXX, XXXX CONSENT ORDER. The company was order and given credit for loan forgiveness when the loans were considered under water. Currently the home is worth $ XXXX and Ocwen pursued to collect a debt upwards of $ XXXX more than the original agreement. I sought to discharge this debt according to 12 USC 95 ( a ) 2 and sent Ocwen payment on XXXX XXXX XXXX. My home is still being foreclosed although the laws of the United States states that the debt was to be XXXX when relying on 12 USC 95 ( a ) 2. The payment has not been returned, and there has been no attempts to offer me an affordable modification. Ocwen nor XXXX were original lenders or part of the original mortgage. I am left with no remedy although I am an XXXX. The corporations are threatening to remove a XXXX, although I relied upon the laws of the United States for remedy.

Consumer Complaint: Ocwen has notified me that my mortgage payment is going up due to a shortage in my impound account, HOWEVER, they will not tell me how the shortage occurred. They sent me ( twice ) a yearly statement that showed them starting with a shortage but what they collected versus what they paid would have left them with a nice reserve. I sent a Certified letter to XXXX XXXX, XXXX of XXXX and was completely ignored. What I pay each year is in excess of what they pay out ; they should be able to show me where they went wrong in creating this possible shortage. In phoning them, I have spoken to other XXXX where the contacts have no idea of why there is a shortage, they say someone will contact me ( they do n't ) and then say they will transfer me but disconnect me, all while I can barely understand them with their heavy accents. They continue to send me statements with the higher payments and with no reason or explanation. This is a HAMP loan and from the start has had a surplus in the Impound account ; WHAT HAPPENED TO IT???? I 've checked my taxes and insurance and I still have a surplus due to small increases in my payment when these changed. There condescending attitude is ridiculous!

It clearly state with the recast my mortgage payment and estimated monthly escrow payment of XXXX ( which is still effective ) that the total monthly payment is XXXX and without recast the total monthly payment is XXXX. I have been requesting the recast payment since XXXX and Ocwen still has not gotten it right. This modification is without the recast. I WANT THE RECAST PAYMENT.

Consumer Complaint: I 'm writing you to request some assistants and file a complaint on the referenced above loan. Ocwen closed out the short sale on XXXX/XXXX/16 and sent us a decline letter ( please see attached ). 1 ) They never countered us to see if the buyer is willing to go up in their offer or advised us of the reason for the decline. Other than closing it out and email us a letter. As per short sale protocol you are supposed to contact us and let us know and give us at-least 24-48 HRS to respond back so we can counter the buyer. We were never advised or done. 2 ) We ordered an Interior BPO on XXXX/XXXX/16 to be completed on the property. We never were contacted for access to get into the property. Which means it was never completed or done. 3 ) The BPO they are going off of was only a drive by. ( which did not take into consideration that the property is mostly Wetland and the home needs to be torn down and rebuilt. NO ONE Should be living in this property. The seller is and is providing for XXXX kids and is unable to bring the account current or have the funding to relocate. 4 ) Ocwen also denied the relocation incentive for the seller because they advised that the investor does n't pay for relocation assistants. The investor is XXXX XXXX XXXX Bank which is a lender that we work with all the time and they have always paid the relocation assistants. I have asked Ocwen several times for the investors phone number so I can confirm this and they still have given us the phone number to verify this. 5 ) With the mentioned drive by BPO that was completed, it was never addressed or states the XXXX of the Acres on the property are wetland and are UN-build-able ( please see documents attached ) XXXX ) There is a foreclosure sale date set on the property for XXXX/XXXX/16 which is very concerning since we are trying to proceed with the short sale of the home. 7 ) Buyers inspection, bids, comps are all attached too. With this being said the offer that we have on the property is a good offer since the home needs to be torn down and rebuilt, along with XXXX % of the property is UN-build-able and has to stay as wetland. Please help us postpone the foreclosure set on the property, along with reviewing the proof and documents attached.
