Consumer Complaint: I have applied 3 times and denied 3 times for a loan modification. Each time, the process has taken 6-8 months. I have been working XXXX jobs to try and save my home. The last denial I was told that I made enough but was too far in the arrears. I have sold my house 3 times. 2 out of the 3 times the buyer has pulled out because the short sale process was taking way too long ( we are all aware that it is a longer process ). I truly believe that Ocwen drags out the process - at least in the loan mods - so that you get so far in the arrears, nothing can be done. You speak to a different agent each time. One agent ca n't seam to find documents another agent has received. They are constantly saying that they do n't have documents when we have proof they were sent ( ask my Realtor! ) and they wait for your next phone appointment to tell you what 's needed instead of sending an email beforehand so you can have what 's needed at the next phone appt. I could have been paying something for the last couple of years. My house needs some work which I wo n't do because of the short sale. It 's an emotional roller coaster for me because I have been in limbo forever. They assign you a " Relationship '' manager but you get them maybe 1 out of 7 phone calls.I have been to every NJ State agency, Senators, written to the White House but to no avail. Would n't some payment be better than nothing? This is not help.

They paid all interest and penalties incurred from my escrow money although it was not my error. Now the county taxes are suing me for court costs for this incident for which I was not responsible. My mortgage needs to reimburse all penalties and interest as well as pay the court cost for their error.

Consumer Complaint: Client was XXXX he is a veteran, while XXXX payments were being automatically withdrawn by his mortgage company. He all of a sudden received a letter saying his loan was going to be foreclosed due to non-payment. He was still XXXX did n't have the resources or time to fight this issue so filed bankruptcy to save his home. He was paying additional to the loan, but still has a delinquent amount of over {$22000.00}. He has been trying to work with his mortgage company but then his loan was transferred, so he continued to try and work with the new mortgage company. They both keep sending him back and forth to get one to investigate and fix the issue, but neither are looking into it and do n't see a problem and nothing has been resolved.

Consumer Complaint: I received a notice from Ocwen Loan Servicing saying they had discontinued the service that had made automatic payments from my bank account via ACH. This notice came very close to the time my payment was due and contained a form to initiate ACH payments. I filled out the form and returned it the day after I received it and before the next payment was due. Ocwen rejected the payment saying I had to pay the loan 30 days in advance for them to activate the payments. This was something I did when I originally set up the Automatic ACH payments they just discontinued. The issue was escalated to an " escalation manager '' who suggested reversing the extra principal payments to allow the ACH payments to be set up. He did this and then told me I had to go to their website to set up the payment. Their website will not allow me to log in, allegedly because the zip code does n't match the loan number on the account. The Zip code and account number were entered as instructed by Ocwen. I have sent them multiple letters and they reply with a form letter telling me to enter the correct information. In doing this, they have caused many of mortgage customers to be late on their payments and if they did this to thousands or hundreds of thousands of customers, they have heavily profited from their inappropriate actions and the extra payments provided them with a very large boost of capital that may or may not be actually benefitting the customers accounts. So Ocwen said they would n't make any more payments that had been ongoing via ACH for years and in the same letter said I could set up an ACH Payment but ONLY if I pay them payments that are n't due for a month!!!

Consumer Complaint: One three separate occasions since XXXX XX/XX/XXXX I have had to contact Ocwen Loan Servicing so they could update my Date of Last Activity from XXXX XX/XX/XXXX ( incorrect date they keep reporting ) to XXXX XX/XX/XXXX ( correct date ). On all three occasions they have made the change, it has reflected properly on my XXXX ( no other has the account on their files ) to than five days later go back to showing the wrong date. we are now on the fourth time this same thing has occurred. Ocwen needs to be punished for doing this to a consumer. I have been denied credit, been unable to buy a car and most important refinance my house all because they are incompetent. I have been trying for 9 months to fix.

This time, they are holding the funds that are needed to pay for the repairs and adding more requirements to release the funds. I am forced to borrow money to pay the contractor doing the work. One such requirement was an inspection at the end of the repairs, now they are changing that to an inspection at XXXX %. We already completed XXXX % and they are still requesting documents before they schedule an inspection that was not agreed on nor communicated clearly.

Consumer Complaint: Ocwen miscalculated my property taxes and as a result, my monthly escrow amount is {$1700.00} instead of {$700.00}. About a year ago, my property taxes got paid twice by Ocwen. My county refunded Ocwen the overpayment amount. Ocwen then calculated my taxes based off the double payment showing I was short, even though I was n't and Ocwen received a check for the overpayment. It is very frustrating because Ocwens XXXX call service center recognizes the error and every time I call to have my escrow recalculated to my correct tax bill, I am told it takes up to ten days and " I will put in a request ". Nothing happens. For a company so large to be so incompetent is beyond me. Unfortunately, Ocwen can see the error, but they wont respond. After reviewing the negative press surrounding Ocwen, I would think they would resolve customer complaints. Also, this is so simple and they ca n't fix it. Take my annual taxes divide by 12 months and you are done ... simple.

Consumer Complaint: Related Case Number : # XXXX & XXXX Ocwen alleged in their response ( XXXX ) that I claimed they " directed '' me to get a lawyer and discontinue scheduled mortgage payments. ( " We respectfully refute your allegations that we forced you into hiring an attorney and caused you to stop making monthly payments. '' ) I did nothing of the sort. What I indicated was that they declined my applications for assistance in XX/XX/XXXX. My financial situation was exactly the same in XX/XX/XXXX ( DECLINED ) as it was when my next application was begun again in XX/XX/XXXX ( LATER APPROVED ). The ONLY difference in my situation, between XX/XX/XXXX and my later attempt in XX/XX/XXXX XXXX, was that I HIRED AN ATTORNEY and to afford, said legal assistance, DISCONTINUED MAKING MONTHLY MORGAGE PAYMENTS. One unintended, though extremely valuable benefit, was that OCWEN/Lender now had to confront the very high costs of the foreclosure process, maintaining the property, and the significant losses, if & when, they were able to sell it. So while they never verbally, or in writing, " directed '' me to STOP making payments or HIRE an attorney, they behaviors with earlier attempts certainly did precisely that. AS A RESULT THEY CAUSED THE MISSED PAYMENTS & THAN PENALIZED ME FOR DOING SO. With regard to the appropriate and required revisions to my credit report they claimed : " We are obligated to report the account accurately to the credit bureaus.. ''. As a result I 'll require PROOF that was in fact a " legal obligation '' ; required by relevant LAWS in place at the time. Also, a complete list of said laws so that I may conduct a review. Finally, with regard to eliminating the balloon payment. As with all agreements everything is negotiable. When the market crashed in XX/XX/XXXX I continued to make monthly payments on the loan, ( fraudulently initiated & reported to the NY AG ) at an interest rate several time higher than the lender could have gotten anywhere. So, I personally kept their balance sheet in the BLACK for over half a decade. Their mortgage modification, while lowering on-going payments, adds a balloon payment after 30 years that effectively forces me to buy the home twice. Effectively making me a 30yr RENTER with XXXX Equity. So I 'm merely asking the lender to eliminate the balloon and help BAIL ME OUT in the same way I did them ; by virtue of my continued timely mortgage payments and tax dollars to bail out their mortgage industry.

Consumer Complaint: When my home loan from XXXX was sold to or contracted for servicing by Ocwen, an escrow was assigned without my consent. The payment amount tripled. I was charged additional interest and fees for nonpayment of those amounts. In short, Ocwen refused to retake control of my note under the original terms. The escrow amount is bogus, XXXX dollars per more than I was paying for taxes and insurance. I have been unable to reach anyone at Ocwen who can explain the amount OR refer to language in the original note that required or permitted them to take such an action. Neither would they allow me to pay just the regular principle and interest amount without applying 2/3 of the payment amount to the escrow, so I could pursue a remedy. Needless to say, the much higher monthly payment cause delinquencies that accumulated, but not above the disputed amount. Now they are proceeding with a foreclosure auction this month ( XX/XX/XXXX ). To make matters worse, they sent notice to my renter. ( The property is an owner occupied duplex. ) I have never been able to speak with the same person twice at Ocwen. Can I stop this and make them work with me to relinquish the escrow on the loan? A person can work with local government on the taxes, if necessary, as they have to answer to the public!

Consumer Complaint: Ocwen Loan Servicing foreclosed on our home XX/XX/XXXX ( this was ratified by the courts the following month ). Since that date we have been working toward repairing our credit, in order to once again have the opportunity to participate in home ownership. We have put ourselves in a position to be pre-approved for a VA loan, but have been denied, because we are still the owner of record for the home they currently own ( XXXX ). We reached out ( by letter ) to their research department in XX/XX/XXXX and received a response dated XX/XX/XXXX. The response said they are looking into our problem and would get back to us within 30 days. We received a second letter dated XX/XX/XXXX, which confirmed what we told them and said that they are in the process of obtaining the deed. Once the deed is recorded they will send us a copy. We waited over two and a half months for resolution, before attempting to find out what progress has been made. We called them on XX/XX/XXXX and they had no answers, but asked us to call them back the following week. We called, once again on XX/XX/XXXX and this time they had an answer. They told us, there was an open water bill that they needed to take care of before they could move forward with the recordation. We were not happy with the " EXCUSE '' and asked to have this elevated. They gave us another number to call, which we called on XXXX/XXXX/XXXX. We explained the problem, once again and was told that they would take care of the problem and we should receive a call back by the end of the week or early the following week ( XX/XX/XXXX-XX/XX/XXXX ). We waited, did not hear anything, so we called them back on the XX/XX/XXXX and they said nothing has changed. They assured me that if they do n't have it resolved by the first of next week ( XX/XX/XXXX-XX/XX/XXXX ), it would be elevated to another level. We are at our wits end! Please let us know, if there is anything further we can do to get this resolved. It appears, as if, they have no desire to resolve this issue. If you ask us, this should be illegal, if not criminal to hold folks hostage!!
