Consumer Complaint: Good Afternoon! In 2009 Pres. Obama gave the banks money and bailed them out ; many claimed loses on mortgages. My mortgage had been securitized several times I learned about securitization from the XXXX XXXX XXXX Ocwen now is " servicing '' the loan, which is now approx. {$40000.00} under water/upside down. Ocwen has never reduced my mortgage by that amount ; they were not the servicer at the time ; it was XXXX XXXX. That company only would offer a " modification '' I contacted the att'y general in my state of New York . I was told that they would rectify the situation. After investigationg, I was told that the modification would be a first step to hopefully reducing the principle to get it back above water/rightside up. I did take the modification, however the mortgage wasn't reduced it now had a Ballon Payment at the end of the loan term of some approx. {$30000.00}. I need help getting this principle reduced so that I'm no longer under water/upside down in this mortgage. Also, if XXXX XXXX did take money from the gov't. to be bailed out I want MY BAILOUT

Consumer Complaint: I have telephone recording conversation when Ocwen Loan Servicing employees calling me several times harassing me threatening me with fraudulent seizer of my home I own and then me laughing at me before hanging up the phone. I would like the CFPB to listen to the recording. I have been brainstorming for a good new name for Ocwen Loan Servicing and its fraudulent foreclosures. Please dont change Ocwens future new name to the XXXX XXXX. Please name your fraudulent unorganized crime operation, Embezzlement, the pretender lender loan servicer because fraud-foreclosures is what we do.

Consumer Complaint: I have a property that was quiet claim to me. Ocwen say it is in foreclosure stopping me from doing anything and tieing up my equity for investments in other real estate. They also keep paying my taxes. I have sent them letter to stop this and to remove the lis pendis from my property. but they still pay my taxes and i keep sending letter for them to stop. cfpb told me cit owns the supposed mortgage but i have not been able to get them to respond since 2016. so i am trying this all again. Consumer Complaint: Since XX/XX/XXXX my mortgage has been serviced by Ocwen. They have never handled my escrow account properly. The first red flag was that it took two months to get Ocwen to acknowledge my property insurance policy number. On XX/XX/XXXX, after numerous unsuccessful calls from both myself AND my insurance agent I finally had to make a three way call with Ocwen and my insurance agent to prove to the Ocwen agent that my XXXX XXXX XXXX WAS accepting calls at the number I gave him. Twice a year, they mail a letter to me requesting that I send my actual property tax bill in an enclosed return envelope, by a specific date. I am never sure if I will receive this letter at all, let alone on time. If and when I do receive the letter, nowhere on the envelope or in the return window does it state that it is from Ocwen or that it is regarding a time sensitive issue from a mortgage company. As far as business practices are concerned there is no good reason to do this. Excluding the business name on the envelope makes it appear no different than junk mail. Since XX/XX/XXXX I have been asking Ocwen why they choose to exclude their company name on these envelopes and they will not answer the question. I have always paid my bills in a timely manner and have a great credit record. I can pay property tax and insurance on my own without these issues. I sent a request for escrow account waiver XX/XX/XXXX and have not received a response about that either.

Consumer Complaint: In 2012, Ocwen Loan Servicing cozied up with shady XXXX XXXX who scrambled and then obtained the phony XXXX file that was sitting on top of the pretender lender loan servicers criminal CEOs desk that is stuffed with fabricated documents, forgery and fraud, manufacturered force place insurance policies, false principal balance, false payment history, void assignment, manufacturered note, and lots of other fraud and then started slandering my title again and again to embezzle. Shady Ocwen was using and adding false information, false balances, false dates, false payment amount, false bankruptcy information and other false information to all three major credit reporting agencies, XXXX, XXXX and XXXX. Ocwen Loan Servicing intentionally done these quiet crimes for years and intentionally failed to respond to my many letters and complaints regarding credit reporting intentional fraud errors for many years causing me exteme harm. I have most of my credit reports that will be given to the court. Fraudulent Ocwen shady employee XXXX XXXX who is assisting her white collar crime operation with embezzlement intentionally removed Ocwen incorrect information from my credit report to sweep another white collar crime under the fraudulent CEOs desk. Never would of thought that Ocwen could brainwash a young new lawyer to assist pretender lender loan services with fraud criminal white collar crime embezzlement. This complaint is evidence that I have spoken with the City of XXXX Mayor who forwarded my matter to the sheriffs. Crooked pretender lender loan servicers and lawyers who tweak up the laws to hide from crimes they commit are the ones who always fail with thousands of open lawsuits. This is what incompetent crime bal people do!

Consumer Complaint: Lender and Loan Servicer : Ocwen Loan Servicing LLC XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX, Fl XXXX Address for serving Ocwen with Legal Process : XXXX XXXX XXXX XXXX XXXX XXXX, DE XXXX Loan # XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, FL XXXX Ocwen, as the loan servicer, has stopped reporting my loan payment history to the credit bureaus. They have stated to me verbally ( at least 4 times in the past 6 weeks ) that our mortgage loan was discharged in a bankruptcy, which is not correct. This is having a detrimental effect on my credit status due to this incorrect reporting by Ocwen. I have made repeated phone calls to correct this. I have supplied overwhelming documentary evidence to Ocwen showing that they are in error and need to correct this in their system. Most recently, on XX/XX/XXXX, The Ocwen representative ( XXXX XXXX ) has continued to insist verbally, without any proof or documentation, that our mortgage was discharged in a Chapter XXXX bankruptcy. I very patiently explained to him, on at least two seperate phone calls, that a Chapter XXXX bankruptcy only covers unsecured debt, such as a credit cards, and that it is impossible for a mortgage to be discharged in a Chapter XXXX bankruptcy. Nevertheless, Ocwen has pulled my mortgage loan reporting to the credit bureaus. I specifically requested in a written email to Ocwen that my loan status get corrected, specifically so that it would not be incorrectly reported by Ocewn. Ocwen 's action after my written request was to do exactly the opposite - they ceased reporting our loan to the credit bureau. This constitutes harassment. To the best of my knowledge, the Ocwen employee responsible for these actions, based on his own ststements to me personally, is XXXX XXXX. He is a senior escalations manager at Ocwen. Per XXXX XXXX XXXX request, I sent him the relevant documents regarding our Chapter XXXX bankruptcy. I also contacted the Ocwen Consumer Ombudsman on XX/XX/XXXX. These are publicly available court documents available to anyone on the US Court PACER system, which is where I got them from myself. I can supply this information to the Consumer Finance Protection Bureau as well, if needed. The Chapter XXXX bankruptcy case that XXXX XXXX has cited is : XXXX XXXX I asked Ocwen to again report our mortgage to the credit bureaus as being part of our credit history. I asked Ocwen to please supply me any documentation they may have that contradicts any of the information I supplied to them. Ocwen is currently not reporting my mortgage history to the credit bureaus. This incorrect action on Ocwen 's part affects my credit history in a derogatory manner. My long record of timely mortgage payments needs to be reported to all 3 credit bureaus immediately and correctly. I requested that this credit reporting issue be corrected by Ocwen previously. Ocwen has not complied with my request to date. Additional information : We later DID file a Chapter XXXX bankruptcy case in the Florida Middle Federal Bankruptcy Court : Case XXXX This Ch XXXX case DID involve our mortgage. The mortgage was NOT discharged in this Ch XXXX Bankruptcy. After the Chapter XXXX bankruptcy was DISMISSED ( not discharged ) The mortgage was later modified by the private lender ( Ocwen themselves ) via the federally guaranteed HAMP program. This was done AFTER the Chapter XXXX bankruptcy was DISMISSED ( not discharged ). After the Chapter XXXX bankruptcy was DISMISSED ( thrown out of court ), I was able to directly work with Ocwen to complete the loan modification process. This was not possible to do while inside a Chapter XXXX bankruptcy, which would have needed to go through the Chapter XXXX Trustee. This was too complex of a process for either Ocwen or myself to negotiate. Therefore, Ocwen and I did it privately, between ourselves, only AFTER we were out of our Chapter XXXX Bankruptcy. I have include the Ocwen HAMP modification acceptance documentation, as well as the Ch XXXX and Ch XXXX voluntary petitions. There is no doubt as to the status of our mortgage. I am dumbfounded as to how or why Ocwen could possibly have gotten this so wrong, or the reasons for XXXX XXXX XXXX 's arrogance and insistence regarding this. Consumer Complaint: I am a customer of XXXX XXXX XXXX. My first complaint is I was never notified about the lawsuit and making a claim. We pay our mortgage every month and somehow we are being charged with {$5000.00} in late fees or other miscellaneous fees. It keeps going up. In addition to this problem, every year according to them our escrow account is short for paying homeowners insurance and taxes. This is almost impossible. I contacted Ocwen about a year ago regarding the processing of our monthly payments and fees to get an accounting history on this and I never received anything. We really need to have this rectified and I believe we should have a part of the claim filed against them as we have been billed incorrectly and right down frauded. I am hoping to get some assistance to fix these errors and compensated for the mistakes that are piling up every month. Thank you

Consumer Complaint: Modification paperwork was submitted, and we were told not to make payments during the modification process. We submitted documentation for the loan modification at least three times. XX/XX/XXXX, we received notice asking for two most recent pay stubs and YTD income for each job. On XX/XX/2014 we received notice from Ocwen that pay stubs for borrower one were not legible. The letter also indicated that a complete package for the modification must be received by XX/XX/2014, or a new loan modification would need to be submitted. XX/XX/XXXX, XXXX, and XXXX 2014 we received to notices requesting us to submit borrower 's one pay stubs. The pay stubs including all paperwork was submitted again. XX/XX/2014, we received a letter from Ocwen stating that the application was accepted. If more documentation would be needed, we would be notified in 5 days. XX/XX/2014, we received another letter stating that the application had been received. We would be notified within 5 days if more documentation would be needed. XX/XX/2014 foreclosure documents were delivered by the county sheriff 's department. We were given 7 days to vacate because the home was foreclosed.

Ocwen is moving to foreclosure violating Debt Collection Laws, violating Texas Property Laws committing Fraud by not providing the lender of the loan and sending the home to foreclose despite the dispute I have spoken with Ocwen and their Obudsmans XXXX who has informed me they will be moving forward with a foreclosure after filing a dispute under US code moving foreclosure sale scheduled XX/XX/XXXX. I sent a dispute to OCWEN to send the Name, and address of the lender who has the payable deed, promissory note showing the lender. I have only received information ( 1 ) That Ocwen is the servicer ( 2 ) That the lender is a group of investors ( 3 ) that the lender is XXXX as listed in the notice for foreclosure sale, which is fraud due to the loan was sold in XXXX. ( 4 ) Ocwen also has listed XXXX XXXX as listed in the instrument debt and obligation of modifications, liens, and promissory notes. I have not signed any documents with XXXX XXXX. Ocwen has yet to send any proof of who owns the loan. I spoke with XXXX XXXX informing her that there is an error in the Notice of Trustee Sale posted at the county. They have XXXX as the lender who sold the loan to XXXX XXXX. XXXX stated that is who they show as the lender. I said that is impossible being they sold it how can that be when my payments were no longer going to XXXX but XXXX XXXX XXXX and XXXX as the servicer. Ocwen is the servicer now and stating the lender is XXXX this is not true and it is a fraud. I am needing some answer and this is a disputed debt. I am demanding the foreclose sale date is remove. Ocwen can provide the information or not an if they can not they must cease and desist. I am not affording them any more time they are to stop this foreclosure which is fraud. XXXX XXXX ( 4 ) XXXX XXXX without notifying notes indicating to proceed. Ocwen refused to cancel the foreclosure stating they put it on hold internally this is a violation of debt collection laws and Texas foreclose laws. They stated they put it on hold in their internal office leaving the Foreclose in place for XX/XX/XXXX while they do their investigation this is illegal. PROPERTY CODE TITLE 5. EXEMPT PROPERTY AND LIENS Sec. 51.002 ( d ) Notwithstanding any agreement to the contrary, the mortgage servicer of the debt shall serve a debtor in default under a deed of trust or other contract lien on real property used as the debtor 's residence with written notice by certified mail stating that the debtor is in default under the deed of trust or other contract lien and giving the debtor at least 20 days to cure the default before notice of sale can be given under Subsection I was not given 20 days from when you filed for foreclosure to cure the debt. You just sent me a notice of foreclosure sale and posted the home for sale before the 20 days were completed. ( b ). The entire calendar day on which the notice required by this subsection is given, regardless of the time of day at which the notice is given, is included in computing the 20-day notice period required by this subsection, and the entire calendar day on which notice of sale is given under Subsection ( b ) is excluded in computing the 20-day notice period. ( e ) Service of a notice under this section by certified mail is complete when the notice is deposited in the United States mail, postage prepaid and addressed to the debtor at the debtor 's last known address. The affidavit of a person knowledgeable of the facts to the effect that service was completed is prima facie evidence of service. Sec. 51.0075. AUTHORITY OF TRUSTEE OR SUBSTITUTE TRUSTEE. ( a ) A trustee or substitute trustee may set reasonable conditions for conducting the public sale if the conditions are announced before bidding is opened for the first sale of the day held by the trustee or substitute trustee.
