I told them and sent them documentation I was selling to a buyer, the buyer needed more time to get bank approval and the mortgage company asked for proof of funds, which was given to them, but they went ahead and foreclosed anyway.

Consumer Complaint: ***urgent help needed *** PHH , servicer for XXXX illegally Forclosed on my home on XX/XX/XXXX violating RESPA , Dual Tracking, & Due Process. I am requesting Void/Cancellation of the forclosure sale that took place of my home and causing severe XXXX and XXXX for me. For seniors is there an Elderly Financial Exploitation claim I can make? This is blatantly unlawful right? Despite ME reaching out 3x on 3 different days nearing the 'sale date ' then I was never replied to by the bank 's representative NOR the banks legal representatives. I emailed Legal and the rep at PHH asking them who will put in a cancel ( this 'cancel ' has been done before. ) It is clear PHH/XXXX NEVER intended to 'help ' after numerous mailings to me to the contrary and confirming receiving my documents within the time frame ALL documents. I keep documentation ask me! Imagine, NO ONE available to offer me legal advice, pro bono is too " busy '', and I know no one to ask for help and given the history & XXXX. of XXXX, I felt they would pull this but I was helpless to the devastation which lay before me. XXXX perpetrated fraud. I still never got an answer. So after an emergency petition I have a hearing XX/XX/XXXX without a lawyer not knowing what to say. Can anyone Assist on what I should do please or next step? Please I am Senior at XXXX & love my home of 19 years and no place to go!

Consumer Complaint: I was behind on my mortgage by alot. PHH mortgage offered me a loan modification in XXXX XXXX to begin payment on XX/XX/XXXX XXXX. It was a 3 month trial payment. House was scheduled for foreclosure in XXXX XXXX XXXX. Was pushed ahead and ahead. I made my 3 consecutive payments XXXX, XXXX, and XXXX @ {$3000.00}. No payment for XXXX as this was the new loan origination date. I paid XXXX mortgage at the same {$3000.00}. PHH mortgage says they sent out final modifications agreements that were to be returned XXXX. I didn't receive the initial mailing of modification. PHH contacted me by phone and then sent bit via email. Mailed back original modification on XXXX they still foreclosed on my house on XXXX @ XXXX. I made all payments required under the trial payment plan and still foreclosed citing they didn't receive the signed modification agreement. Spoke with PHH on XXXX and was told there was no foreclosure taking place.

Consumer Complaint: I'VE SENT LETTERS TO XXXX XXXX ASKING FOR DEBT VALIDATION INFO, THE WET INK SIGNATURES THAT BINDS BOTH PARTIES TOGETHER IN THIS CONTRACT BY CERTIFIED MAIL, EQUAL CONSIDERATION ( SHOWING THAT THEY PUT UP THE MONEY THAT WAS LOANED TO ME FOR THIS MORTGAGE. FULL DISCLOSURE THAT I WAS THE ACTUAL PERSON FUNDING THE MORTGAGE. Consumer Complaint: Im writing to appeal your decision to deny my loan modification application submitted on XX/XX/23, when you claim to have been willing to reverse the decision to cancel and accept payment by XX/XX/23 but failed to communicate this to me in writing. No one told me about this offer when I returned the call from XX/XX/23 and instead was told I had to submit a new application which I did on that very day ( XX/XX/23 ). I was just APPROVED 60 days prior for the modification and in those 60 days, I sent in the first payment, which got accepted. I sent in the second payment, it initially got accepted and then returned back to me, for a reason which was not explained. I spoke with PHH and they never told me to resubmit the payment by XX/XX/23. Which I would have done because I already sent in the payment. What is going on is not right. Ive been fighting to keep this house and I finally got approved for the loan mod, please reconsider. I only found out about your offer to reverse the cancellation after I checked with the complaint I filed with the CFPB. Unfortunately after XX/XX/23. Your current reason for denial is now related to XXXX which is inaccurate based on the condition of the house. Due to the condition of the house, this home is not worth {$680000.00}. See the listing of comps ( attached ). Which I believe PHH said that is {$14000.00} over what the loan mod would be approved, which is wrong because I was just approved 60 days ago. This home has been in my family for 49 years and represents XXXX generational wealth and I would very much like to keep it in the family. I appreciate your reconsideration of the reversal of the current denial especially in light of the situation that caused it on your end. Respectfully, XXXX XXXX

Consumer Complaint: My mortgage company has been reporting my mortgage loan as past due to all major credit reporting agencies in error for the past eighteen months from XX/XX/XXXX, through the current date. I have made numerous attempts to get them to correct this issue, but the company refuses to do so. They continue to believe that they are reporting accurately. I have requested the company provide evidence that would validate why they believe that my loan is past due, but they can not produce any information that would support their reason for doing so. I have forwarded the proof that I have to the mortgage company to show evidence that they are reporting my loan in error, and they still refuse to correct this issue. This issue has totally ruined my credit history and has taken a toll on my health. This mortgage company is a lender who has been suspected of violating residential lending laws and consumer protection rules. The company has been sued by a mortgage holder for inflating property inspection fees for defaulted loans, and this is what they are doing to me as well. They have also been opposed by a group of attorneys general for charging excessive and unnecessary fees for online and phone payments. This company has assessed a {$1400.00} fee to my loan due to me being persistent in getting this issue resolved, which is totally unfair to me for being concerned about my mortgage. PHH Mortgage Services has mishandled my loan and breached their duty to maintain my loan in an accurate manner. My mortgage is one of my greatest assets, and I take pride in my home. I am so disgusted with my mortgage company for refusing to resolve this issue that has caused me a great deal of intentional emotional distress. I hired an attorney to resolve this issue, but he seems to be giving me false hope. My co-owner filed for XXXX XXXX bankruptcy on XX/XX/XXXX. At that time, Ocwen Loan Servicing was the lender for my mortgage loan. After the bankruptcy was filed, Ocwen Loan Servicing stopped recording due dates on my loan, which is the start of what has caused issues on my loan. Ocwen Loan Servicing knew that my loan was in the process of being transferred to a new lender, which is now PHH Mortgage Service. My loan was transferred to PHH Mortgage Service on XX/XX/XXXX, ( Exhibit 1 ) while still in an active bankruptcy. Upon acquiring my loan, PHH never reviewed my loan for accuracy and assumed my loan as it was. My loan with PHH was to begin on XX/XX/XXXX, but PHH documented that my loan was due for XX/XX/XXXX, which was inaccurate. I have enclosed my bank statement to show that the XX/XX/XXXX, payment was paid to the previous lender, Ocwen Loan Servicing, and my first payment due XX/XX/XXXX, was paid to PHH. ( Exhibit 2 ) PHH Mortgage Service would not correct any errors while the loan was in an active bankruptcy. When it was time for my XX/XX/XXXX, payment, PHH once again documented that my loan was due for XX/XX/XXXX, which is the start of a two-month error. My loan has been processed in error from XX/XX/XXXX, through the current date, due to a due date error that was overlooked and never corrected when PHH first acquired my loan from Ocwen Loan Servicing on XX/XX/XXXX. The bankruptcy was paid in full in XX/XX/XXXX, and discharged on XX/XX/XXXX. ( Exhibit XXXX ) After the bankruptcy was XXXX on XX/XX/XXXX, PHH immediately started reporting my loan as past due. ( Exhibit 4 ) I mailed a certified letter to PHH concerning this issue, but the issue was not resolved. I received a response letter from PHH stating that my loan was due for XX/XX/XXXX, which is incorrect. ( Exhibit 5 ) Due to the two-month due date error in XX/XX/XXXX, the loan was in bankruptcy and was never corrected, which is the reason why my loan is in default. ( Exhibit 6 ) However, {$550.00} was in a suspense account where PHH took the liberty to apply {$180.00} from the suspense account balance and applied it to the principle to secure a payment for the XX/XX/XXXX, payment. I also submitted a payment in the amount of {$630.00} for the XX/XX/XXXX, payment, making two payments being applied to the loan for the month of XX/XX/XXXX. ( Exhibit 7 ) As of today, PHH is still reporting my loan as 30-days past due, which is still incorrect. If the XX/XX/XXXX due date errors are corrected, my loan should reflect a current status. I have enclosed a payment history to show that all payments were made. ( Exhibit 8 ) I also forwarded this information to PHH Mortgage Service, but they refuse to accept accountability for their error, which is keeping my loan in a past due status with PHH and all national credit reporting agencies. I am in great need of assistance, and I pray that you can assist me in this matter. I have enclosed the evidence that I have to prove that PHH Mortgage Service has reported my loan inaccurately to all major credit agencies. Anything you can do to assist me will be greatly appreciated. Consumer Complaint: PHH took over servicing the reverse mortgage on my late parents house. I am the XXXX XXXX trying to sell the house. It took me several years to evict a squatter and the house has been in foreclosure during those years throughout the pandemic and eviction moratorium. I thought we had agreed to hold the foreclosure in abeyance to give the estate a chance to short sell. After we finally got access to the house we discovered that the tenant had trashed it. Our interested buyer who had patiently waited to submit their offer could finally see the interior of the house. The banks appraisal came in lower than they expected and they put my buyers short sale offer on hold pending a police report that they wanted the estate to file so they can file an insurance claim to offset their losses instead of negotiating the the short sale in good faith. Meanwhile the bank refused to stay the auction which is scheduled in 3 weeks. This is a bad faith maneuver. I have no choice but to put the estate into a bankruptcy action to stay the sale.

Consumer Complaint: This is yet another attempt by me to get the information corrected by this company. the company has provided the credit reporting agencies the wrong information. which in turn stopped my wife and I from gaining the equity in our home. They advised that through their research they never spoke with or had any contact with me regarding a forbearance. I clearly reached out to them in XXXX of XXXX. They responded in XXXX of XXXX. Several months later. Instead of offering me a forbearance they sent me and my wife a modification. Why we would take a modification when the rest of the nation under the cares act was provided a forbearance ; shows the type of bad intent and business they continue to do and provide. I was XXXX XXXX XXXX XXXX and thought we were getting a forbearance. We did not and have found that the company after sending us a letter stating that during these times, they would not report negative history and went against everything that they stated in the correspondence. A correspondence that printed on their letter head is legally binding. Also, we have now found that our balance use to be XXXX is now XXXX on their website. This is a clear violation of our rights. This company has been terrible. This issue even goes all the way back to XXXX when they were Ocwen and cancelled over XXXX of debt through a 1099C. In XXXX they cancelled the debt for the amount of just over XXXX on another 1099C form. We borrowed XXXX and they ended up cancelling over XXXX and getting credit for it from the IRS. ( info included ) We checked with the IRS during that time and found that they indeed did get credit for the debt cancellation. How are they allowed to get credit then go after the consumer? I own my own company and can't write off any amount and still go after someone who owes me for the original amount! All we want is to have the amount and credit reporting corrected. If not, we will be forced to join the many class action lawsuits against them. This company should not be allowed to practice business at all. The little man consumer is being crushed by companies like these as they are allowed to rip us off through bad/illegal business practices!
