Issue: Incorrect information on your report

Subissue: Information belongs to someone else

Consumer Complaint: I have contacted all three Credit Bureaus/Agencies ( XXXX, XXXX ) and the Creditor ( DEPT ED/NELNET ) involved in this matter several times trying to resolve this issue. Notifying them that they were not in compliance with their incorrect report per FCRA and that the accounts were fraudulent and that I'm a victim of identity theft. In return to tell me that these fraudulent accounts were verified and/or belonged to me or no response at all. None of these companies have provide me with any proof such as any original documents bearing my original signature. Either way, the reporting requirements do not comply with FCRA Section 611 ( 15 U.S.C. Section 1681 ) and the information must be deleted immediately.

Issue: Dealing with your lender or servicer

Subissue: Keep getting calls about your loan

Consumer Complaint: I forgot to schedule my payment to come out on the due date, so I scheduled it to come out as soon as I realized the error. The payment is scheduled to post on XX/XX/XXXX. My mother told me she received 3 phone calls on the XXXX and 3 on the XXXX about the severe delinquency of my loan. I am the primary borrower and only received one call. My loan is barely 15 days past due. When I contacted Firstmark they started that they continue to make those calls even if the payment I scheduled. I asked why they felt the need to call over and over again. They said the calls are randomly generated. I asked why the primary borrower wouldnt be contacted first and he was like oh I dont know. Then he said the calls will continue until XXXX XXXX of the day of the scheduled payment. This is very misleading. My mother was going to make the payment, but thankfully I let her know I already had one scheduled. This tactic seems very misleading and manipulative. If someone has a payment scheduled, they should not be calling anyone other the primary borrower, and they really shouldnt be calling anyone at all if there is a pending payment. The volume of phone calls and e-mails my mother received is borderline harassment. This company should not be allowed go call people numerous times a day when they have a payment pending!

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: On several occasions, Firstmark Services has made promises of applying a Natutal Disaster Forbearance to my XXXX XXXX loans for wildfires experienced in XXXX County. I have had over ten contacts with this company, and on each call, they state they are submitting this to be applied and expedited, each and every time, most recently today, XX/XX/21. Meanwhile, my account continues to grow more delinquent during a time of severe hardship and Firstmark has not honored their promise of applying the forbearance to my XXXX XXXX XXXX XXXX XXXX loans. This company is absolutely subpar in terms of customer service, has caused me great distress over many contacts and still refuses to honor their promise to apply these forbearances on multiple calls spanning four weeks now. This matter is time urgent and requires immediate resolution prior to credit reporting in 6 days.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: The issue that I am having is such ; the credit reporting agencies claim that I owe for three loans that they claim were issued in XXXX but I only got one loan for one semester. I only attended XXXX one semester but there are three loans and I qualified for a Stafford grant then so that paid for a percentage close to XXXX XXXX XXXX. That's XXXX near one semester so why does the loan company day I owe for three more loans totaling almost XXXX XXXX? When I was in XXXX I filed a credit report and noticed that in XXXX they reported my loan was forgiven and since XXXX was involved in the loan scam I believe it was forgiven but as soon as I got released from XXXX a few months later in XXXX someone got three loans they say I owe for now but they are saying it's still from XXXX but I am certain they said I owed nothing in XXXX. Could you please help me with this issue? They refuse to forgive it and I've only had one loan and when I took as semester break I was charged and sent to XXXX so I never got to complete college. It's my first loan and I don't know why I don't qualify for forgiveness if worst things the loans are they original loans. And if they are why were they removed and then put back? And why does the credit collection companies buy debt that I still owe to the courthouse or county for court costs? Why do they keep selling it to other companies before it can arrange payment plans?

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Because of covid 19 and the Cares Act, federal student loan payments were suspended until XX/XX/XXXX. Nelnet is not suspending my student loan payments because they refuse to recognize my loan as a federal student loan. My federal student loan originated from the XXXX XXXX XXXX XXXX XXXX in XXXX. Nelnet bought my loan from the XXXX XXXX XXXX XXXX in XXXX. I have been making payments to Nelnet since they bought my loan. I am currently still making the monthly payments even though my student loan qualifies for no payment under the Cares Act. Nelnet needs to stop inaccurately labeling my federal student loan as private. I never had any private student loans when I attended XXXX. I had XXXX student loans which were and still are federal student loans.

Issue: Dealing with your lender or servicer

Subissue: Problem with customer service

Consumer Complaint: I graduated undergrad in fall XXXX so my private student loan, previously held at XXXX XXXX XXXX and now currently at Firstmark Services, was in grace until XX/XX/XXXX. I entered XXXX school in XX/XX/XXXX and called Firstmark Services to find out if I was eligible for deferment. I was told yes and sent a form for my school to fill out. I returned said document to Firstmark Services the beginning of XX/XX/XXXX. Never heard anything back. When I called on XX/XX/XXXX to make sure I was back in deferment, customer service rep was rude and condescending and told me that my document was declined due to missing my schools stamp or seal. Upon asking why no one had informed me, customer service rep said that because I was in grace, I was not a priority. All the while I could hear his tv playing in the background. I had to ask multiple times if I needed to make a payment before this deferment business was fixed and he was not giving me a clear answer. There is no where on their website to leave a complaint or do a survey either

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: This account is being reported as 90 & 120 days late on my credit report on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX which does not seem to be reporting accurately and legally per the Fair Credit Reporting Act ( FCRA ) and the Fair Credit Billing Act ( FCBA ). I would like for you to investigate the late payment history and prove to me that in fact was delinquent on the date reported. It is the responsibility of the furnisher to report accurate information per Section 623 of the FCRA and it is the responsibility fo the Credit Bureau to hold them to those standards
