Consumer Complaint: In the early XXXX my husband and I consolidated our student loans. We had been married For approximately seven years and we're starting a family. And work told it was in our best interest to consolidate. The remaining parts of our student loans, which we have been paying on. Since the early XXXX. We had only had the XXXX when there have been job layoffs or one income. At the time it was Sallie Mae which turn to navient. In XXXX My husband was involved in a car accident which left him XXXX XXXX XXXX. Once The courts deemed my husband XXXX XXXX our student loans, which had been one for nearly 10 years consolidated were considered with official legal paperwork to be 100 % XXXX balance. For 7 years, we heard nothing. And had the official paperwork that showed both from navient and from the courts that there was a XXXX balance. 7 years later navient came after me under my maiden name. And told me that I owed double because of Interest the amount that was left on the consolidation. They took a federal student loan turned it into a private loan without my consent put my name on it. XXXX interest and sent it to me. I offered to pay the portion of what I actually owns. They hadn't contact me in 7 years and denied me. My husband and I are working with a XXXX XXXX XXXX XXXX. And since it is a private loan. It can not be turned into New York State education. Navient has acknowledged that. It is a private loan on record. And yet they have now turned it over to New York State education threatening me. XXXX interest rate on a loan that I don't owe. Which is double what was actually initially owed which was the remainder of a loan that I had paid down significantly with my husband. We absolutely can not find anyone to help us. Navient continues to move my name around without my consent. They refuse to acknowledge that it is paid in full. They change it from a private loan to a school loan back to a private loan to a school loan which is illegal and without consent. This is completely illegal. Is there anyone who can help us? And allow us to be part of any sort of class action or lawsuit.. Navient refuses to stop cooperate. They will not even discuss this with the XXXX XXXX XXXX XXXX company that they are legally obligated to speak to because they have turned it into a private loan.

Consumer Complaint: I went through a divorce and I have a daughter that is totally XXXX. I was on time with my payments when I was put through a divorce. Now my interest and payments jumped up XXXX. Making it almost impossible to pay back. I am just now getting back on track where my check isn't garnished from marital debt that I was left with. I am getting ready to lose my job cause it is moving and closing. It is impossible for struggling people pay when the loan company Navient charges so much interest. If the interest was lowered and it was closer to the true amount I actually owe, I would be able to pay my debt.

Consumer Complaint: While trying to call Navient to issue a CORRECTED 1099C - they are currently giving me a runaround, hanging up on me, or reading off a script which does nothing but waste time. I co-signed many student loans for my XXXX children and other relatives. Navient sent a 1099C to the IRS and as of today - CAN NOT tell me who or which loan is involved. The IRS is now involved. I've tried several times to speak with the Navient Escalation team to rectify this. Today, in speaking with a Navient Escalation team member first told me she could not tell me WHO the borrower of the loan was, then proceeded to tell me it was for my daughter, then later in the conversation said my son 's name. When I questioned her on this, she denied saying my daughter 's name. She then read off the address that she claimed the 1099C was sent to and it was the wrong address. When I pointed this out to her, she denied reading off the wrong address. She then said she would 'RESEND ' the 1099C and then quickly she hung up on me. So, I'm am now VERY concerned Navient is going to CREATE and send out 1099Cs willy-nilly and impact more people. What's odd about this whole thing is that according to my research - Treasury Regulation SEC. 1.6050P-1 ( 7 ) - states that for purposes of filing, 'a guarantor is not a debtor ' - it differentiates between those who get the benefit of a loan and those who guarantee its repayment. Also, both my children SETTLED their loans with Navient and are debt free. If there is a class action lawsuit against Navient regarding incorrect 1099-Cs sent to the consumers and the IRS - I would love to join it. Seriously ... Students can apply on-line and get in debt for hundreds and thousands of dollars easy-peasy but Navient can't seem to support the after affect. Why do they continue to get away with this?

Consumer Complaint: I have two consolidated loans with Navient. In XX/XX/2020, my payments will increase. In anticipation of this, I have made multiple requests, both online and over the phone, to allocate my payments so that I can pay down the smaller of my two loans. I got a bonus in XXXX and made a {$2600.00} payment on the smaller loans. And yet, Navient 's system keeps distributing my loans contrary to my wishes, no matter how many times I request or what hoops I jump through, I keep getting the runaround. I find this practice unfair, deceptive, and potentially abusive.

Consumer Complaint: On XXXX, I reached out to Navient because my autopay was taken off of my account without my knowledge. I was told that it was only scheduled for a year even though I did not receive notification it was ending. My payments have been coming out of my account on the XXXX of each month for almost a year. As a result, I was considered to be 9 days late making a payment. I went ahead and made a payment on XXXX which made me current. My first issue that I have is that I have been making timely payments in order to be eligible to release my cosigner from my loan per Navient requirements. Navient requires 12 months of on time payments before being eligible for cosigner release. Since I was in the XXXX month when they stopped my autopay without my knowledge, I do not meet eligibility criteria for cosigner release per their website even though Navient stopped my autopay without my knowledge. Secondly, I spoke with XXXX XXXX on XXXX regarding an administrative forebarence that was placed on my account without my knowledge when I made the payment on XXXX. I did not agree to a forebarence because I was no longer behind on my payment. She stated that it was to help me and I will not have another payment due until XXXX. However, she could not tell me if I will incur interest during this forebarence that I did not agree too or have knowledge of until I checked my account online. I feel deceptive business practices are taking place that is not keeping me as the consumer informed about what is happening with my payments. Furthermore, I am requesting that my cosigner be released due to me not being notified my autopay would stop. I am also requesting what are my rights after your review of the case.

I've called the company MANY and tried many times to lower my loans to an amount that I can afford but Navient refuses it. Consumer Complaint: First had federal loans with Sally Mae then they were purchased by Navient. As of XX/XX/2019 they had me respond yes to postpone repayments. I have not received if they have them or a different lender. On XX/XX/XXXX was informed they were at collections and more than what I knew before. Also derogatory marks on my credit would be nice to be removed. I always am honest and take care of them on time when contacted.

Consumer Complaint: My apologies as the dates aren't clear, but when I first began paying my federal student loans, I was never offered any income-based repayment plans. I was informed of these plans by family and friends, not by my lender. Once I discovered these options, and that my criteria fit them, I signed up. Before this time, I used the only options given to me by my lender : Unemployment deferment, Economic Hardship Deferment, Internship Forbearance, etc. Each one of these options charged a fee in order to enroll. Each one of these options still charged me interest of some kind, and did not offer the same types of benefits as the income-based repayments. My salaries at the time were always provided, including proof of payment, etc. I would have qualified for income-based repayment at any point during these years ( XX/XX/XXXX-XX/XX/XXXX). *Please note that I graduated in XX/XX/XXXX, and my loans went into repayment in XX/XX/XXXX. I am continually denied any information before XX/XX/XXXX, before my loans were consolidated.
