Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: My private student loans are with Navient XXXXolutions. I am in a rate reduction program. I have two scheduled payments through Navient that come out on the XXXX of every single month, one in the amount of {$140.00} and one in the amount of {$63.00}. These payments have being coming out since XX/XX/XXXX via electronic checks that Navient writes to my bank, as if it were from me. My bank which is XXXX XXXX XXXX, receives the checks and processes the request for payment and it usually posts within three days of said request. These payments did NOT come out of my checking account via XXXX for the month of XX/XX/XXXX, however Navient claims the payment has posted, and continues to claim this no matter what I say. I called XXXX and asked them if they missed anything and they said they have no record of any request for payment from Navient. I began calling Navient on XX/XX/XXXX and have spoken to them a total of XXXX times since then, including a call yesterday. At first I had to fight them on getting them to look further into this issue. Finally a nicer more wise representative by the name of XXXX XXXX was able to submit a request into accounting to dig a little deeper. When I had not heard anything for a couple of days after that I called back and could not reach XXXX, so I spoke to a supervisor named XXXX XXXX. I got her on the phone and merged the call with a representative of the office of the CEO of XXXX XXXX XXXX, where XXXX was able to confirm to XXXX at Navient, indeed these payments had not come out of my checking account. XXXX submitted another request and tried to call me back but had to leave a voicemail, where she told me they are still looking into it. I have not heard anything back as of yet to these inquiries. Each time I call Navient I get a different person and I can not get the same person twice. I have to go through the whole story all over again. I have asked Navient to produce check numbers, of the checks THEY WRITE, and they can not provide these numbers. I was told twice, once by a random supervisor they don't actually log those numbers, they put in any number as a placeholder. I don't understand what kind of accounting system this is. All I know is a. my account still shows no payment posted by Navient. b. I'm tired of boing back and forth with Navient and this nonsense. I can not believe I have to fight this company to make sure a payment posted. Obviously they messed up somewhere and I can not get any answers as to why and it's been almost a month. c. I received a letter today that just reiterates the lie they keep telling me that a payment posted, which shows only one of the two payments that posted. d. I'd really like if the IRS audited this company. Something is not right here. This is absolutely unacceptable. I have attached the letter they sent to me today claiming a payment has been made. I have also attached an example of one of the checks they write on my behalf to my bank XXXX.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I have been making on time payments consistently for a few years now. Originally my interest rate on the loan was XXXX, It was originally taken out from Sallie Mae in the XXXX timeframe was {$12000.00}. Unfortunately I wasn't able to pay it for several years I fell within the requirements for the previous settlement save for this mysterious payment that showed up within my 'history ' on XX/XX/XXXX that I never paid, or at the very least I don't remember ever paying. without that payment in there I went 9 months consecutively without paying until I went into bankruptcy. When I got out of bankruptcy, my loan had ballooned to {$30000.00} and now my interest rate was a little over XXXX. I consistently made payments until I needed a small forbearance but when it was over I went back to consistent payments ... my interest rate went down to XXXX. I continued to make payments until I needed to do one more small forbearance and then when I got out I continued to make payments at a higher payment to cover what the forbearance cost me. In XXXX, when I made my first payment, 2 more capitilized interests were added just before making me required to pay back {$30000.00} and from that point on I have made on time payments ranging from $ XXXX to $ XXXX and as of XXXX XXXX of XXXX my loan is now down to {$23000.00}. XX/XX/XXXX, I was sent a letter explaining that a change in my loan terms happened, my interest rate was raise to XXXX and now my payment is XXXX up from the XXXX I was paying. It's as if the further I pay this down the higher my interest rate goes which is mind boggling to me. I snuck in a 'payment ' in my history to get out of erasing this loan and are only making it harder on me to pay by raising the interest rate for no reason. the letter I got from XX/XX/XXXX explained that after I make these new payments until XX/XX/XXXX I will have made $ XXXX which is far more than what I owed originally. Navient 's criminal behavior needs to stop!

Subissue: Trouble with how payments are being handled

Consumer Complaint: Navient keeps sending me bills and charging me late fees during the federal student loan pause that is supposed to last until XXXX of this year. This also happened during the last pause as well. I had to go into forbearance because I had budgeted with the pause in mind and then could not afford to make payments during that time. I believe they are also trying to convince borrowers to refinance in anticipation for loan forgiveness, but that the process would actually make borrowers no longer eligible.

Consumer Complaint: Navient claims to have a Tuition Answer Loan co-signed by my father. The documents Navient has sent me claim the loan was disbursed at the XXXX XXXX XXXX XXXX. I never attended the XXXX XXXX XXXX XXXX. I believe we qualified for the loan, but the loan was canceled on our end at the XXXX XXXX XXXX XXXX student loan office. My documentation for the loan was lost during one of my many moves do to being unable to afford housing. I don't recall accepting this loan and the fact that the loan documentation in the hands of Navient incorrect is beyond concerning. Further, I just filled out my PSLF forms and it noted none of my loans are in an income based repayment plan. This is incorrect, my loans have been in an income based repayment plan for over a decade. Again, this a failure to properly account for and maintain loans. Additionally, I was fraudulently placed and steered into a full forbearance ( not want I wanted or understood ) on my loans during a long period while recovering from a serious XXXX XXXX that almost left me XXXX. I would also like to note that a Navient employee told me that my wife and I shouldn't have had a child during this process. Just absolutely sickening and vile behavior by Navient and its employees. Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I have lived in XXXX since XXXX. I have two student loan servicers : XXXX and Navient. I have complaints about XXXX, but they have been resolved to my liking. It did take several years, though. With Navient, the complaint is similiar to the problem I had with XXXX : since I live in XXXX, and the loan servicer does not accept a foreign checking/routing number, or my debit card here, so paying my monthly payments is a real nuisance. For awhile I would mail a XXXX XXXX draft to Navient, but the mail time was always unpredictable and the payments would often arrive late. Plus, getting the XXXX XXXX draft took up a lot of my time every month and had a fee. In the last couple of years Navient has helped me with a work-around : they do not accept credit card payments ( XXXX does XXXX but only for Americans living abroad, and only at a specific phone number that is NOT toll free... ), but they ( Navient ) will accept ( very specifically ) a prepaid XXXX card. However, in order to make this payment I have to phone Navient, wade through the automated system ( ultimately knowing none of the automated system will help me because I HAVE TO speak to a representative in order to pay this way ), and then more often than not I have to convince the representative that Navient DOES INDEED accept payments in this fashion! More often than not I have to speak to a higher-up so that the payment can be processed, because there is no address addressed to the card. Today I phoned and got to the part where the agent asked for the address. She then put me on hold for about 5 minutes, came back and told me that the department that processes this kind of payment was closed for the day ( I'm in XXXX and it was XXXX for me, she was in the XXXX XXXX I'm assuming the department she was referring to was EST ). That phone call took 25 minutes in total, and I have to phone back tomorrow and do it all over again. I don't see how they make it so incredibly hard for me to pay off my debt. If they want my money, they should make it easy. I can not be the only American citizen with student loans now XXXX XXXX. They should accept my regular credit card, or find a way to let me pay through my XXXX XXXX, or in some other online fashion. It is XXXX.

Subissue: Don't agree with the fees charged

Consumer Complaint: Since the student loan payment suspension has been in effect I have continued to make on-time monthly auto payments to NAVIENT. During this period NAVIENT has continued to charge my account interest on the balance. I have been under the impression that ALL interest was suspended during this period. Email and phone calls have produced nothing if any value to me because I am not interested in consolidation or refinancing at this time. Can this office help resolve this question?

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I am Co-signer on two Private Student Loans that Navient bought from Sallie Mae prior to XXXX. I filed Bankruptcy in XXXX and got discharged approximately XX/XX/XXXX. I started repayment and these loans became part of a Class Action Lawsuit against Navient in which they were put on non-payment status for approximately 2+ years. The Loans were removed from the lawsuit and repayment started up in XX/XX/XXXX with no explanation. I contacted the Michigan Attorney General as Michigan Residents were part of the Class Action lawsuit. I was given XXXX XXXX as the Firm that had oversight and could tell me if I was on the list. I was informed that I was not on the list and after explaining my situation the Rep said I may have been missed and because I wasn't on the list did not mean I do not qualify for complete Loan Forgiveness. I went to www.NavientAGSettlement.com and noticed it spoke of low credit scores as a Qualifier. That was the reason I filed for Bankruptcy in XXXX due to low credit scores and inability to pay debt in which these private loans I Co-signed were part of the Bankruptcy. When the Loans started back up in XXXX I was informed by Navient Customer Service that they did not have any data as to why the loans re-instated and not canceled. I was informed by Michigan AG Office and XXXX XXXX to file a complaint with CFPB to get to the root of this matter as to why the loans were not canceled after reading information on www.Navientclassaction.com which addresses my situation and I do not understand why these loans were not canceled. It appears to me that Navient is selectively choosing who to cancel Loans for based upon some discriminatory criteria and not the criteria stated on their Wedsite. Navient has sent me emails offering to match my payments which I do not understand because this seems to be a compromise becasue the loans should have been canceled.

Subissue: Trouble with how payments are being handled

Consumer Complaint: When my son was in college at XXXX XXXX XXXX I cosigned 3 loans for him totaling {$42000.00} and after making payments for about 13 years the amount owed is {$53000.00} and I am trying to figure out what is going on. These are private loans and the servicer is Navient Solutions LLC and I am doing the math and it doesnt make sense. In addition to owing {$11000.00} after all this time of making payments I discovered something that needs some explanation. We received a letter telling us that there are some changes made to the account, due date etc. the only thing I saw that changed is the interest rate. There are 3 loans and here is my main concern : Loan 1 : {$170.00} ( payment ) - {$150.00} ( interest ) = {$16.00} ( principal ) Loan 2 : {$130.00} ( payment ) - {$110.00} ( interest ) = {$18.00} ( principal ) Loan 3 : {$140.00} ( payment ) - {$130.00} ( interest ) = {$13.00} ( principal ) With a payment of {$450.00}, {$400.00} goes to interest and {$48.00} goes to the principal, when will we ever be able to pay these loans off??? This is why the average person gets frustrated and stop paying their loans because at this rate they will retire and still not be able to pay it off. I am a senior citizen and the cosigner on these loans, this is not fair to anyone. Please can someone explain to me what is happening here. I am sending this information to Navient Solutions LLC, Consumer Financial Protection Bureau and US Department of Education with the hope that someone will help me to make sense out of this mess and give us a path to be able to pay these loans off, it is very frustrating and with all the help that the government is offering, these loans are not eligible for any help.
