Consumer Complaint: I suffered a hardship in XXXX of XXXX. My father passed away, I paid for the funeral and then shortly after I lost the tenant in my apartment. I kept the mortgage company Nationstar aware of what had happened and asked for some understanding. The mortgage was not paid XXXX, XXXX & XXXX of XXXX. In XXXX XXXX I got a new tenant. I immediately sent a payment for XXXX & XXXX and advised them that starting XXXX XXXX I will send the regular payment & and additional {$500.00} a month until the 3 months I originally missed were paid for. Nationstar sent both payments back to me. They said either give them the entire 5 months plus late fees, attorney fees etc or they are starting foreclosure. They said my only option was a loan modification. I asked " what if I am not approved '' the loan specialist on their recorded line said " you will be approved for something I just do n't know what ''. So here we are 11 months later with a tacked on {$5000.00} in attorney fees, I am denied with no other option but to try and borrow {$16000.00} to make this loan current. The denial was because it 's not my primary residence & they will not accept all my income. Even though they asked me to send in my contributor package twice with my husbands income. They denied my application after 11 months stating that the only income they will accept to show all my expenses is the rental income. The big issue here is that they knew from the very beginning that this was a rented property but racked up {$5000.00} in attorney fees and late fees dragging me along when there was absolutely no way I was getting approved for a loan modification. So now my attorney fees, late fees etc. cost more than the original three months I was behind. It would have taken me 6 months to bring the mortgage current yet they intentionally strung me along so they could rack up as much money as possible leaving me no other option. The worst part is that everything else, taxes, 2nd mortgage and HOA fees are all current. The 2nd mortgage company XXXX took the 3 months missed and put it to the back of the loan, they immediately worked with me due to me never missing or sending a late payment in the last 10 years that I have had this mortgage.

Consumer Complaint: I had an insurance claim and Nationstar Mortgage is listed on all of the checks. I had to send the final check for withheld deprecation to them. They have been holding the check for months and they refuse to release it. They tell me something different everytime I call. I was told they would release the funds when the inspection came in at 90 %. The inspection came in at 97 % but they still refuse to release funds. They wanted paid in full receipts for the work and I sent those. They refuse to release my money and they continue to request the same documents over and over again. They are determined to keep my money.

Consumer Complaint: My wife and I refinanced our mortgage with Nationstar in XXXX 2016. I enrolled in automatic payments and paperless statements. Our XX/XX/XXXX payment included an additional charge for {$47.00} for Optional Products and Services. I contacted Nationstar to inquire, I was told the charge was for a home warranty policy with XXXX XXXX XXXX XXXX. XXXX XXXX cancelled the policy after several calls and indicated that the original request for enrollment was received XXXX/XXXX/2016 from Nationstar. Nationstar claims that their only role in the process was to collect the payment and forward to XXXX XXXX. I made a total of 7 phone calls ( 4 - Nationstar, 3 XXXX XXXX ). I asked each company for documentation of authorization of payment from our bank account and both indicated that I would need to request it from the other company. How can a company take money from my bank account without authorization? It sounds like fraudulent activity to me.

Consumer Complaint: Inspired by a recent article which detailed the travails a homeowner was having with Nationstar and the fact that he was seeking help through the CFPB, I wanted to share my experience in case it is not too late to be of use to myself or others. XX/XX/XXXX I was seeking to refinance my mortgage, when my existing mortgage was sold to Nationstar. Despite persistent calls from me they took a couple weeks to provide a loan payoff amount, saying that their system had not received the necessary details of my mortgage. The folks at the credit union I was trying to refinance with affirmed that they had never seen such unresponsiveness. As a result of Nationstar 's delay I lost my initial locked-in mortgage rate, costing me an extra $ XXXX/month for a total of over {$9000.00} over the life of the loan. I also had issues with Nationstar after the refinance, having to place many calls to get explanations ( often confused or contradictory ) for adjustments they made when refunding my escrow funds. Firstly, although I had requested the Payoff Statement as of XXXX XXXX, they sent it good through XXXX XXXX. The law firm handling my refinance sent Nationstar payoff funds appropriate to the date of their receipt of the funds, eliminating the interest for days after the loan was paid off. But when Nationstar refunded the money in my escrow account they deducted hundreds of dollars for interest for the remainder of XX/XX/XXXX ; despite my objections they refused to refund that amount. Second, my initial mortgage had been an FHA loan which had been open two and a half years ( since XXXX XXXX ). I was of the impression that the up-front Mortgage Insurance Payment which I paid when taking out the first mortgage was paid out over the first five years, and so because I was refinancing before the five years had passed I was due a refund of some amount of the up-front MIP payment. As part of the aforementioned calls with Nationstar regarding adjustments they made when refunding my escrow funds, I tried to ascertain whether I was getting this refund. Although they said yes and pointed to a credit of a few hundred dollars, I was a suspicious given that I had been expecting about half of the original up-front payment ( which was {$7000.00} if I recall correctly ). Bottom line, I do n't know if the folks at Nationstar were swindling me or just incompetent, but either way the result was expensive for me.

Consumer Complaint: On or about XXXX I was no longer able to pay my second mortgage due to a loss of income ( father in-law who was on the mortgage passed away then wife became unemployed ) with me becoming delinquent on the first soon after from back to back hardships. The lender of the second mortgage refused to work with me in any way, shape or form such as a loan modification, deferring payments, lowering the interest rate from 7 % to something more modest, etc. During XXXX the lender, NATIONSTAR, charged off the full amount of {$71000.00} and issued me an IRS tax form XXXX " cancellation of debt '' for the XXXX tax year. When reviewing the form I noticed that box # XXXX which explains the reason and or type of cancellation was not filled in. I contacted NATIONSTAR asking for a completely filled in XXXX along with a notice of wether or not the lien was released so I may forward it to the first mortgage company in an effort to save the home. I was told by Nation Star that although the debt was charged off and they received the tax benefit of it and that I had to file it with my taxes where it could have been considered earned income, except for the law that was in place at the time, the debt is still valid and owed by me and they maintain a lien against the property still. Can this be legal and if not who can help me resolve this?
