Subissue: Attempted to collect wrong amount

Consumer Complaint: This is the 2nd notice of dispute of this collection notice. The initial dispute was placed with your office in XX/XX/XXXX with a lady ( I believe her name was XXXX ). I again spoke to XXXX XXXX with the collection company, National Credit Systems approx. XX/XX/XXXX. My conversation with him at the time was not only to dispute the information ( collection notice ) but also requested proof of the debt owed. Instead, another notice of collection was issued a week later on XX/XX/XXXX.

As of this letter, I still have not been provided with the proof of the debt owed to XXXX XXXX XXXX XXXX. I explained to XXXX XXXX, I had 165 pages of documentation providing we didnt owe this debt. How can this debt be placed in collection on a credit bureau without proper proof of the debt as it has been disputed twice with two individuals of National Credit Systems in XX/XX/XXXX and XX/XX/XXXX.

In XX/XX/XXXX, I informed the XXXX XXXX, I didnt lease a property from this apartment complex. There was several discussions with the leasing agent, XXXX and property manager, XXXX XXXX. The lease prepared was not prepared correctly with the terms agreed upon therefore was not finalized. My husband and I met with the XXXX XXXX with the XXXX complex. She apologized and admitted to my husband and I the file was handled both incorrectly and unprofessionally. Agreed to refund {$290.00} and no further obligation was due. An email stating {$290.00} would be refunded. The refund has yet to be processed and received since XX/XX/XXXX. Recently, when my attorney contacted the property manager, XXXX again another credit was issued and an email received. Yet still no refunds have been issued. This case is pending legal action in a court of law in XXXX XXXX XXXX XX/XX/XXXX.

I have requested proof of the debt as previously requested twice. Their notice clearly states if the debt is disputed National Credit Systems will provide proof of the debt. Why have I not received the proof of the prior to placing this file in collection on my credit report? Due to this file being disputed and no proof of the debt has been provided, the entry needs to be removed from credit bureaus. Proof of the removal from the credit bureau until such time proof of the debt is provided and resolved in a court of law should be provided within 7 business days.

The proof of debt and cancellation of reporting can be mailed to XXXX XXXX XXXX, XXXX XXXX, XXXX, LA XXXX.

I have supplied National Credit Systems with a copy of both refund letters from the property manager, XXXX XXXX with The XXXX XXXX XXXX XXXX. I can also provide the CFPB with copies of the same.

XXXX XXXX stated in XX/XX/XXXX, it was our responsibility to provide him with the proof I did n't owe the debt. I tried to explain several times the burden of proof was on the collection agency if it was disputed. As why it was sent to the credit bureaus after communicating with their office in XX/XX/XXXX when the first notice was sent. Ask him to remove the entry until proof was provided and he refused. Called me a liar and was extremely rude. The collection tactics was an attempt to frustrate me.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: I 've sent in certified letters for at least 4 months to get a frivolous statement or letter saying verified. By law it is required to investigate the consumers credit with authorization of the consumer and the credit bureau and creditor must have a signature of mine but theirs no documents shown that and the credit bureau and the creditor falsely agree to verify without and reliable documents. The information is inaccurate and false. I have been suffering a great deal of pain and I am truly XXXX XXXX that an error on my credit report has cost me a great deal of pain and suffering. A measly credit error has ruined my life and the next step is to file a civil suit with XXXX XXXX, XXXX XXXX XXXX and XXXX. Verbal verifications can not verify information or documents, without consent of the consumer their should n't be no verification. Both the creditor and credit bureau had broken several FCRA laws.

Issue: Attempts to collect debt not owed

Subissue: Debt was paid

Consumer Complaint: I served as a guarantor on an apartment lease at XXXX XXXX XXXX in XXXX XXXX, Louisiana. The lease terminated on XX/XX/XXXX. At the conclusion of the lease I personally visited with apartment management to confirm the account was paid in full. This was confirmed by XXXX XXXX XXXX, Assistant Property Manager, prior to move out in XX/XX/XXXX. We never received any further communication from XXXX XXXX or any representatives of XXXX XXXX after that date.

Today, XX/XX/XXXX I received notice from a credit bureau ( XXXX ) that National Credit Systems had flagged an account belonging to me as unpaid in the amount of {$4000.00}. I have never received any communication from National Credit Systems. I contacted them by phone today and they indicated the unpaid account related to the lease agreement at XXXX XXXX XXXX. They further indicated they had turned the account over to XXXX XXXX XXXX XXXX XXXX XXXX XXXX and provided contact information.

I contacted the XXXX firm and spoke with a XXXX XXXX ( spelling? ) who advised me that : 1 ) XXXX XXXX XXXX turned the account over to National Credit Systems in XXXX, XXXX - 9 months after we terminated our lease and were advised no further funds were due ; 2 ) the balance of {$4000.00} was due to a check being returned for insufficient funds ; 3 ) I could " settle the matter '' for 60 % of the debt ; and, importantly 4 ) neither they, nor National Credit Systems, nor XXXX XXXX XXXX are under any obligation to provide me with any information proving my debt. During her repeated attempts to encourage me to " settle '', she indicated that would be the most effective path to remove derogatory remarks from my credit reports, and, absent such a settlement, those derogatory remarks could remain on my reports indefinitely.

I have confirmed that I paid all obligations under the term of the lease as required, and that there was never a check returned for insufficient funds. I have no debt to XXXX XXXX XXXX.

Consumer Complaint: on XX/XX/XXXX National Credit systems responded to my proof of validation letter by sending be a packet and my signature has been forged. I sent a letter back stating that it is my signature is not the signature on the paperwork that they sent me. I also sent proof of my signature via drivers license and other signed documents. NCS ignored my letter. I called them several times to ask who signed my name on the paper and the represent ivies that they transfer to me will start to yell. I Sent another letter asking for validation of the signature and validation of the contract, They sent back they same exact packet that they sent before dated XX/XX/XXXX. This is not my signature and also not a valid contract. A Contract must show valid signatures of the parties to the Contract instrument, in order to verify its validity in law. Contract must be a deliberate and conscious agreement made between competent parties. there is only one signature on this " so called '' contract. Also, the lease expired on XX/XX/XXXX I then went on a month to month lease with the company and worked for rent. This paper that NCS sent me states that the reason that I moved out was because I no longer worked for rent. NCS must prove that I owe XXXX to them or any company that they are representing.

Issue: Took or threatened to take negative or legal action

Subissue: Threatened or suggested your credit would be damaged

Consumer Complaint: I have contact National Credit Systems on several occasions in regards to comments on all XXXX of my credit files that I want removed. After being told several times that someone would call me back I finally spoke with XXXX XXXX at ext XXXX today, XX/XX/XXXX who put her XXXX XXXX XXXX , who identified herself as a supervisor. When I explained to her that I have asked all XXXX credit bureaus to remove the comments " consumer disputes this information '' from my file since I am no longer disputing this debt and they informed me that every time they remove the comments National Credit Systems add the comments back on. XXXX XXXX XXXX informed me that the only way the would remove the comments is if I paid the debt. I told her I was no longer disputing it and want the comments removed, she again repeated that the only way they would remove the comments is if I paid the debt right now and did I have a credit card handy. I told her I was not paying this debt, but am no longer disputing it. That I 'm trying to obtain a mortgage and need the comments removed and since I was the one the initiated the dispute and am no longer disputing it, I am requesting that they stop put the comments back on when I have them removed, she told me that this is n't going to happen, and again the only way they would remove the comments is if I paid this debt in full right no.

Consumer Complaint: In XXXX of 2016 I atttemoted to rent an apartment from XXXX XXXX in XXXX AZ. I walked in the apartment and it did n't seem like anything was wrong. I signed the lease. After this I inspected the apartment while moving in. The apartment was not livable or move in ready. The bathroom tub was not cleaned or restored, the outlets didnot work, the dishwasher was disgusting, the refrigerator did n't work, there was bees, bugs and cocaroaches infested in the apartment. During the first week I called the police 3 times due to the u safe environment. I have XXXX small children who were scared to stay in the apartment. There were people and men outside my window at all hours of the night. During that week maintenance men were in and out of my apartment attempting to fix all the wrongs. I spoke to managment serval times and ask for different apartment and location. They denied me and said they had none avaible. I gave notice I would leave this apartment within the week, which I did. These people placed a debt on my credit report for this lease in the amount of {$3400.00} dollars. I am unable to lease a home due to this. I have disputed this debt in hopes it will be resolved if not I will sue this apartment complex and will be contacting fair housing act and the better business 's bureau.

Consumer Complaint: This has been on my credit for 5 years and to no avail I can not get a copy of my signed lease. I do not owe this money. I did live there but they can not provide me with a signature or any lease to validate if it is mine and the amount is correct. This collection is from XXXX 2012 to present for the amount of XXXX. I do not have an account number. They keep saying I owe this amount which is not correct. I need verification that this is indeed the right amount.

Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: I have attempted to contact the collection agency and the company that is claiming I owe this debt. I have even attempted to resolve this with the credit bureaus. XXXX XXXX XXXX/ XXXX XXXX is claiming that they evicted me from my apartment in XXXX 2013. They even filed an eviction against me and is being reported on XXXX XXXX. I have supplied them with proof ( my lease ) that I was not a resident of this apartment at the time they filed the eviction. I had moved out almost 3 months prior to this. I submitted proof of my notice to vacate, the email response to my notice, a rental and history verification where they acknowledged I turned in my notice. The proof they keep submitting is a auto generated bill statement where they applied charges that were not mine ( the base rent does n't match the base rent included on my signed lease ), including legal fees, and charges for damages. They claim the proof of these damages is a move-out condition sheet which the apartment number/address is missing, the resident 's name is missing, and the lease start date is incorrect. XXXX XXXX did submit my signed lease. A portion of it anyways and the lease does not match their so called supporting documents. This has cause me to loose out on being able to rent elsewhere and damaging to my credit. This has being ongoing trying to get this matter resolved. My next step will be legal actions.
