I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX XXXX XXXX XXXX and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with The XXXX XXXX XXXX, Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C. 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. Finally, you are reporting the INQUIRIES that are the result of the same type of fraudulent activities. It must be noted that I did not apply for credit accounts with the below-listed companies and creditors, some of these are the result of attempts to open accounts, but the companies did not approve the accounts. Therefore, these inquiries must be deleted from within my credit file. You can not delete the fraudulently opened accounts without also deleting the fraudulent inquiries. It should be noted that an inquiry that was not made by me is not a factual record, just as a fraudulently opened account is not a factual record and not referred to the creditor to be disputed directly with them. The credit reporting agencies have attempted to address an inquiry as a factual record of file access, but if it was done through fraudulent means, it is not a factual record. As a consumer, I should not be required to dispute each fraudulent inquiry directly with each company. These inquiries are the result of fraudulent activity and therefore, inaccurate in which the credit reporting agencies or the creditors can not verify, meaning that these inquiries are unverifiable information and must be deleted from my credit files. 1. NATIONAL CREDIT SYST bal. {$260.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. Consumer Complaint: I have contacted XXXX XXXX XXXX ( XXXX ) by mail and through CFPB complaints about this alleged debt that is still reporting on my credit report. I have never made accusations about identity theft but this seems to be the route they want to go. I have asked XXXX to provide validation of this debt which they still not to this day provided. The information attached is provided. They are giving the appearance in their response to me they have provided this information when in fact they have not verified. In there in complaint # XXXX they stated they sent an identify theft verification form. No such verification was provided by XXXX. XXXX is still reporting on my credit report which is considered a collection tactic and a violation of the FDCPA and harming my character which is a violation of the FCRA. So I will ask again because I am prepared to take this to the state AG office to provide the following to the CFPB and myself : How has this debt been verified and certified to be accurate under the FDCPA? Consumer Complaint: I rented an apartment and my lease was up in XXXX I am in the XXXX and was on XXXX orders and submitted all of this in order to move out early. After doing the move-out inspection the leasing lady said I would get letter in the mail along with a copy of the inspection form. I never received it. Once the apartment starting showing on my credit report I disputed it because I was never made aware that I would be charged and wanted proof of everything. I even tried contacting the company to settle it because after 5 years of fighting it I just wanted it removed. They refused the payment. The rep gave me the info on the website of the charges I had and the letter was not sent to my forwarding address but sent back to the address of the apartment I moved out of. Not only are they charging me for ridiculous damages but they also are charging me for 2 months of rent when I should not have been charged at all given I have them my XXXX orders. The account has been deleted from one report because they were unable to verify the account as accurate.

Consumer Complaint: After reviewing my credit profile on XX/XX/XXXX I identified a discrepancy with accounts listed under National Credit Systems. I requested a validation on XX/XX/XXXX as these were accounts that I did not recognize. I reviewed my credit report again on XX/XX/XXXX and the accounts continue to reflect on my credit report and I have not received any correspondence from creditor to validate these accounts as correctly belonging to me nor has any update been made on my credit report to reflect that the accounts are disputed and therefore a 2nd validation letter was sent out on this day. As of XX/XX/XXXX I have not received the requested validation in a timely manner according to the Fair Debt Collections Practices Act and I do not believe the accounts belong to me nor do I believe that the creditor has authorization to access the accounts nor authorization to attempt to collect on the accounts and the accounts continue to negatively affect me. Please strike and remove these accounts from all 3 credit bureaus until adequate validation has been received proving that the accounts belong to me and all information is correct.

Consumer Complaint: My daughter who attended XXXX University in XXXX, NE lost her job due to covid19, was attending college via online classes only and attempted to relinquish the apartment lease she signed for months. Explaining to them that she is unable to maintain the lease and continue to pay the rent when she moved home to XXXX, NE and was not in XXXX for any reason. She paid rent from XXXX until XXXX of XXXX despite not living in the apartment. We communicated to The XXXX XXXX employees numerous times that she needed help to relinquish the apartment/lease. The apartment employees are young adults with no manager available to further communicate my complaints to although I was told the regional XXXX would speak to me, that never happened. We attempted to find another person to move into her apartment and take the lease over. Anyone can sign a lease at The XXXX XXXX, they are not student only housing. We posted the apartment on XXXX 's student housing page and lists, on multiple social media sites. We had a couple of male students that were willing to take the lease over but were told the person had to be female. A leasing agent for the view called my daughter early in XXXX XXXX saying that they were able to find someone to take over her apartment. We drove to XXXX, cleaned the apartment and turned in all of her keys. She has not had access to this apartment since mid XXXX of XXXX. The leasing agent took possession of her keys and did not have us sign anything or take any further action. At this point we thought we had relinquished the lease. The view contacted us a few weeks later stating the applicant did not move in and we were responsible for the rent. This was extremely unprofessional and continued to be stressful to manage. I co-signed for my daughter. The view apartments have had another occupant in her apartment since XXXX. I obtained legal counsel to manage this account but National Credit Systems has reported the collection to the credit bureaus for {$5300.00} despite me disputing this account and amount owed. My daughter is graduating from XXXX on XX/XX/XXXX but the amount owed includes rent through XXXX of XXXX. My legal counsel is XXXX XXXX with XXXXXXXX XXXX XXXXXXXX in XXXX, XXXX XXXX XXXX XXXX. XXXX, NE XXXX. This firm has not had been successful with The XXXX XXXX or National Credit Systems returning requested communication. Furthermore both companies have reported to my credit while I am actively disputing this action. The XXXX XXXX in XXXX, NE is owned by a company out of Florida for which we have had difficulty attaining further information. I have worked tirelessly over the past few years to pay off my debt with the hopes of purchasing a home to now be faced with this collection added to my report. I am not sure what else to do but I will take all legal action to fight this unethical collection. Consumer Complaint: To whom it may concerned : I have been informed that there is a debt collection with balance of {$5900.00} with National Credit System ( NCS ) on both my XXXX and XXXX credit reports. I challenge the accuracy, compliance and reportability of this listing. There has been no validation of any information that I owe any amount of debt. This listing was on my file ever since XXXX XXXX. However, I have not received any notice from NCS about this negative information. Per Fair Reporting Act section 623 ( 7 ) ( A ), " the financial institution shall provide a notice of such furnishing of negative information, in writing, to the customer ''. Also, I mailed a certified Debt Verification letter to NCS on XX/XX/2021 ( USPS tracking number : XXXX ), requesting any contract or agreement that bears my signature to show my consent of payment/debt. After 30-day window, I have not received anything back from NCS that can validate the legitimacy of the above mentioned debt collection. Consumer Complaint: To whom it may concern : I was the Managing Partner and CEO of XXXX, XXXX, a small software company located in XXXX, FL from approximately XX/XX/XXXX until XX/XX/XXXX, at which point the company was closed down due to financial problems. From roughly XXXX until the company 's close I was a minority shareholder and owned approximately 15 % of the company. Before the company was shut down in XX/XX/XXXX, it borrowed approximately {$130000.00} in the Fall of XXXX from XXXX XXXX XXXX XXXX XXXX XXXX, and the servicer, XXXX XXXX XXXX XXXX XXXX located at XXXX XX/XX/XXXX XXXX XXXX, XXXX Fl New York, NY XXXX. This loan was unsecured. It had NO personal guarantees and even had a clause expressly written into the agreement stating exactly that. When the company was shut down there were no assets left to repay this debt. Therefore, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX filed a lawsuit against myself and my father, XXXX XXXX , who was also a company shareholder, in a New York court in an attempt to collect the debt from us personally. We defended ourselves pro se and the case was dismissed ( based on the fact that we had not personally guaranteed the debt and showed proof of that to the court ). This debt has never been determined to be a valid personal debt of ours. However, that did not stop XXXX XXXX from filing a personal debt collection against me with all three of the credit bureaus. This debt has been on my personal credit report as an outstanding and delinquent debt that I personally owe. However, by law, I do not owe this debt personally and I would like it removed from my credit report.
