Consumer Complaint: NOTICE TO OPT OUT OF REPORTING, DISCLOSING AND SHARING CREDIT CARD/ LOAN ACCOUNTS LISTED BELOW TO THIRD PARTY NONAFFILIATED THIRD PARTIES ( XXXX XXXX XXXX XXXX XXXX XXXX ETC XXXX ) To : JP Morgan Chase, Chase Cardmember Services, XXXX, XXXX, XXXX XXXX et al. From : XXXX XXXX Date : XX/XX/XXXX RE : Notice to Opt Out as per 15 USC 6801- 6805 ; 16 CFR 313.7 ; and the Privacy Act of 1974 5 USC 552a This Notice to Opt Out is to inform Chase and nonaffiliated third parties, that I am now and forever exercising my rights as a federally protected consumer to opt out of having my private financial information i.e. Chase credit cards ending in XXXX and XXXX disclosed, reported and shared with XXXX, XXXX and XXXX XXXX et al. Any consent whether verbal, non-verbal, written that Chase, XXXX, XXXX, XXXX XXXX assumed existed never existed. In addition, as a consumer, my rights were intentionally violated by Chase and the nonaffiliated third parties ( XXXX, XXXX, XXXX XXXX et al ) as I was never provided with any conspicuous notice whether in electronic or paper format informing me of the right to opt out of any disclosures. I am also stating for the record that this is not the first time, I have exercised my rights by requesting that Chase and the nonaffiliate third parties cease and desist from reporting my non-public personal information. Therefore, by law the Chase credit card accounts ending in XXXX and XXXX must be immediately removed from the files of the nonaffiliated third parties XXXX, XXXX and XXXX XXXX within 48 business hours. In addition, this correspondence and the prior correspondence will be entered into Court as evidence and used as a basis to seek enforcement, remedy and compensation for damages as I have repeatedly requested that my privacy not be violated by reporting, sharing and disclosing my confidential financial information without my written consent. This notice is also being filed with the Consumer Financial Protection Bureau because as 15 USC 6805 provides : Subject to subtitle B of the Consumer Financial Protection Act of 2010 [ 12 U.S.C. 5511 et seq. ], this subchapter and the regulations prescribed thereunder shall be enforced by the Bureau of Consumer Financial Protection. According to 15 USC 6801 ( a ), a financial institution such as Chase has the continuing obligation to respect the privacy of its consumers and to protect the security and confidentiality of those consumers nonpublic personal information. This clearly did not happen in my case as Chase without my knowledge and consent shared, reported and disclosed my confidential account numbers to various non-affiliates including but not limited to XXXX, XXXX, and XXXX XXXX. According to 15 USC 6802 ( a ) Notice Requirements : a financial institution may not disclose a consumers nonpublic personal information to a nonaffiliated third party unless notice is given. In ( 1 ) ( A ) ( B ) ( C ) : the financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the financial institution clearly and conspicuously discloses to the consumer in writing or in electronic form that the consumer has the right to exercise the nondisclosure option. Chase never provided any notice explaining that I have the right to opt out but as the law provides me with this option I am exercising it anyway. The law in 15 USC 6803 clearly states that I have the right to be notified of my right to opt out at the start of the relationship with the financial institution and not less than annually. Chase never complied with this According to 16 CFR 313.7 ( a ) Form of opt out notice to consumers ; opt out methods. 1 ) Form of opt out notice. If you are required to provide an opt out notice under 313.10 ( a ), you must provide a clear and conspicuous notice to each of your consumers that accurately explains the right to opt out under that section. The notice must state : ( i ) That you disclose or reserve the right to disclose nonpublic personal information about your consumer to a nonaffiliated third party ; ( ii ) That the consumer has the right to opt out of that disclosure; and ( iii ) A reasonable means by which the consumer may exercise the opt out right. Furthermore 16 313.7 ( e ) under Time to comply with opt out states You must comply with a consumer 's opt out direction as soon as reasonably practicable after you receive it and ( f ) Continuing right to opt out. A consumer may exercise the right to opt out at any time. By not complying with the requirement to provide notices of disclosure and the right to opt out, Chase has engaged in Unfair and Deceptive Practices. Chase is thus obligated to comply with my notice to opt out by immediately ( within 48 hours ) removing the accounts ending in XXXX and XXXX from the files of the nonaffiliated third-party agencies XXXX, XXXX and XXXX XXXX XXXX Chase, and these nonaffiliated third parties are civilly liable for conspiring to violate my rights by not informing me of my rights to opt out.

Consumer Complaint: I have had an ongoing issue with JP Morgan Chase Bank, XXXX XXXX, as well as their internal fraud department. On or about XX/XX/XXXX I opened a checking account with chase bank and upon depositing incoming funds, they flagged my account and accused me of fraud. As well as accusatory actions from internal bank branch employees, and the XXXX department they have based out of XXXX and claimed that they would not be opening a chase account due to my " fraud '' history. With that being said, I demanded the legal department information to begin legal action against Chase due to the defamatory accusations and their illicit business practices. I have previously submitted in writing formal affidavits sent to me by customer claims department back in XX/XX/XXXX ; I even followed up with the claims department at which they confirmed receipt of the identity theft affidavit and the customer complaint docs and advised it would take up to XXXX business days for the information to be reviewed. so, from XXXX I managed to file an identity theft claim and open a chase account that was even confirmed by branch agent that those fraud accounts were closed out leaving me eligible for opening a chase account. So, after an exhaustive and insulting debacle in the chase branch, due to their failure to process a deposit payment, and or unfreeze my account. I was then contacted by a XXXX over at the XXXX office she provided me a case number XXXX and phone number XXXX ext. XXXX email XXXX to upload same documents i have previously sent to the fraud dept in XXXX and now we are at XX/XX/XXXX and i have yet to hear anything from the case outcome, nor have i not been able to access the current chase account ending in XXXX ; but they did restrict my online banking ability and froze me out of accessing the information. I feel that this matter needs to be escalated and they need to be sanctioned for their failure to provide adequate and factual information to me as a consumer, the failure to follow up on an XXXX complaint, the defamatory statements made by the fraud department and the overall treatment done to me. this would be the second complaint I submit over this issue, and i have yet to see any resolution. thank you. Consumer Complaint: I had a credit card from Chase Bank and my consumer rights were violated under the Privacy Act. Chase Bank discloses that they do not share customer information with non-affiliated third parties, but they shared account information, my personal information, and transaction history. Per 15 USC 6802 ( b ) 1 ( B ) and ( C ) : B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. I affirm that I was never provided the opportunity to opt out nor was I given any explanation of how to exercise these consumer rights and this has directly disabled my ability to access credit and resources. XX/XX/XXXX deposit released, bank manager verified check with employer. Later on same day restricted account again. Said employee at company stated fraud. Manager verified check for a XXXX time, fraud department still kept restriction. Filed complaints last week of XXXX with CPFb, and FDIC, contacted by executive office from chase who stated employee at company claimed fraud but they had not spoken to the owner of the company. They could not tell me who. Owner stated on XX/XX/XXXX chase has never contacted him except for XX/XX/XXXX during initial verification. If chase is calling the number on the check they are speaking with the receptionist who does not handle any accounting within the company. XXXX closed account. Chase representatives stated I would receive a cashier check, then stated my employer will receive the funds, Representative now states on XX/XX/XXXX neither myself or employer received anything, XX/XX/XXXX that chase will keep funds for a year before releasing funds to the state. Neither myself or employer will receive funds.

On XX/XX/ two days after leaving rehab from my XXXX I discovered what Chase Bank had done and proceeded to contact their executive offices to get this resolved. Chase Bank has since refused to assist me in any way telling me that because the account was closed they can not reopen it or dispute any transactions letting me know that my life savings was stolen from me and that Chase Bank executive offices as well as Chase Bank themselves refuse to assist me in this matter.

Consumer Complaint: I booked a flight for my family- myself, my husband, and our son- through Chase travel portal. I had to cancel my flights due to medical reasons and the airline processed the refund on XXXX XXXX XXXX. Chase then proceeded to refund me but the issue was they only refunded the XXXX and one adult and I'm still waiting for the refund for the second adult. I have been following up with Chase countless times sinceXX/XX/XXXX and all I have been told was a ticket was created and escalated to their accounting team. Each and every time I called Chase their team promised to call me within a certain frequency to update me on the progress but they have failed to do that every single time, which leaves me having to follow up every week, only to be told to wait longer. The latest conversation I had with them was on XXXX XXXX XXXX through which I learned the reason it has taken so long for the refund to be processed was someone on their accounting team made a mistake. Even though the mistake was on Chase 's part, they showed no willingness to help me resolve the issue and get my money back. All they keep repeating to me is wait. They have been holding my money for no reason and refused to release it in a timely manner.
