Consumer Complaint: I am writing to address a persistent issue regarding the account labeled " XXXX XXXX XXXX '' on my credit report, which has been repeatedly deleted and re-reported by Experian. This erroneous reporting is negatively impacting my credit, as the account does not belong to me, and I have not authorized its inclusion on my credit file. I must stress that the continued deletion and re-reporting of this account by Experian is not only inaccurate but also in direct violation of the Fair Credit Reporting Act ( FCRA ), specifically section 609. The FCRA mandates that credit reporting agencies maintain accurate information in consumers ' credit reports. In this case, Experian 's actions are not in alignment with this requirement. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX, Experian and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, Experian, and XXXX ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. The lawsuit will filed due to the utter lack of response from your company. When someone is the victim of identity theft, it is simply a nightmare trying to get false information removed from a credit file. I have contacted all of the false creditors listed on my credit file. I have challenged all of the false listings on my credit file. Nothing ever happens to fix the situation. Over 90 days ago I wrote each the creditors in question and demanded proof that I am their customer. I asked for proof of the alleged debt, including specifically the alleged contract or other instrument bearing my signature. So far none of them has been able to provide such proof to me. I have sent follow-up letters to each of them and there is still no proof. I have attempted phone contact, but I simply get transferred around and nothing ever gets accomplished. I have fully investigated my rights in this matter. Under the doctrine of estoppel by silence, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX I may presume that no proof of the alleged debt, nor therefore any such debt, in fact exists. I have copies of the certified letters and dates prepared to bring to court. Also, under the Fair Credit Reporting Act, these disputed items may not appear on my credit report if they can not be supported by any evidence. Under the Fair Credit Reporting Act, if they can not verify the debt within 30 days, then it must be removed. Your letters to me claim to have " verified '' the debt, but this is in fact not true under law. Simply contacting the alleged creditor and asking them to match up numbers in their database is no sufficient verification for identity theft. Of course the information matches up. Someone clearly used my information without my authorization. Now I am suing XXXX for being such a pain in the posterior to me. I have provided more than sufficient evidence to get these false accounts removed. You XXXX contact me before ( XXXX ) via letter at my address listed at the top of this letter. This matter can be settled simply by your agreement to remove the false information from my credit file. I require a response, on point, in writing, hand signed, and in a timely manner. If I get another pointless letter from you saying that it has already been " verified '' then there will be no more opportunity for negotiation. Consumer Complaint: I am writing to address a matter of non-compliance with the Fair Credit Reporting Act ( FCRA ) Section 609 by Experian. I submitted a complaint to Experian regarding inaccuracies in my credit report, as per FCRA guidelines. According to the FCRA, Experian is legally obligated to respond within 30 days of submission. However, it has now been more than 30 days since my complaint was filed, and I have not received any response from Experian. As per FCRA rules, this failure to respond within the stipulated timeframe warrants the removal of the disputed negative items from my credit report.
