Consumer Complaint: This company has defrauded, coerced and attempt to extort me the consumer.. There are few key violations here, As per IRS PUBLIC 4681 Charge Offs are considered canceled by the irs which means they are taxable income and can not be reported to a credit report as well as Topic 431 of the IRS which are attached below therefore they must be removed off my credit report subject IMMEDIATELY AS IT IS ILLEGAL AND INACCURATE REPORTING against a consumer Not to mention this is a case of identity theft as I do not recognize this account and i submitted a prior identity theft affidavit for the same account whihc was then re-applied to the consumer report this is egregious and gross negligence and a clear violation of my right to privacy as per privacy act of 1974. Consumer Complaint: As a consumer, I assert that XXXX XXXX XXXX ; XXXX XXXX XXXX has consistently violated my right to privacy, as protected by the Privacy Act of 1974. XXXX XXXX XXXX ; XXXX XXXX XXXX, through its various iterations, has reported negative information on my credit report without my authorization, contravening the Fair Credit Reporting Act ( FCRA ), as explicitly outlined in 15 USC 1681 section 602a. This section of the FCRA emphasizes the imperative for consumer reporting agencies to discharge their responsibilities with fairness, impartiality, and due regard for consumer privacy, stating, " There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumer 's right to privacy. '' Pursuant to 15 USC 6801, I, as the consumer, retain the right to ensure that my private information is not disseminated without explicit consent. XXXX XXXX XXXX ; XXXX XXXX XXXX, recognized as a financial institution under the same title, is subject to 15 USC 1681 section 604a section 2, which explicitly states, " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' In this specific case, neither XXXX XXXX XXXX ; XXXX XXXX XXXX nor XXXX, XXXX and Experian, a consumer reporting agency, possesses my written consent to furnish this information, rendering their actions unlawful.I hereby unequivocally revoke any and all consent previously granted to XXXX, XXXX, Experian and XXXX XXXX XXXX ; XXXX XXXX XXXX, whether such consent was verbal, non-verbal, written, implied, or otherwise. Additionally, it is noteworthy that XXXX XXXX XXXX ; XXXX XXXX XXXX and XXXX, XXXX, Experian neglected to apprise me of my right to exercise the nondisclosure option, exacerbating their non-compliance with relevant laws. Furthermore, the inclusion of this adverse item in my credit report by XXXX XXXX XXXX XXXXXXXX runs afoul of 15 USC 1681C ( a ) ( 5 ), which explicitly states, " Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' XXXX, XXXX and Experian, as consumer reporting agencies, are duty-bound to uphold reasonable procedures designed to avoid such violations, as mandated by the requirements delineated in 15 USC 1681b . Additionally, 12 CFR 1016.7 further underscores a consumer 's right to opt out at any time from reporting services. XXXX XXXX XXXX is also reporting on an account that they have already written off and have sent a 1099c to me the consumer, confirming this. This debt is already discharged. They can't collect on a charged-off or discharged account. After all, it is considered taxable income and income can not be reported on a consumer credit report. This account is an adverse item they are reporting again without my permission, which is against the law. Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, XXXX and Experian, is not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. According to the recent notice from your agency, federal court rulings have determined that Delinquent Child Support Payments, Judgements, Liens Fines do not arise from a credit transaction and should not be reported on credit reports. I expect a swift resolution. **Important Notice*** Credit Reports for collection of delinquent child support, judgments, fines and liens may no longer be permitted Federal courts recently have issued rulings about the use of consumer reports for the collection of an account under the Fair Credit Reporting Act ( FCRA ). 1 These cases note that certain definitions were added to the FCRA as part of the 2003 amendments ( FACT Act ). In particular, the word credit was defined. As a result of the new definition the position that is being advocated is that a collection of an account is a permissible purpose to obtain a consumer report only when the collection is in connection with a credit transaction. The courts have specifically rejected prior case law and FTC guidance that a judgment creditor had permissible purpose, noting that those decisions pre-dated the FACT Act. These cases have held that a delinquent child support obligation, municipal fines arising from parking tickets, and a statutory debt resulting from the towing and impound of an illegally parked vehicle did not arise from a credit transaction. As a result, the courts found that collection of those accounts was not a valid permissible purpose to obtain a consumer report. I received an email from the credit bureau stating that they are assuming the disputes are coming from a 3rd party. They in fact did not come from a 3rd party. l even called them to verify it was me and they still refused to process my disputes. I wasted money on mailing my disputes out. I sent personal information to verify my identity through mail, just for them to not thoroughly investigate.
