Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX, Experian and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' The companies listed are financial institutions by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' These companies listed are financial institutions and the Consumer reporting agencies XXXX, Experian and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, Experian, XXXX and these companies whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' These companies Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information : Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' The accounts listed are adverse items they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, Experian and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services for the following accounts and personal nonpublic information : Remove all non-mailable address XXXX has XXXX listed XXXX has 19 listed and experian has XXXX listed the only current mailable address is XXXX XXXX XXXX XXXX, Fl XXXX Remove all phone numbers that no longer belong to me XXXX has 14 listed Remove all employers listed Remove all inquiries per 15 USC 1681 Remove all collection accounts affirm and ccs per USC 1681 and 12 CFR 1016.7 Remove all charge off accounts XXXX XXXX XXXX XXXX XXXX XXXX They are charged off and now considered ( Certificates of Indebtedness ) income which is not allowed to be listed on a credit report. Remove US Dept of ED per The Family Educational Rights and Privacy Act, this reporting violates my rights to privacy per 20 USC 1232 g ( b ). It's also listed inaccurately by each reporting agency. Remove these accounts and info from my consumer report. I am opting out of all of the above being reported on my consumer report per 12 CFR 1016.7 and 15 USC 6805. Remove all transaction history and credit utilization for the two XXXX XXXX XXXX and the XXXX XXXX XXXXXXXX credit card accounts mark them as pays as agreed per 15 USC 1681 ( 2 ) ( A ) ( i ) ". This is effective immediately and indefinitely. These adverse items which are being reported without my permission has not only damaged my right to extend credit but it has made me lose trust and hope in the banking system. I have been denied for credit and loans because of this and my character has not only been defamed but my mental and physical health has suffered greatly. There is no law that says a consumer reporting agency must furnish information about a consumer which is why congress made it very clear that your company assumed this vital role pursuant to 15 USC 1681 ( a ) ( 3 ). Also your company failed to be fair and respect my right to privacy according to 15 USC 1681 ( a ) ( 4 ). I'm requesting valid proof and documentation that these negative items were investigated fairly and properly. Also provide me with the system and details your company uses to determine if transactions took place or not. Your company is in violation of several federal laws including the responsibility you have to protect my privacy. I'm giving your company the opportunity to make this matter right. Included are denial letters and my letters sent to each reporting agency and the furnishing companies.
