I advised Experian that this is my THIRD WRITTEN REQUEST asking to remove or delete unverified inaccurate account listed above. I also notify Experian that I have reach out to the company and provided proof of my conversation that there is no account of the information that's being report which is associated with my personal information.

Consumer Complaint: Family Educational Rights and Privacy Act ( FERPA ) The Family Educational Rights and Privacy Act ( FERPA ) is a federal law enacted in 1974 that protects the privacy of student education records. FERPA applies to any public or private elementary, secondary, or post-secondary school. According to the above mentioned act and more precisely 20 USC 1232g ( b ) I have the right to privacy when it comes to my education records. section 1232g ( 4 ) ( A ) also includes the definition of an education record and what information that entails. It states that directory information only is to be included in these said reports. For example it states ( b ) Release of education records ; parental consent requirement ; exceptions ; compliance with judicial orders and subpoenas ; audit and evaluation of federally-supported education programs ; record-keeping ( 1 ) No funds shall be made available under any applicable program to any educational agency or institution which has a policy or practice of permitting the release of education records ( or personally identifiable information contained therein other than directory information, as defined in paragraph ( 5 ) of subsection ( a ) ) of students without the written consent of their parents to any individual, agency, or organization, other than to the following It then goes on to break down each exception and consumer reporting agency is not listed as one of the acceptable parties. Furthermore the U.S. Dept of Education does not have my written consent to furnish my information and records to Experian. The act in its entirety is uploaded as proof of claim.

In regards 15 USC Code 6802, it states that : a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party ( XXXX XXXX XXXX AND THE BUREAUS MENTIONED ABOVE ARE NOT AFFILIATED ) any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title. ( b ) Opt out ( 1 ) In general A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( They NEVER gave me this information/option ) ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. ( Again, they never gave me that option when the transaction was initially done ). *Also see ; 12 CFR Part 1016 Subpart A* They DID NOT give me full disclosure when the transaction initially took place, which is misleading and fraudulent. I have tried to resolve this issue directly with all 3 of the major credit bureaus and the company. The account in question is a collection account for {$680.00} from XXXX XXXXXXXX XXXX XXXX XX/XX/XXXX I sent the company a certified letter, of which I have enclosed the receipt from the USPS and my credit report as of XX/XX/XXXX. They never responded to my request. I have recently checked my Experian credit report and the same debt is reporting as a Collection account and a Closed Act account. I would like this account deleted permanently from my credit report as soon as possible.
