Consumer Complaint: I am writing to formally request that Equifax, XXXX, XXXX, ( collectively, the ( Consumer Reporting Agencies '' ) cease sharing my personal information with any third parties, including furnishers of information to credit agencies, without my express written consent. Statutory Basis : My request is based on the following provisions of the Fair Credit Reporting Act ( FCRA ) and other applicable regulations : 15 U.S.C. 1681 ( a ) : This section emphasizes the need for credit reporting agencies to handle consumer information with fairness, impartiality, and respect for privacy. 15 U.S.C. 16801 : This section declares the Congressional policy that financial institutions must respect customer privacy and protect the confidentiality of nonpublic personal information. 15 U.S.C. 1681 ( b ) and 1684 ( a ) ( 2 ) : These sections limit the circumstances under which credit reports can be furnished, requiring either written consumer consent or specific legal authorization. 15 U.S.C. 1681c ( a ) ( 5 ) : This section prohibits credit reports from containing certain adverse information, including outdated criminal records. 15 U.S.C. 1681s-2 ( a ) ( 1 ) : This section prohibits furnishers from reporting inaccurate information to credit reporting agencies. 15 U.S.C. 1681 ( e ) : This section requires credit reporting agencies to maintain reasonable procedures to prevent violations of the FCRA. 12 C.F.R. 1016.7 : This regulation allows consumers to opt out of receiving credit reports at any time. Lack of Nondisclosure Option : I was not informed of my right to opt out of having my information shared with furnishers, as required by 15 U.S.C. 16802 ( b ) ( c ). Requested Actions : Therefore, I request that the Credit Reporting Agencies take the following actions immediately : Cease sharing my personal information with any third party, including furnishers of information to credit agencies, without my express written consent. Remove the outdated or inaccurate adverse item from my credit reports. Provide me with information regarding my right to opt out of having my information shared with furnishers in the future. I am enclosing copies of my credit reports and any relevant documentation supporting my claims. Please confirm receipt of this letter and outline the steps you will take to address my concerns. Consumer Complaint: Complaint Regarding Credit Report Inaccuracies Dear CFPB, I am writing to file a complaint regarding inaccurate information on my credit report. I have been actively disputing these inaccuracies with the credit bureaus, but they have failed to adequately investigate my claims or remove the incorrect information. In accordance with the Fair Credit Reporting Act. I attached the PDF file below containing the list of items that have violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. Credit Bureau stated everything was complete and accurate. But how is that possible if the open date, date of last activity and much more is incorrect. According to 15 USC 1681i ( 5 ), they are supposed to modify or delete accounts that aren't reporting correctly. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. I also believe that the credit bureaus have violated the Fair Credit Reporting Act ( FCRA ) by failing to : 1. Investigate my disputes in a timely and reasonable manner : The credit bureaus have not provided a clear explanation for their decision not to remove the inaccurate information, and I believe their investigation was inadequate. 2. Furnish accurate information to creditors : The inaccurate information on my credit report is harming my ability to obtain credit and other financial services. 3. Follow the FCRA 's dispute resolution procedures : The credit bureaus have failed to comply with the timeframes and procedures outlined in the FCRA. I am requesting that the CFPB investigate my complaint and take the following actions : 1. Order the credit bureaus to remove the inaccurate information from my credit report. 2. Require the credit bureaus to provide me with a copy of my updated credit report reflecting the changes. I feel like Im being taken advantage of and my disputes are being ignored. Section 611 ( a ) says failure to investigate within 30 days gives reason to immediately remove those items. I have attempted to resolve this through the Consumer Finance Protection Bureau and to no avail Equifax did not look into the situation, did not address the issue, and told me the standard agent answer. Therefore, I am exercise any and all legal rights by filing a lawsuit against Equifax : Equifax Fair Credit Reporting Act Litigation, No. XXXX. I believe I am a party who was impacted by the code switch and will not proceed with a lawsuit against Equifax and will represent myself as allowed by United States law.
