Issue: Written notification about debt
Subissue: Didn't receive enough information to verify debt
Consumer Complaint: I have been disputing this collection account with XXXX and directly with Midland Credit management for some time. Midland Credit Management intentionally misrepresented information in an effort to harass and inhibit my rights as a consumer by negatively impacting my credit score. To date Midland Credit Management has never provided me with any documentation confirming an account with an alleged last statement date, charge-off date, last payment date, a transaction date, or a judgment date on XX/XX/2020. Per XXXX2 CFR Section 1006.34 ( b ) ( 3 ) Midland Credit Management has violated my consumer rights by reporting a reference date XX/XX/2020 which is outside of compliance parameters of XXXX Section 1006.34 ( b ) ( 3 ). Further FCRA 623 ( a ) ( 5 ) ( A ) requires that the reference date is the month and year the account first becomes delinquent, not when the creditor places the account for collections, charges the account to profit or loss, or takes a similar action. Midland Credit Management is operating outside of FCRA compliance and negatively infringing on my ability to act as a consumer.

Consumer Complaint: Midland Credit Management placed one collection account on my credit report without any prior written communication about this at all. It seems Midland Credit Management purchased this account ( XXXX ) from another creditor in the amount of {$620.00}. I request that you please verify the following... 1. Full original account number. 2. Date original account was opened. 3. Any written agreements between myself and the original creditor stating that this debt is owed. 4. Full account summary on how the charges added up to {$620.00}. 5. Date of first delinquency. If Midland Credit Management is unable to provide the above identifying account information, this information must be deleted from all CRAs. Midland Credit Management also failed to follow FDCPA by not sending a letter giving the consumer time to dispute or validate the alleged debt within the allowed XXXX time frame that is allowed by federal law.

Issue: Communication tactics
Subissue: You told them to stop contacting you, but they keep trying
Consumer Complaint: Midland Credit Management is a company, that I have never done business with, but allegedly purchased old debt which is beyond the statute of limitations. I received a call from Midland Credit Management in XXXX, XXXX, I refused to speak to the representative and disconnected the call. On XX/XX/2021, I contacted Midland Credit to obtain their fax number to submit a cease and desist letter without discussing anything pertaining to any accounts. I received a letter dated XX/XX/2021, stating that they have opened an investigation regarding your recent dispute. However, I have never disputed, or requested an investigation. I believe that this is an act of fraud, and harassment as I sent this company a cease and desist for all forms of communication.

Consumer Complaint: As soon as i missed one payment from XXXXXXXX XXXX they started calling me and harassing me. They will call every single day 3-6 times a day. I have blocked so many numbers. It either comes up as XXXXXXXX XXXX Or Midland Credit or they will use a local number thinking ill answer. I have blocked a ton of their numbers they still find a way to harass me. I have answered telling them to stop calling me and leave me alone they hung up and still call. They will not leave me alone. This is absurd i have way more documents showing how often they call. Its ridiculous. There is no reason to call someone so much.

Consumer Complaint: My name is XXXX XXXX XXXX, and I am sending this request myself to address the inaccuracies on my Credit Reports and time has already passed but up until now, I havent heard any kind of response from XXXX and XXXX credit bureaus which made me decide to seek assistance from you. They have shown negligence and an act of refusal of complying with my request regarding MIDLAND FUND ( Original Creditor : XXXX XXXX XXXX XXXX ) with the account number XXXX. I know for a fact that they are to comply with the Fair Credit Reporting Act law, to provide proof, documents, and give definite and accurate responses, within the given statutory time. I've already reached out to both the Bureaus and collection agency. However, they failed to do so, they are obliged to remove this item which is erroneous and unverified. Their unfavorable and unacceptable actions have been hurting my credit scores immensely. Please investigate and remove this MIDLAND FUND ( Original Creditor : XXXX XXXX XXXX XXXX ) from my account. This is causing my scores to drop.
