Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: I, XXXX XXXX, a federally protected consumer, debtor, and holder in due course pursuant to UCC 3-306, I am asserting my right to acquire documentary evidence in accordance with 15 U.S.C. 44 for the books of account as defined in IRS Publication 583. Be advised this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g stating your claim is disputed and validation is requested. This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION made pursuant to the above-named Title and Section. I respectfully request your offices provide me with competent evidence that I have any legal obligation to pay you. I will need this documentary evidence to insure that your office isnt using unlawful extortionate means, as defined by 18 U.S. Code 891, with forethought and malice to bring harm to me and my financial reputation by making any false claims of securities, causing a tax liability. This documentation showing my legal obligation to pay you would insure me that there isnt any unlawful theft by deception, bank fraud, and creation of the false and deceptive form is in the act of taking place to a federally protected consumer, beneficiary, debtor, and holder in due course pursuant to UCC 3-306. At this time, I will also inform you that if your offices have reported invalidated information to any of the 3 major credit reporting agencies ( XXXX, XXXX, or XXXX ) this action may constitute fraud under both Federal and State Laws. If your offices can provide the proper documentation as requested in the following Declaration, I will require at least 30 days to investigate this information, during which time all collection activity must cease and desist. Also, during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will not hesitate in bringing legal action against you and your client. This includes any listing of any information to a credit reporting repository that could be inaccurate or invalidated. If your office fails to respond to this validation request within 30 days from the date of your receipt, all references to these accounts must be deleted and completely removed from my credit file, if applicable, and a copy of such deletion request shall be sent to me immediately.

Consumer Complaint: This is a copy of my email that was sent to XXXX XXXX XXXX XXXX, XXXX My name is XXXX XXXX XXXX. I live at XXXX XXXX XXXX XXXX, XXXX, XXXX XXXX. I check my credit score occasionally and the last time I checked it I had two ( 2 ) derogatory remarks due to a Collection/Chargeoffs. At the time all of the information I had was the name of the collection agency. I contacted them. They told me that my name, Social Security Number and date of birth matched the information on file for whomever used my identity to obtain electricity in the State of XXXX. I have never lived in XXXX. I was told they would note it on their account but I would need to contact the local police and file a report and then go to the identity theft website and complete the necessary information. I did go to the police but because I live in the county I would have to contact the Sheriff 's Department to file the report. I had officer XXXX XXXX of the XXXX XXXX County Sheriff 's Department come out to my home. After explaining and requesting a report he advised that because this involves two state ( XXXX XXXX XXXX ) I would need to go to the website XXXX and proceed to filling out the Fraud Complaint online. This week I received a collection letter from Convergent Outsourcing , Inc. demanding {$700.00} which was 80 % of the full amount of {$870.00}. I contacted them and relayed this same information. The gentleman told me I may also need to complete a fraudulent packet with XXXX XXXX XXXX XXXX, XXXX. Obviously this is very frustrating that as the victim of this activity I am having to go to such lengths to clear my name because of another 's incredulous acts and over {$800.00} at that. Please advise. Thank you. XXXX XXXX XXXX ( XXXX ) XXXX XXXX XXXX

Consumer Complaint: I contacted Convergent debt collection last year to notify them that this is not my account. They asked me to send a copy of my social security card and other personal identifying information that I am not comfortable sending in order for them to locate whomever debt this belongs to ( or in the case this was identity theft ). I already dealt with this issue through previous debt collection agencies as well as filed other complaints through the cfpb website regarding this same debt. Now they are sending me a letter with an amount owed in excess of XXXX dollars. I do not owe this debt and I would like them to stop contacting me.
