Consumer Complaint: I reported fraud on my credit card issued by capitol one. First the call is outsourced and I had trouble understanding the persons English. They were not very well informed about fraud and how it was handled by capitol one. As of yet I have not received a new card or a credit. They say they only give a temporary credit until investigation. It is legitimate fraud. I caught it on my online. The charge is on my overall balance. Capitol one has been unhelpful. Unappreciative of my many years of patronage. I even have a large saving account with them. I have over 800 credit score. I feel violated by someone charging on my card. Capitol one shows no concern for me. Tardy service and all the way around bad business practice.

Consumer Complaint: XX/XX/XXXX I entered a payment of {$130.00} to my XXXX credit card ( handled by XXXX Bank ) through my Capital One checking ( XXXX ) bill pay service. The payment was sent electronically, funds withdrawn on XX/XX/XXXX and processed on XX/XX/XXXX. XX/XX/XXXX I received a XXXX credit card statement showing no payment was made. I took a screen shot of the bill pay confirmation and sent it to XXXX on their website portal. XXXX responded that they would look into it. XX/XX/XXXX I received another XXXX credit card statement showing no payment and more late fees added. I realized the account number on my billpay and on my XXXX account did not match. I had received a new card in XXXX and did not realize the account number also changed. I called XXXXXXXX and the rep told me that in the investigation they would find my account with the old account number and it would be reconciled. XX/XX/XXXX I received a request from XXXXXXXX to ask my bank to trace the payment and provide them with the electronic transmittal inquiry form, which I did. XX/XX/XXXX Capital One card investigations emailed me the proof of payment including the electronic payment trace number. They also included in the email that the payment was accepted by XXXX and not rejected. I sent the email and proof of payment form to XXXX XX/XX/XXXX XXXX sent a letter saying they were unable to verify their bank received the funds for the paymnet and for me to contact Capital One. I contacted Capital One and they so the proof of payment is evidence that the money was sent so there was nothing more they can do. XX/XX/XXXX I filed a complaint with CFPB against XXXX Bank for not recording my payment. XX/XX/XXXX XXXX bank mailed a letter saying the mailing address on the billpay was incorrect. I called Capital One regarding this address error and they confirmed since the payment was sent electronically the mailing address was not used and did not affect the transfer of funds. I asked that they put this in writing, but they said they were not able to do that. They said the money was sent to XXXX and XXXX did receive it and keep it and that was confirmed in their investigation. I have since filed complaints against XXXX with CFPB ( again, this time noting the incorrect physical address did not affect the electronic transfer to them ), the XXXX Attorney General 's office, and the FDIC. XXXX only responds with " our decision remains unchanged ''. I have banked with Capital One for years and have never had any issues, but I don't know who to believe in this situation. I tried to rectify my errors, but the address error Capital One told me didn't matter and the account number error XXXX told me didn't matter. The funds were taken from my account, but since then there is no record of them. I don't know how an electronic transfer trace isn't enough evidence, but this makes me question using Capital One or any bank because a vendor can just say they never received it. XXXX now has my balance at {$130.00} + fees totally well over {$400.00} and my credit score has dropped due to this banking error.

They investigated and came to the conclusion that the account would be deleted as well as the inquiry that account made. When i called all the bureaus they stated that they dont have that information and the cap1 is still reporting. The account must be removed now because it does not belong to me. PER 15 USC 1681 B YOU ALL ARE BREAKING THE LAW. I DID NOT AUTHORIZE YOU ALL TO FURNISH THIS WRONG INFORMATION THEREFORE IT MUST BE TAKEN DOWN ASAP!

Consumer Complaint: I received a targeted email from Capital One in XX/XX/XXXX inviting me to apply for the Quicksilver credit card ( a card I previously had but was closed due to inactivity ). I applied on XX/XX/XXXX, and surprisingly, was immediately declined even though my credit score, based on Capital One 's XXXX tool, was XXXX or " Excellent. '' As I monitored for the adverse action notice, I continued to receive similar advertisements targeted to me about the special Quicksilver card offer. Upon reviewing the adverse action notice, I felt deceived as Capital One 's XXXX indicated I had excellent credit. I was planning to file a complaint at that time but time slipped away. Fast forward to XX/XX/XXXX. I received a similar advertisement via email indicating that my " loyalty hasn't gone unnoticed, '' inviting me to once again apply for the XXXX card. I applied again on XX/XX/XXXX, and was immediately declined. The adverse action notice I later received ( dated XX/XX/XXXX ) indicated my application wasn't approved based on the " number of bank cards tradelines opened in the last 24 months '' and that " there are too many revolving accounts. '' This is concerning as the advertisement was targeted to me even though Capital One 's XXXX tool already outlined the number of new accounts I had opened within the last 24 months as well as the available credit across all accounts. Furthermore, based on Capital One 's XXXX tool, my score actually declined since previously applying in XX/XX/XXXX ( to XXXX ). Although Capital One 's advertisement indicates within the " Frequently Asked Questions '' section that " your XXXX credit score will not factor into the decision to approve or deny your application, '' it is a misleading tool. It is like Capital One saying we are going to create this tool to help you manage your credit score, but we aren't going to stand behind it.

On XX/XX/XXXX I uploaded the necessary documents to Capital One as instructed to have my last name changed from XXXX to XXXX as I recently got married. A few days after I started getting emails from Capital One addressed to XXXX, I then used my credit card, and my transactions are listed as XXXX XXXX. Basically, a simple name change has turned my bank and credit card accounts into a disaster as my entire name has been changed to XXXX XXXX!!!!! Where do you get a last name change from XXXX to XXXX translated to XXXX XXXX? I called customer service for assistance and was basically advised they were submitting a request to have this rectified and to allow XXXX days, nothing is being rectified and I live XXXX hours away from the nearest branch. A simple mistake such as this can have detrimental effects on my credit, accounts, as well as my identity and your Customer Service teams have no urgency to get it rectified. It's been a week and still has not been rectified. I have spent hours on the phone being passed off from one agent to another.

Consumer Complaint: The Fair Credit Reporting Act ( 15 U.S. Code 1681 ) says ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. So whenever there is a violation under the FCRA, it impairs the efficiency of the banking system. This is a violation of my privacy with my consumer report, since I control what is listed and what is not. In the event that any accounts are reported without my written consent, that is considered identity theft. This is a violation of both 15 U.S. Code 1681b ( 2 ) and 15 U.S. Code 1681c-2. This leads way to civil liability against the credit reporting agency for negligent and willful noncompliance under 15 U.S. Code 1681n, which allows for {$1000.00} per violation, for account listed without my expressed written consent.

I have remarred over XXXX XXXX years ago and my name has changed. The charges totaled over {$540.00} and I have since learned upon calling Capital One that the bill is over {$800.00}. I was out of town when this card was issued ; therefore, I couldn't have opened this account. The purchases were made at Walmart supercenter # XXXX in XXXX XXXX, Id. and XXXX which is cable company. I received a letter from XXXX who works with the Idaho Department of Health and Welfare stating that they had a Data Breach and my data could have been stolen. At the time I was on Health and Welfare with Idaho my last name was different than it is today. That was over 13 years ago.
