Consumer Complaint: XX/XX/2023 : I made a call to Capital One on XX/XX/, in which I inquired about the restriction placed on my account and the subsequent adverse impact on my credit score. During the call I expressed my concern about the restriction placed on my Capital One account. First they stated it was a fraud alert on the account that I was 1 never made aware of and two I never had anything fraudulent occur during the time these accounts have been open. The representative acknowledged that there had been an issue and clarified that my account I was using to make payments was classified as a non-transactional account, which may have contributed to the confusion. Despite the account being in good standing historically, the representative mentioned that they would not be able to reopen the account due to it not being in good standing today. While I understand the classification of my account, I would like to emphasize that my intention has always been to maintain my account in good standing and promptly address any outstanding balances. The late payment was an unfortunate result of an external factor, and I sincerely apologize for any inconvenience it may have caused. Maintaining a positive credit history is of utmost importance to me, and I believe that reopening the account would help me continue to do so.

It is required under the FCRA to have properly verified the accuracy of an account listed on my credit report. In the results of your first re-investigation, you stated in writing that you verified that these items are being reported correctly. Where are the documents that you used to verify these accounts? What is the name of the person in your company who verified these accounts? What documents did they use to verify them? Please provide me with the name of that individual, their business address, and telephone number. XXXX XXXX XXXX, XXXX XXXX, XXXX, defines Verify as, 1 ) " To prove to be true ; to confirm or establish the truth or truthfulness of ; to authenticate. '' 2 ) To confirm or substantiate by oath or affidavit ; to swear to the truth of. '' and Verification as, Confirmation of correctness, truth or authenticity, by affidavit, oath, or deposition. Affidavit of truth of a matter stated and object of verification is to assure good faith in averments or statements of a party. The company was not willing and able to produce any documentation that proves the account ( s ) in dispute belong to me and the information being reported is accurate and you must be able to do this in a court of law if I file a lawsuit against you. Nor did someone within your company provided authenticated documents in your files that were used to verify the disputed accounts and to do this they must have 1st hand knowledge of the alleged account ( s ) and all that has ever transpired for the alleged account ( s ), under oath and under the penalty of perjury. As I am sure that you are well aware, current Federal case law states that, Consumer Reporting Agencies bear grave responsibilities to ensure the accuracy of the accounts they report on and their responsibility must consist of something more than merely parroting information received from other sources. The Courts have also ordered that a Reinvestigation that merely shifts the burden back to the consumer and the credit grantor can not fulfill the obligations imposed by 1681 ( a ) ( 4 ). XXXX and XXXX are consumer reporting agencies and I'm the consumer.my right to make sure my private information isn't shared is backed by 15 usc 6801. That says it's policy of Congress that each financial institution has a affirmative and continuing obligation to respect the privacy of the consumers and to protect the security and confidntuality of those consumers Private information .furnisher of information to credit agencies is a financial institution by definition under title 15 usc 1681section 604 a section that says in general subject to subsection ( c ) any consumer reporting agency may furnish a report under the following circumstances and no other. In accordance with the written instructions of the consumer to who it relates ( furnisher of information to credit agencies ) the financial institution and the consumer reporting agencies XXXX and XXXX don't have my consent to furnish this information, nor do they have my written consent .any and all consent to XXXX and XXXX ( furnisher of information to credit agencies ) whether it be verbal or non verbal written, implied or otherwise revoked.15usc6802 ( b ) ( c ) says that a finance institution may not disclose non public personal information to a non affiliated 3rd party unless the consumer is given a explanation on how the consumer can exercise that non disclosure option. ( furnisher of information to credit agencies ) never informed me of my right to use my non disclosure option not only that,15 usc1681 ( a ) ( 5 ) says except as authorized under subsection ( b ) no consumer reporting agency may make any consumer report containing any of the following items of information other than records of conviction of crimes which antedates the report more than 7yrs. This account is an adverse item they are reporting again without my permission which is against the law. 15 usc 1681s-2 ( A ) ( 1 ) A, says a person shall not furnish any information relating to any cosumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 usc 1681e says every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishings of consumer reports to the purposes listed listed under 1681b of this titleXXXX and XXXX are not maintaining reasonable procedures designed to avoid violations of section 1681c of this titleXXXX and XXXX are not maintaining reasonable procedures. 12CFR 1016.7 SAYS that a consumer may exercise the right to opt out at anytime. Consumer Complaint: On Saturday, XX/XX/2023 I deposited check with amount of {$2200.00} through the ATM in Capital One XXXX to my checking account in this financial institution. Normally money available fully ( if deposited through a cashier ) or partially ( if online ) but only if you deal with a decent bank. In case of Capital One these cheaters do not provide cashier service and instead of expedited on-line services they simply delay operations taking advantage of saving their business expenses in both online and offline cases for the cost of customers ' convenience. The check has come from well known job-related settlement of the Doe v. XXXX , Inc. lawsuit . The check obviously is legitimate and covered by XXXX and Settlement Administration so there is no doubt it would be paid. Capital One had enough time during long weekend to make sure the check is fine but instead on XX/XX/XXXX these clowns sent me email claiming " there's an increased risk that the deposit may return based on confidential information that indicates the check may not be paid '' and availability of funds delayed. Really? Tell XXXX about these clowns ' opinion, what would they say. Besides such a statement was quiet offensive, the delay is totally unreasonable and inappropriate for me since I relied on those funds to make my car fixed and Capital One caused lost wages since I use my car for driving XXXX and soonest repair was essential. Furthermore Capital One placed restriction on my checking account claiming account was overdrawn. While the {$95.00} overdraft of an account is still not a solid reason ( it was not a first time account overdrawn and was always covered without any problem ) for placing any restriction on it, by the time they made such a decision they already had my legitimate check deposited and it was more than enough to cover the overdraft so decision they made was illegal. Now they are going to close my checking account ( without a good reason ) and my remaining funds would be paid by transfer to external account which cause additional delay of availability of my money for approximately one another week, which also has no good reason at all.

Consumer Complaint: To Capital one 360 Investigation numbers XXXX AND XXXX I'm very upset that my claims were denied. I was trying to get XXXX on my tv and called what I thought was XXXX. The guy who called me XXXX XXXX had me do all this stuff on my phone and sure enough he got XXXX on my tv. The charge was XXXX. He was polite and respectful. Than he had me go to XXXX and type in XXXX. I questioned this but he said they had to verify my account. At this point I trusted him cause he got my tv working. Than he had me go to XXXX and put in another XXXX. I was getting very suspicious at this point and he said XXXX XXXXXXXX we have to put the money back in your account. Once that was done he hung up on me. I tried calling back several times no answer. This man was a scammer who took advantage of a XXXX XXXX XXXX woman on SS. I am very very upset. Im not on top of technology and never never agreed to this. There are XXXX XXXX charges to a guy XXXX. If I dont get money back for this I will never use capital one again and I will go a step further. I trusted capital one. I have credit cards with you than decided to open a checking account.
