Consumer Complaint: 1. XXXX I deposited a personal check for {$9500.00} in my Capital One 360 Checking Account via a Mobile Check deposit. 2. The Check I deposited into my Checking account was drawn on a Capital One Checking Account. 3. XXXX I received a notice from Capital One that stated the funds from the check the I deposited would be held until XX/XX/. 4. XXXX I reviewed Capital One 's policy concerning the availability of funds from the deposit of a check drawn on a Capital One Account into another Capital One Account. The website said the funds would be available the next business day. 5. XXXX I spoke with several customer service reps at Capital One in an effort to resolve this matter. 6. All of the reps refused to verify the funds from the Check I deposited, even though it was drawn on an account from the same bank. 7. The Check that I deposited was written by my sister who also banks at Capital One. The money for the check was removed from her Capital One 360 Checking account on XXXX 8. My sister was present during my phone calls with Capital One. She explained that the {$9500.00} was removed from her account. There was no reason to hold the money. The funds were verified. 9. Several calls to different account managers failed to provide me an answer as to why Capital One was holding my funds. Funds they could verify. Funds they knew were available. 10. I was told by several reps that they could not tell me why my check was being held because it was private information.

Consumer Complaint: I opened my Checking account with Capital One in XXXX. It has had about {$200.00} in the account since XXXX and no fees have been charged to the account. In XX/XX/XXXXXXXX XXXX XXXX XXXX XXXXXX/XX/XXXX, I was charged {$8.00} fees on my account. I was never charged fees before or after this point. I called Capital One to ask them why these fees were charged and they said it was a maintenance charge because my balance was below {$300.00}. I asked them why these fees had never been charged before or since and the agent told me Capital One had the right to charge these fees and would not waive them. I would not have kept this account open if I new it was accruing fees- I have XXXX XXXX saved with Capital One in no fee accounts and I was never charged a fee on this account since I opened it until 5 years later.

Consumer Complaint: I recently found out that I was a XXXX XXXX for a Capital One settlement due to a XXXX Data Breach. I called the capital One Settlement department and was told I was a XXXX XXXX that could have received benefits, but because I did not respond to the claim in 30 days, I lost my opportunity. An agent told me that an email was sent out to me about the settlement in XXXX of XXXX, but she also said the email was automatically deleted after 30 days. Meaning, Capital One purposely sent the email to my Spam folder so that I would not know that I was an eligible XXXX XXXX for the settlement. Others have received {$700.00} as a result of the settlement, but others like me are out of luck as the final deadline to submit for the claim was XX/XX/XXXX.

Consumer Complaint: In XXXX, I opened a high yielding savings account with ING Direct. In XXXX, Capital One purchased my account through a merger and renamed my account a " Capital One 360 Savings Account. '' At the time, Capitol One XXXX XXXX XXXX sent me a letter that pledged : " our commitment to you is staying the same. '' He specifically promised that after the merger Capital One would still be offering " great features and rates that we know are important to you. '' Over time and following market conditions, Capital One gradually lowered the interest rate on my 360 savings account until it reach a low of .3 % in XX/XX/XXXX. But as market conditions changed over the past 3 years and interest rates rose, Capital One never raised the APR on my account. Instead, around the same time they froze my variable interest rate at its lowest point, they created a new savings product with a higher APR and deceptively similar name : " Capital One 360 Performance Saving. '' They did not notify existing customers about this new savings product and made sure there was no mention of it in the App, which all existing customers are encouraged to use. Locking in existing 360 customers at a .3 % APR when market conditions have changed drastically and interest rates have risen precipitously while creating a new product with a deceptively similar name that pays a much higher APR is a far cry from keeping its promise to former ING Direct customers. I have filed 2 previous CFPB complaints about this issue and am completely dissatisfied with Capital One 's response through their representative, XXXX. They have been stealing from customers by not paying them the interest they are owed and in the process will destroy Capital One 's good will and reputation for customer service. I just found out today that a lawsuit was filed against Capital One regarding this issue. I'm looking forward to seeing what a jury thinks of their fraudulent and deceptive practices.

Consumer Complaint: Kohl 's Department Store/Capone Collections Subject : Cease and Desist Unauthorized Debt Collection Activities Dear Sir/M, I am writing this letter to formally demand that you immediately cease and desist all debt activities pertaining to this account with Kohl 's Department Store/Capone Collections. It has come to my attention that you have been engaging in unauthorized and unfair practices, which amount to a violation of my rights under the Fair Debt Collection Practices Act ( FDCPA ). Firstly, I dispute the existence and validity of the alleged debt you are attempting to collect. I have not entered into any contractual agreement with your company. Furthermore, your collection tactics have been persistently harassing and intimidating, which is unacceptable and unlawful. I have received numerous phone calls and letters from your company, often containing false and misleading information designed to pressure me into paying a debt I do not owe.
