Issue: Getting a credit card
Subissue: Delay in processing application
Consumer Complaint: I received a letter from Comenity Capital Bank, regarding me to finish processing my XXXX XXXX credit card application. I called the XXXX number on the letter, which connected me to a female representative with the Account Protection Team. At no time did the representative mention that the conversation was being recorded, which was unusual for a member of a loss/fraud department. I explained that I did not open a credit card application and wanted to know how, where and when the application was opened? I was told she wouldn't be able to until I provided her with so information. The representative asked for the number below the date on the letter, which I provided. Next, she asked that I verify my first and last name, along with my address which I did. Next she asked for my DOB and SS number. I asked why and she indicated that she needed it to verify my information. When I refused, she provided me with an XXXX number to an unspecified credit bureau and disconnected. Prior to receiving my letter, I received no credit alerts from any bureaus.

Issue: Charged fees or interest you didn't expect
Subissue:
Consumer Complaint: I filed a previous complaint # XXXX ... ..against Comenity Capital Bank, XXXX XXXX XXXX, XXXX Ohio XXXX. I was offered financing from my dentist to pay for a procedure. The dental office told me I could make monthly payments when I was approved ... .no one explained that there would be late fees if I did not pay by the XXXX every month. I called Comenity and told them due to my pay schedule I could not pay the XXXX and asked if they could make it a later date in the month. They refused to it. I have made similar arrangements with other creditors. Every month I make my payment and every month they charge me a {$41.00} late fee. Why do I have to pay this fee which was never disclosed to me when i signed up? I have never missed a payment. They responded to my original complaint by crediting me {$50.00} only to charge {$41.00} again on my most recent bill. They are stealing from me and I refuse to pay anymore. Why are they allowed to bully their customers and steal funds through this ridiculous policy. As I said, I have never missed a payment so why do I have to pay {$41.00} extra every month. I need the CFPB to stand up for me!! My account number ends XXXX.

Issue: Communication tactics
Subissue: Frequent or repeated calls
Consumer Complaint: This company has been acting as a debt collector, and did not disclose to me that they in fact are a debt collector when calling. They have repeatedly texted and called from different numbers and never disclosed that they were a debt collector when calling. They assumed it was conveient for them to call me before " XXXX ''. When it is in fact not convenient at all to receive calls or texts throughout the day. This is their official notice to cease and desist all communication with me, otherwise by the CFPB website, or by mail.

Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Problem with personal statement of dispute
Consumer Complaint: I had excellent payment history with Comenity Bank : XXXX ( XXXX XXXX ) Account XXXX for years, until I got sick XXXX XXXX and wasn't able to make a payment on time. My husband called the compnay on my behalf and reached an agreement with them on a recorded line, where he put in a promise to pay at a later date and they agreed to record that promise to pay in the account and not issue any late fees or negative reporting to the credit bureau. I did call and not only did I pay the amount due, but the entire remaining balance, however negative reporting went into my credit report despite the recorded agreement in place. I tried disputing with them directly and received a letter simply denying. They never even went through the trouble of looking up my account. I then submitted a separate dispute through XXXX and still nothing was resolved. They refuse to hold their end of the agreement even though I held mine. They should be held accountable for any notifications and promises they make in exchange of payment to customers over the phone on recorded lines. Is simply insulting to dismiss any arrangement or out of our control circumstances like XXXX. I would like the negative reporting to the credit bureau to be removed completely from my file.

Issue: Fees or interest
Subissue: Problem with fees
Consumer Complaint: This is a complaint with the Comenity Capital Bank, which services my XXXX credit card. On XX/XX/2021 I received a bill of {$33.00}. It was paid on that date, so it was not paid late. I paid the bill electronically through my account at XXXX XXXX. The following month I was notified that the bill was unpaid and had a late fee added to it. I contacted XXXX XXXX and received a document showing that XXXX XXXX had removed the money from my account. They then sent a check to Comenity Bank. I sent proof of this transaction to Comenity Bank, but they were unsatisfied. They requested a copy of the check that was sent by XXXX XXXX. XXXX XXXX did a skip tracing on the check and discovered that it was never cashed. They credited my account for {$33.00} and I sent a personal check to XXXX for that amount, which they received. At the present time Comenity Bank is charging me {$64.00} in late fees. I made the initial payment on time. XXXX XXXX sent the payment in. The payment was either lost in the mail or at Comeninty Bank. We will never know as the check was never found. I would like these late fees erased.
