Issue: Opening an account
Subissue: Account opened as a result of fraud
Consumer Complaint: Timing might be a little off for first incident because I originally deleted emails assuming they were a phishing attempt, and account closures were done over the phone. XX/XX/XXXX - Account fraudulently opened in my name at Bank of America - assumed spam/phishing attempt and ignored XX/XX/XXXX - statements from BoA start arriving at my house, first attempt at closing of fraudulent account XX/XX/XXXX - still received statements, account not closed XX/XX/XXXX - XXXX time to attempt fraud report. This time seems to work. Send BoA a very extensive amount of sensitive personal data as requested to their fraud department. XXXX XXXX - Receive confirmation that they finally believe me and closed the fraudulent account closure. XX/XX/XXXX, XXXX XXXX - Received emails that my new BoA account has been approved. I did not open this account. XXXX time -> I'm going straight to the feds.

Consumer Complaint: As a previous claim was made, and closed by the Bank of America, I specifically asked them to reopen my claim. There is a fraudulent tool that calls people using the id of any institution, and my call came from BOA. I never had a XXXX account and the man named XXXX XXXX BOA explained someone was trying to withdraw {$890.00}. Of course, we believed him, and using the same verification of id by asking us to repeat the XXXX digit code sent to our cell phone, we repeated it to him. He then proceeded to open a XXXX account, and transfer the money out of our account. Not until the next day when we went to our local bank did we find out BOA had not called us. This is completely unacceptable to us. We are honest long time BOA customers, and feel they should have some type of protection for us. Please research this again since we could sure use the {$890.00}

Subissue: Told you not to respond to a lawsuit they filed against you
Consumer Complaint: I had a conversation in XXXX of XXXX where I contacted XXXX and XXXX after repeated phone calls. On a recorded line I told them I was willing to set up a payment arrangement to resolve the debt. I was told that there was a garnishment action with an upcoming court date in XXXX XXXX, Virginia and that the court date was for the creditor and judge and I was not authorized to attend the court proceeding. I was told the hearing was not for me and was between the creditor and judge. ( There is a recorded phone call of this and notes from this conversation in their date base ). I was told to call back in XXXX of XXXX and set up a payment arrangement. I called back in XXXX of XXXX and left multiple voicemail messages and did not receive a call back. The garnishment suit in XXXX XXXX, Virginia was dismissed. Subsequently. in XXXX of XXXX my account with XXXX XXXX Bank was garnished for {$2300.00} without me having any notice of legal proceedings against me in XXXX, Virginia. I received no notice of a court proceeding. They have phone records of the XX/XX/XXXX phone call and notes from this conversation. The notes were read back to me on XX/XX/XXXX by a representative XXXX XXXX. When I raised the legal issues with XXXX XXXX, I was placed on a phone call with an attorney XXXX who I spoke to for over an hour. I was told that under the Virginia code that I didn't have to actually receive notice and that my bank account being garnished was " notice enough ''. I raised the issue of this garnishment action violating my due process rights and was told my due process was not violated. When I continued to raise the issue that I would have attended a court hearing in XXXX XXXX, I was told " well this was dismissed '' and it " does not matter. '' My overall point was that I could have resolved this a year ago and not had my bank funds seized as a father of XXXX taking care of XXXX kids. As the call ended, I was told " I am not sweating as much as you think I am. And I hope you are able to have a good day. '' in a very condescending tone. This whole matter could have been resolved 10 months ago, the initial case in XXXX XXXX was dismissed. I was provided legal advice by a representative of XXXX and XXXX not to attend a hearing and had my bank account garnished without justification. XXXX and XXXX is a law firm that specializes in legal matters beyond debt collection as displayed on their web site. They provided me legal advice that has created an adverse impact on me.

Issue: Opening an account
Subissue: Account opened as a result of fraud
Consumer Complaint: XX/XX/2023, I received an email from Bank of America that an application for a new bank account was being processes. A few minutes later another email came thru stating the account was approved. I contacted BOA the same day to inform them that I did not apply to open an account. After the phone call I was instructed to go into a branch to file a fraud report because I was not comfortable giving my information over the phone. I filed a fraud report inside the branch and received an affidavit a few days letter to fill out. I had to submit copies of my social security card, drivers license, and a utility bill to prove who I was. I had several phone conversations during the weeks to make sure they had all information needed to close that account. On XX/XX/2023 I received and email stating that the account was closed. I also received a letter as confirmation. My issue with this is I have a freeze on my social security number due to previous fraudulent activity. I checked my credit report and I did not see any inquiries from Bank of America which should have occurred if someone applies for credit. Even if they inquired, I have a freeze on my social security number so it would be blocked. I believe Bank of America opened this account without my knowledge. I want to file a complaint to uncover how this account was opened and if Bank of America did in fact open this account and put me through drastic lengths to close an account that they opened fraudulently. I found this very disturbing that someone can open an account online with my information with ease but I have to go through drastic lengths to prove who I am even while being physically inside a branch with my identification.

Issue: Trouble during payment process
Subissue:
Consumer Complaint: I have been requesting Bank of America remove PMI from my account for over 5 years. I was told my account was eligible but the letter stated Bank of America needs a property valuation with a fee of {$100.00}. I paid to overnight a check in the amount of {$100.00}. On XX/XX/2023 I called Bank of America about PMI removal and spoke to someone named XXXX in PMI department. To my surprise He advised that regardless of what the original letter statedit was no longer valid because it had been more than 30 days. No where in that original letter does it state This letter is valid for 30 days. Or the customer must send the payment no later than 30 days. This is unfair to consumers and should have been disclosed. It appears now the process will be delayed once again. How much money is Bank of America making by holding these PMI payments for years by setting up these road blocks and delays to avoid deleting PMI.
