Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: I ended up getting my XX/XX/2016 taxes compromised because they said my loans were in default status. The school closed and I was no longer responsible for the remaining debt on the account. Their has been an ongoing investigation for over a year and 2 months and my credit score is being effected because of it. US department of edu. is showing a balance of {$3500.00}, and {$2100.00} when in fact I am not responsible for that. I would also like this and fed loan servicing taken off my credit report as those are both hurting my credit very badly.

Consumer Complaint: RE : account # XXXX I have attempted multiple times to get the late payments corrected on this account and XXXX states that they are unable to correct them. The late payments are for XX/XX/XXXX and XX/XX/XXXX. They are reporting late when they should be reporting as pays as agreed since I was granted deferment XX/XX/XXXX until XX/XX/XXXX. They state they are unable to change something that has been reported accurately at one time. Section 623 ( a ) ( 2 ) clearly shows that the reports must be updated/corrected regardless of whether they were accurate at one point. * Since I was granted deferment for those months then my account should be corrected to show pays as agreed during all those months. I have attached a copy of my deferment letter to show those dates were covered during my deferment. I would like for this to get corrected asap.

Consumer Complaint: My student loans are incorrectly reporting late payments for each loan account listed on my report for the months of XXXX- XX/XX/XXXX. On XX/XX/XXXX the Federal Trade Commission issued an advisory opinion in which it renders a decision on the interpretation of Section 623 of the FCRA ; it states, A furnisher that reports current information to a different CRA has done nothing to " correct and update information '' with CRA that possess the information that the furnisher has now determined is incomplete or erroneous. This duty extends to all student loan accounts reported to CRAs, regardless of whether they were accurate at one point, because the section requires the furnisher both to " update '' accounts as well as to " correct '' those that were erroneous when submitted to the CRA. See attachment For further reference the FCRA section 623 ( a ) ( 2 ) states : ( 2 ) Duty to correct and update information. A person who ( A ) regularly and in the ordinary course of business furnishes infor- mation to one or more consumer reporting agencies about the persons transactions or experiences with any consumer ; and ( B ) has furnished to a consumer reporting agency information that the person determines is not complete or accurate, shall promptly notify the consumer reporting agency of that determi- nation and provide to the agency any corrections to that infor- mation XXXX or any additional information, that is necessary to make the information provided by the person to the agency complete and accurate, and shall not thereafter furnish to the agency any of the information that remains not complete or accurate.

Consumer Complaint: I had consolidated my loans to XXXX. Mid- XX/XX/XXXX I was having trouble making my payments due to low income. I received an email on XX/XX/XXXX stating that they had defaulted and that they would go delinquent if I did not call in. The email stated that they can help. I called in XX/XX/XXXX and talked to a man about lowering my payments. He was very helpful and was to send me documents to fill out to ensure we got my payments lowered. I asked him, if I should make payments until we got the due amount lowered. He stated, not to pay until after I received my documents, mailed them back in, and got approved for the lower amount. I never received the documents. I called back in XX/XX/XXXX letting him know I hadn't received them. I took his advice and kept waiting on documents and not paying. I went to get a car loan in XX/XX/XXXX. As I was attempting to secure the car loan, the lady told me that there was something on my credit that I needed to check in to and that I couldn't get the loan. I looked into it and saw that XXXX had marked me as delinquent and sent my balance to collections. I called XXXX immediately and spoke with a lady and told her that I had been talking to the guy on getting the paperwork and that he had told me not to pay until it came. She went back and listened to our recorded conversation. She apologized that the man had given me wrong information and that there was nothing she could do. She then told me, " If it makes you feel better, he was let go from the company ''. No, that does not make me feel better because now my debt in is collections, I can't get approved for a car loan, and it impacted my credit immensely. I now have issues with the collection agency and communicating with them.

Consumer Complaint: XXXX has mishandled my payment instructions and has delayed for several weeks in fixing its error. Submitted payment of {$95000.00} on XX/XX/XXXX, which XXXX misapplied ( even though I uploaded payment instructions per their direction 10 business days before sending this payment ). Previous CFPB complaint " resolved '' by XXXX and marked closed by CFPB, wherein XXXX stated on XX/XX/XXXX : " [ b ] ecause you provided special instructions for how you want the payment applied, the payment will be reapplied according to your instructions. Although it may take a few business days to process the reapplication, once it has been reapplied the payment will still be effective the date it was received, XX/XX/2018. '' It is now XX/XX/XXXX and no change. I now need to complete my annual re-certification of IDR and my loan balance is not correct due to XXXX 's continuing error. XXXX must do better.

Consumer Complaint: Ive been trying to make on-time payments every month, but unfortunately American Education Services does not give me any options to lower payments or to lower my interest rates. I have asked time and time again for help but they give me vague responses and no help to deal with this problem. I want to pay and eventually free myself of student loan debt but my interest rates keep changing and going higher. I feel I will never be able to reach my goals of paying everything off. Im afraid if they go too high with my interest that I wont be able to make payments. My monthly bill is {$720.00} a month, now it could be at {$730.00}! When does this end? When will there be assistantance to people who want to do the right thing? Am I being scammed for my money? What can I do to pay the principal down? I havent had any answers or help for almost 10 years! I dont want my entire life to be about paying a company who wont work with me to pay them off. Im growing emotionally tired every day from the frustration and helplessness. Someone please tell me what to do? I cant even refinance this loan. My credit is just not strong enough. I was once instructed on the phone that if i wanted a lower payment I would first have to be delinquent on my account, but that hurts my chances of having a better XXXXredit score to refinance eventually. Nothing makes sense anymore.

Consumer Complaint: I have been employed in XXXX XXXX since XX/XX/XXXX( FEMA ) and have been paying my qualifying student loan every month using Income Contingent Repayment or Income Based Repayment plans since XX/XX/XXXX. I have paid every month and my loan is in good standing. I meet the two qualifications for the Public Service Loan Forgiveness ( PSLF ) Program ( 120 monthly payments and working for qualified employer ), yet I was denied. My employer was determined to be qualified. XXXX is not counting my long history of on time loan payments with my previous two servicers. I have attached a data pull from NSLDS on my loan showing this and I have attached XXXX 's loan payment data. DESCRIPTION OF QUALIFICATIONS - PAYMENT HISTORY AND ELIGIBLE EMPLOYER 1 - I have made 120+ qualifying payments >Between XX/XX/XXXX and XX/XX/XXXX. Consolidated loans in XX/XX/XXXX with XXXX XXXX XXXX , XXXX XXXX XXXX. Began payment as ICR, then switched to IBR. Maintained loan in good standing by paying every month, made 53 payments after XX/XX/XXXX. >Between XX/XX/XXXX through XX/XX/XXXX. Loan held by XXXX, a XXXX XXXX XXXX Servicer. I paid every month, note several short ( <30 day ) deferments while XXXX worked out the yearly amount for IBR payments. Record of 65 payments made to XXXX attached. > From XX/XX/XXXX through present. Loan switched to XXXX after requesting PSLF. To date, made 8 payments. 2 - I am a full-time employee at a XXXX XXXX ( XXXX ) from XX/XX/XXXX through present, when I made each of the qualifying payments CORRESPONDENCE DATES : >Submitted Employment Certification Form to XXXX in XX/XX/XXXX. >XXXX received my Application for PSLF XX/XX/XXXX >XXXX denied my Application for PSLF on XX/XX/XXXX. Consumer Complaint: The student loan representative promised for there fee of XXXX a month my loan payment would be reduced and no interest for three years would be charged to my account. In addition the consolidation was at 7.5 % which I assumed would start XX/XX/XXXX. At the end of the three years of no interest. My loan was given to XXXX and the representative reported that he was with the student loan company ; NOT ; XXXX XXXX and they indicated they dont use third party companies to get there loans consolidated. Soon afterwards, I received a bill from XXXX and XXXX XXXX for XXXX in XX/XX/XXXX. I checked to day after making 5 payments to XXXX XXXX XXXX and owe more then I did when I started to pay them. The account is showing and listed as a CREDIT CARD on my credit report and now showing that I am late. I never applied for a credit card with this scam company!!! The representative stated today ; that a payment in XX/XX/XXXX was not received and they JUST posted that the account is late ; and NOW I owe them {$150.00} in late fees and plus the monthly FEE. How is this company still in business with ALL of the negative business practices that they are currently doing. Who can I contact for legal advice ; I was in the process of buying a house and my credit score just dropped 30 points today XX/XX/XXXX

Consumer Complaint: In XX/XX/XXXX I started a Business school and took out a Student loan through XXXX XXXX ( I think the 3rd word was XXXX ). The school closed 1 week after they cashed the check. The loan was for XXXX. I never went to school and after never hearing from them, I was asked to start paying back in about XX/XX/XXXX. My current husband and I had our Federal Taxes withheld to pay for this 4 times totaling more than XXXX. In XX/XX/XXXX the loan was sold to XXXX and they were paid at least 1 year at XXXX/mo and a Federal income tax check of over {$800.00}. All of a sudden XXXX is showing the amount due as {$4800.00}. In XX/XX/XXXX, the loan was sold to XXXX XXXX XXXX with a balance of {$4200.00} and I didn't have to pay anything because I didn't have a job and they said they wouldn't use my husband 's income because he wasn't responsible for this debt prior to knowing him. Now XXXX XXXX XXXX wants $ XXXX/month because I have a job and make about XXXX/month. I wouldn't mind paying off the loan right now if it was just the original amount. We've paid more than the original amount and fees, but none of it has ever been credited.
