Issue: Getting a loan

Subissue: Fraudulent loan

Consumer Complaint: I was previously a student at XXXX university graduating in XXXX. I received a lawsuit from XXXX XXXX trust XXXX in XX/XX/XXXX which I ended up settling with and paying. Now that I look back I do not have any substantial documents regarding my loan or payments to XXXX XXXX. I am reading on the new laws and what has happened in recent years in regards to borowers being duped and having no proof of these loans. Am I eligible for a refund of what I paid XXXX XXXX? I actually settled with a law firm called XXXX XXXX XXXX XXXX on behalf of national collegiate.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I graduate College in XXXX with approximately {$18000.00} in student debt with XXXX XXXX. It was an initial interest only payment for 7 years, then a structured payment for the remaining life of the loan. In XXXX my loan was transferred to AES and my auto debit payment continued every month. Due to an error on AES ' part it was applied to interest only for another 7 years. 14 years of paying {$110.00} per month for a total of approximately {$19000.00}. I have paid more than my original debt, but still carry the full amount on my account because of their mistake? or is it fraudulent behavior? After researching this it seems there are many others in the same situation as mine ; all starting around XXXX. This type of activity is criminal. I am a consumer who paid every month, in good faith, and amount that was requested to satisfy my loan in a timely manner. Individuals have gone to jail for less than this. I will not stop pursuing this until a fair, reasonable accommodation is made. I repeat myself, this is theft, someone needs to be held accountable.

Issue: Dealing with your lender or servicer

Subissue: Need information about your loan balance or loan terms

Consumer Complaint: In XXXX I lost the employment and had to get off my income based repayment plan and was moved to forbearance due to unemployment. I regained employment in XXXX. I called AES to request that an Income Based Repayment ( IBR ) plan application be mailed to me. After a few weeks I called back and was told that the IBR was mailed but that they would send it again. A few weeks later after receiving nothing I called back and was told that nothing was mailed either time and that I can go to the website to get the application. I said that I don't want to go to the site and asked that get the application mailed to me as I did 3 calls and 2 months prior. A few weeks later I called again for a fourth time asking where the application was because I still haven't received anything. I was told that the " systems were down '' and that " nothing could be mailed but I could go to the website ''. I told that person that for the fourth time and 3 months after my initial request that I still want the paperwork mailed. After receiving the paperwork I completed the application as instructed and faxed it in along with the required pay stub. 2 weeks later I got an email saying that my application was denied and I have to stay on my current plan. I emailed back saying that how could my application be denied? I am working and want to start repayment but can not because they denied my application and want me to continue paying nothing! They replied back saying that I was denied and have to stay on my current plan. I replied saying that is ludicrous. I can resume repayment because I have income and don't want to continue paying nothing. AES 's response was that I must continue on my current plan until next year when my current repayment plan is up for renewal. That is insane. They owe me for the 3, now 4 months of accrued interest and to go over with me terms of repayment. What AES is doing is CRIMINAL.

Issue: Struggling to repay your loan

Subissue: Can't temporarily delay making payments

Consumer Complaint: I am a XXXX in Oklahoma who gets paid once a month on the XX/XX/XXXX- always have and always will. XXXX has known this since XX/XX/2012 and has NEVER allowed me to change my due date to the XX/XX/XXXX. Even now, when I am having a major water leak, no running water in our home and after being defrauded out of almost {$1000.00} by corporate greed in XX/XX/XXXX- I also have a new student loan payment to contend with. I need help to get my family back on our feet again- this couldn't have come at a worse time. I applied and was denied a XXXX XXXX that can be used unlimited number of times with no explanation. I deserve that if anyone does! We appreciated greatly the forbearance this past year and we desperately need another length of time to finally secure some vestige of a financial future despite my egregious loan amounts. I'll NEVER be able to even pay a dime of the principal, I've dedicated my life to XXXX and kids ... and since Student Loans are the ONLY debt no one can EVER get rid of- We suffer - year in and year out because I went to college right when it was most expensive and least valuable. Now I commit my life to kids and my community and give back EVERYDAY with no hope of ever getting out from under my {$140000.00} in student loans. I borrowed about {$45000.00} total. The rest is fees, interest, and money the Federal Government is making off me ... a guy making {$31000.00} a year. Can someone please help us get a forbearance or debt cancellation. How can we live our lives under this incomprehensible debt? Being forced to pay a bill 4 days before payday that you can not afford is a recipe for more lost funds for my family! Please help us- we may be forced to move soon and need help!

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: First, about a month ago, AES charged me {$4000.00} in interest for ONE day and they also would not help me change my due date to better suit my paychecks. Then they negatively reported my account to the credit bureaus. After reporting them to the XXXX, they fixed it. Now the payments are due on the XXXX of each and every month. This past XXXX (XX/XX/XXXX ), I noticed my payment did not come out of my checking account NOR did it post to my account on AES. When I checked to make sure that no payments were pending, I made a payment as a warning on my account said the payment was due and late. Note that I believed I had a direct debit set up but their system said I did not. So I made a payment. I then checked the next day and it now showed two payments ( one on the XXXX and one on the XXXX ). I called them and complained and said they needed to return one payment and I told them the problem and they said " there is nothing they can do and it would take 30 days to return my money ''. This is NOT ACCEPTABLE. This loan company has been XXXX me over for a long time.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I am seeking student loan forgiveness through the PSLF program. My account has been under review with XXXX for the better part of a year due to my account somehow being arbitrarily placed in paid ahead status. They are not giving me credit for approximately 2 years worth of payments, despite the fact that I have never paid more or less than the amount due, and have never been late, and have always made payments without fail since XX/XX/2010, except for periods of forbearance. I have two loans serviced by XXXX. On one loan they have it listed as 47 qualifying payments, and another as 59 qualifying payments. I pay one amount every single month, which pays both loans. I have called countless times, always receive the same responses : that my account is under review, and they should be finished with it soon. They always tell me that there is no reason any of my payments should have been denied, but every month my statement shows the same number of payments, despite submitting new employment certifications, which is when they claim to update the number of payments. I have copies of banking records verifying every payment made over the last eight years, but I dont think I should attach them here, but I could provide them if requested.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Today i called XXXX XXXX XXXX to see what my new monthly rate would be on the income based payment program. I was told months ago before i could reapply for this i had to make 3 consecutive monthly payments of {$170.00}. I made the 3 payments and submitted my paperwork for the application on XX/XX/XXXX. When i called a few days ago they told me that i should know something by the XXXX because my application is still processing. Today they told me that they would not be able let me get on the program because i did not make my payments on time. I said my payments were accepted and i asked were my payments considered late each and every payment. In fact, when i called back in XX/XX/XXXX of this year, the gentelman on the phone told me i actually paid my payments weeks in advance and i did not have a payment due XX/XX/XXXX. My previous payment covered my payments and i am in good standing nowhere near late. I was told 3 seperate peices of information. I was told my payments were never late, i am in fact qualified for the repayment plan and i was most recently told today XX/XX/XXXX that my payments i made of {$170.00} did not count because i didnt make them on time. Im extremely angry with XXXX XXXX XXXX with giving me false informatiom each time i called. In the past week i have called XXXX XXXX XXXX to check on my processing 4 times. This is extremely stressful and frustrating for me and i need this resolved immediately.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I have had continuous problems with XXXX XXXX. They are taking advantage of people with student loans under the Public Service Loan Forgiveness ( PSLF ) program. They will not consider taking into account I have made over four years worth of payments to XXXX XXXX before moving my loans to XXXX XXXX in XX/XX/2017. XXXX has yet to tell me how many total payments I have made toward my 120 qualifying payments before the loan is considered forgiven. I have made numerous phone calls ( more than 5 ) to get an answer to this question and have not received back any consistent answers. They currently say they have my loan under a review, but that it could take months for them to make a decision about how many of my payments should qualify for their program. They also claimed they would not considered any payments that I paid ahead ( I explained I did this because of building interest ). I was promised calls back numerous times and no one reached out to me or returned my calls. I have been with XX/XX/XXXX for over two months and have yet to receive any notification of how many qualifying payments I have made nor have I received a date of which I could expect to be eligible to apply for loan forgiveness.

Subissue: Received bad information about your loan

Consumer Complaint: In XXXX XXXX required that I direct consolidate my loans in order to qualify for PSLF. I had previously direct consolidated my loans, but did not have any documentation. I recently found an email dated from XXXX informing me of my submitted consolidation application. As of right now XXXX will only review payments made since my XXXX reapplication. However, I have been paying my loans since XXXX and would like all my payments reviewed to determine whether they qualify for PSLF. I'm attaching the email that was sent to me in XXXX in response to my direct consolidation application.
